She's on my bank account, but they would only add her with her maiden name since she has no id yet that has her pic+married name, and first thing with that will be her state id, need the EAD to get state id to add her to my bank account, also need the EAD to get her ss card changed from maiden name to married name.

They all work together in conjunction with the EAD

Ahh. We didn't care about name change so we didn't have this issues.

You will be able to sort it out once GC or EAD

    Have an easy AOS interview!

Exactly they wanted to see the EAD but agreed that we are doing things properly, so when we get the EAD going back and getting the state ID and hopefully happens before the end of the month so can get all joint evidence gathered for the GC interview on 3/10

She can be added to bank accounts without a state id. She can use her passport.... It worked for us. The only thing might be hard is getting a credit card since she cant prove her residency, but for joint account it shouldn't be a problem.

Called my local DMV, about what paperwork is required to bring up to get my wife's state ID (my bank said they want an ID showcasing both married name + photo) so state ID would be the option, she currently doesn't drive so drivers license is not an option.

The worker at the DMV kept telling me she needs a document showcasing her length of stay and something along those lines, and I continued to tell the person that she is in legal status as she has an I-485 that is currently in progress and has been submitted and awaiting her green card interview.

The guy kept telling me the NOA's showcasing that her I-485 would not work as that does not show length of stay or something along those lines.

From my understanding she should be eligible to get a state ID as she is here lawfully while awaiting her green card interview.

I am confused as to what this guy was even talking about

Depending on your state she might be out of luck. The filed I-485 is not a legal status. It is more like we tolerate you but you are not a resident.   On the NOA1 has like twice a sentence with like 20pt of text saying it doesn't give any immigration benefit.

If the K1 is still valid she might be able to get a state ID with that for 3 months (90 days after she entered)

Right now the legal status she has/had is the admitted until on the I-94.

If nothing works she will need to wait for the EAD or greencard to be able to get a state id/drivers license.

    Hi,

I recently found out that my UK driving license is no longer valid on Californian roads after moving here. I am an EAD holder waiting for my AOS interview, what will I need to take to the DMV and will I need to take the knowledge test or just the driving test?

    Thanks

You will need to take everything. Driving, knowledge, road sign test...

Probably u can get a RealID, but it's validity might be the same to your EAD.

Read the requirements but in general for real id u will need two different bill/bank statement with your name on it with the address where u reside. You can find everything on the DMV website

I know I won’t be able to work yet, but can I still send out applications and go to job interview while my once I send off my AOS

Sure, but keep in mind that you might be burning bridges if u have no authorization.

Depending on your field some companies won't even talk to you before u r authorized for work. (At least that was my experience)

If u send out a bunch of resumes you might risk being in their system and not trigger anything when u resend your resume in a few months....

It is tricky, look around if your field has meetups, groups where u can network without just blankly sending out resumes.

    Hello,

I booked my tickets via American airlines and it is asking for my visa information. I have an expired H1B, and an approved EAD Combo card. Should I just put in the EAD number in the visa section?

It depends on the airline. I needed to check in at the counter after entering all the details from the  GC. Looks like I was selected for extra security checks(zzzz or aaaa or whatever marking) at my connecting flight to the USA. Beside the inconvenience nothing hapened.

At the kiosk scan your ead. Sometimes the readers are not that good reading tiny cards so no panic just try it again in a different orientation, location, pushed down, held, just let it float etc... Took 6 minutes to get my GC read... Now I am wondering if something is wrong with it

I apologize, this is not really an administrative "visa" related question, but a challenge we probably all share. I am wedding planning with my fiance and we are at the point where we are ready to make a deposit on a venue, purchase dress, etc. How conservative should we be on spending money before he has his visa? Is it a bad idea to put a deposit on a venue in case something goes wrong? Anyone have similar experiences/stories?

Do not do any of it.

Once the visa is approved you can get married at the courthouse or pay an ordained person who could marry you at home or in a park of your choice or if the courthouse is not romantic enough.

After that file AOS and then start planning the wedding.

The forum is full with ppl paying deposits for venues, catering and then the processing times going up or visa denied...

My fiancé lives in Romania and we are trying to figure out the logistics, reality and costs of moving some household goods and possibly a vehicle from Romania/Europe to the US. Household goods will be some boxes, no furniture or large items. Vehicle is a sedan.

Does anyone have companies that they can recommend for either boxes or vehicle?

Not sure if this will be helpful or not, but the car might not worth it to ship and once here it runs on different fuel (octane count) so it might be just pricier to fuel it up. (Probably the 85 unleaded would not work)

I know it is hard to give up stuff, but most likely the value won't worth the shipping cost of bigger items. That is one downside of moving across the world....

My fiancée lives in the US and our wedding is planned for early July this year. So long as the fiance(e) visa is accepted soon, I plan to fly to the US early to mid April to help organise the wedding. We have been considering signing the wedding papers together as soon as I arrive there before the actual wedding ceremony, so that the green card can begin processing asap, but we're not sure if that would be a good idea or if the US government wouldn't like it. What do you guys think?

First get your SSN and then go and do the courthouse/ordained person wedding and submit the papers for AOS

It doesn't matter for AOS if you will have/had a big fancy wedding or just a courthouse/ordained person marrying you at home.

I have heard that once your fiance' is ready to come to the US, that their ticket should be a round trip and not a one way. Is this advice coming from the US Embassy?  I understand that most round trip tickets are even cheaper than a one way. I'm just wondering about the messaging that the Embassy is sending.  What is your opinion? And for those of you lucky enough to have your fiance/wife here already, what did you do?

You don't need a roundtrip ticket. Sometimes i can cause more problems if not canceled.

You definitely need a roundtrip ticket if using ESTA. Maybe for B too? Never had a B visa so not sure.

When got my K1 I bought a one way ticket because it was travel season and it was cheaper than a round-trip.

She owns a house, she has money in the bank, more from inheritance and all. How can they conclude without even checking.

Did you guys provide all the documentation for this? They are not going to check anything for you. They look at the evidence you provided with your application. If u didn't show bank statements or investment portfolio when you had the chance might be interesting to know if you can add more assets now and try to work around it instead of getting a joint sponsor.

And $40k a year is not rich by any means.

  12. They also take into consideration of your age, education, how likely u will be able to find and hold a job. Your old job history and so on.

Do you have any significant age difference where she is much older than you and won't be able to support you in the future? Being rich doesnt guarantee that she will leave all that money to u.

Also owning a house is not considered as asset if it is the USC's primary residence. If she sells it where r the two of u gonna live?

I have question regarding trip outside of US.

I became LPR since 2017, however due to having babies, I have to stay in VN to get help for caring the babies from my mom in VN, so I have stay in VN with my USC husband from 2017 - 2020. I have applied 2 reentry permits since 2017. I filed tax jointly with my husband every year since 2017, we have joint account in us, with joint credit card.

Im planning to going back to the US in 2021 and apply n400 in 2023. When they ask about the trips outside of US, does this question mean 3 year since I file n400? which is 2020 to 2023

Because Im outside of the US from 2020 to 2021, will it create problem during n400 interview?

or should I wait until 2024 and apply for n400, assume that from 2021 to 2024, i did not travel outside of the US, so there should be no trip outside of the US at all.

Which year should I apply, 2023 or 2024

Thanks guys for your help, Im really appreciate it.

I think you will need to wait five years after you come back or best case 2 years and one day if the clause at 16 applies to you

    https://www.uscis.gov/policy-manual/volume-12-part-d-chapter-3

An applicant who is required to establish continuous residence for at least 5 years [15] and whose application for naturalization is denied for an absence of one year or longer, may apply for naturalization four years and one day after returning to the United States to resume permanent residence. An applicant who is subject to the three-year continuous residence requirement [16] may apply two years and one day after returning to the United States to resume permanent residence. [17]

I did fill the askNVC form but they are responding to forms they received at December 10 2019 so there is a 2 month delay. I tried to call NVC too but it just says every officer is busy and hangs up.

Try calling NVC at their opening time. Don't remember the exact time but sure u can find it googling it. Probably u will need to hold for a while to get an officer. Try calling from Skype, hangouts etc so u won't rack up a huge fee. Or ask your dad to call them from an US phone number.

If you plan on changing your last name (+ of course getting your documents such as passport and drivers license changed to the new name as well) you can use the new married name for all intents and purposes on the form, your marriage certificate serves as your proof of name change

Does the US takes a foreign marriedge cert as a legal document backing up the name change?

Iam a us citizen and i petitioned for my wife to come here from the dominican republic, and im at the stage where im just waiting for the interview letter.

Of course when i filed the affidavit of support it was last year and i used my tax returns from 2018 year, in other words those are the most "recent" tax returns they have, but since its a new year i wanted to know if they will ask for the tax returns of 2019 now even though those were not the ones they have on file.

The reason i ask is because the tax returns of 2018 they have meets the minimum i have to have made to bring her over here, but the NEW tax returns i just did a couple of days ago i did not make enough, so can i just say i havent filed my taxes this year since technically i have until april 15 to file my taxes, or will they know i did my new taxes 2 days ago at the interview?

If you didn't file it yet with IRS and just calculated it at home then no issues.

If you already submitted it to IRS then that might be trickier as others said. In theory they should be fine with the 2018 if her interview is before 15th of April and u didn't do your taxes for filed for an extension (providing the extension letter)

Start the conversation with “oh wow, it’s kicking again” and then the pregnancy topic will start. May be the IO will not ask hard questions even if he was planning to. Good luck.

Hope that was just a joke. She will be under oath and I am not a woman and dont want to say what to feel or not but in biology class we all learned that a mom will feel the baby's kicks only after 5-6 months of pregnancy. School was a long time ago so I might be wrong.

Beside that sure u can mention it, if u have pregnancy care documents/ultrasound u can add it as an evidence if you wish.

It should not be weighted more, but as others said might change the interviewers behaviour since we are all just humans.

    Congrats!

anyways, with the outbreak of the coronavirus, my mother-in-law wants to apply for her green card.

Then why she wants to travel back and forth? Looks like the corona virus has nothing to do with the case.

If she applies for Advance Parole (and approved before she leaves) and the ban is lifted then she can travel back and forth

So I was reading my cover letter for the AOS package that we sent yesterday and instead of writing DS 3025 (overseas vaccination), I wrote form I693. Am I gonna get an RFE because of this?

    thanks!

Hopefully not. It is not required to file it with the initial petition. Maybe they just ignore your cover letter.

does change of address after filing ROC automatically triggers RFE for more documents ?

People who changed address after ROC got RFE please reply here.

Have no first hand experience about it but why would trigger RFERFE of what?

I would understand for N-400 because there is a requirement to reside at one jurisdiction for at least 3 months before filing...

Btw it doesnt matter because you MUST notify USCIS within 10 days of your move. Also the sponsor needs to file a different form and mail it in if he/she moved too

My wife didn't get her green card yet.  We're still waiting for the green card interview.  Does that change your answer?

    Thanks.

She can be considered resident for tax purposes  since she lives here.

    https://www.irs.gov/individuals/international-taxpayers/determining-alien-tax-status

She fails the green card test but passes the substantial presence test.

She has a ssn so just file and report her december income

I did file the I-864 and nothing has changed since then. As far as I know her medical was complete. She only needed one vaccination at the exam which she got. They passed her with a clean bill of health with no flags or anything.

I would wait for somebody else to chime in, but I think you are fine. It is good that she got the vaccination overseas. If you can locate the DS3025 just to be sure that would be great.

K1 vaccinations are a subset of vaccinations required to AOS and not everywhere they do the vaccinations.

Good morning all, I just have a quick question about my wife and I's upcoming AoS interview. She interviewed for the K-1 with the affidavit of support, medical records, etc in June of 2019 and entered the US in July of 2019. The AoS interview letter asks that we provide the medical records as well as the affidavit of support if not previously filed. Am I correct in understanding all the forms filed in June of last year should still be current for the AoS interview next month without the need to redo new forms or do I need new copies? I'm fairly certain but just wanted to double check to avoid any issues at the interview. Thanks in advance for any insight you can provide.

I assume you did file the I-864 with AOS (different from the K1 affidavit). If nothing changed with your employment and such u wont need a new one.

Is her medical was marked complete? Meaning the DS3025 has nothing related that the applicant elected NOT to be vaccinated at this time?
