  1. Not sure waiting for the response to the RFE will count in the processing time. Also you waited 2 months to respond to the RFE so give them 2 months after the received it.  But otherwise can understand your frustration but there is not much you can do unless you want to force them to make a decision which can or can't be to your favor. It's like forcing somebody to make a decision when they are undecided.

I've seen two types of advice for working while waiting for EAD so I thought I would ask just to see why that is.  My spouse has sent in her AOS and EAD applications but has been asked to start working by a potential employer.  She told them she is waiting for EAD and they said they would pay her in cash so there would be no problem.  Regardless, we're both worried about any issues of working before EAD is approved.  But I've seen on VJ that people have said illegal work is no problem for spouses of US Citizens.  So even if USCIS found out it wouldn't be a problem?  How would it even come up, in the AOS interview will they ask if you've ever worked while in the US?  And why have I also seen on VJ people saying that you cannot work before EAD is approved, no exceptions?

    What others have said plus

Think about when they will ask if you work or not at the interview. basically you will admit it because lying to immigration is pretty harsh, but then you are in a catch, because you didn't pay any federal/state taxes, ss contribution from your income....

Yeah it sucks waiting for the EAD, but you can try to expedite it with a written job offer (if the company willing to give you one) or they are just looking for cheap labor since she will be working illegally she will have no voice or legal ground for anything. She can be let go when she refuses to go in on a weekend or do 3rd shift or clean the boss's car or whatever. You get the point.

    Hi all,

just received my first receipt notice for my AOS case in the mail. On here and on Reddit I see some people reference the Lawfully app. In anyone's experience, is the paid subscription worth it? How accurate are the timelines and case analyses? Thanks in advance!

Hmm you need to pay for it? Never tried it, but that three review on their website seems so fake. A user review doesn't look like that...

Anyway you are the data. They claim to have 250k. If those 250K don't update their status (report it) they can use as much machine learning as they want because it won't be accurate. You can search the forum and add a few months of padding and you have your free estimate

Hi there I was wondering if anyone has gone through this I filed my roc i751 on March 17th 2021 send it via fedex on the 18th and it reached Arizona literally the next day and it was signed by someone the name of f brown. I filed my form during my 3 month window and my green card expired March 28th 2021. It’s been almost 3 over weeks and I have not received any receipt nor has my cashier check been cashed. I emailed the lockbox support a few days ago so I haven’t heard anything from them. Desperate for help cuz I don’t know what to do!

It will take a month to get the NOA. Just don't leave the country.

Help!!! My husband is a March filer and we received his package back  in the mail today as rejected bc I filled out one part incorrectly. ( I know ). They stapled a paper that we are invited to resubmit once I correct the mistake.

My question is: currently the green card he has is expired and now that we have to make the correction we are outside the window which they require to apply. Can I just correct my mistake and send it back ? They also sent back my money orders, can I just resend those as well??

I would make a copy of the rejection notice and add an explanation of why u r filing late (it was rejected first time and u r refiling and attach the copy of the rejection notice.) You can send the rest back as is after u corrected your mistake. Check for updated forms since u your initial filing was a month ago.

  6. Why start with a 3 months visit? If this is your first time in the US  and meeting him for the first time, go for a more normally accepted 2-3 weeks and most likely you won't have a problem at the border. Had a friend come over in 2018 (first time US traveler) for 2 months and while she was not in secondary the agent asked her questions and doubted the legitimacy of her visit and at one point she was able to show them her UK insurance/work permit i guess, don't remember exactly what card it was, but it proved that she works in the UK even tho she took off 2 months time.

When I was visiting for 20 days at a time, had not issues, told them visiting and the agent asked about my return flight date and that was it.

rrespective of which country you live, if you are working for a organization, they should have insurance policies where you have both spouse names . do you or your spouse have any ?

That is not true at all. Most European countries have universal healtcare systems were everybody is insured if they work, no need for paperwork, the employer takes out of your part from your paycheck and sends it to the government.

Hi! so my interview was finally scheduled for mid april after first applying in june last year.

I live in Belfast, although the interview is in London as expected.

The only problem is my passport is the only photo ID I have, as such I didn't realise they ship your passport back to you with the visa inside.

I need to fly back to Belfast.

    Any ideas?

Can't you get a state id or something? Or a secondary passport and leave the first one at the embassy?

I just called and they are closed to the public, they said I'll have to mail my GC to them and it takes around 8 weeks to get it back I don't think I can do that since we must have our GC with us at all times 😬 I will wait a bit until they open to the public

Yeah. I would not mail my GC to anybody because if they lose it, it will take forever to get another one. Better to wait in this situation.

    Hi everyone !

I recently got my conditional Green card, I already have my SSN card (the one that says only valide with a work authorization). My question is do I have to apply for a new SSN card or there is no need and I can continue using this one ?

    Thanks for your help !

    Hi

You don't have to but it is recommended to update your immigration status with the Social Security Office. (not just for the card) The number will stay the same as other said but the annotation will be removed.

This is good when you will need to get a job and fill out the I-9. The conditional green card card will expire, the SSN card won't so you can fill out the I-9 with your driver's license and SSN card so you won't need to deal with the expired green card at least from your employment perspective. My card is expiring next month and I am sure HR would be on me by now (they were on me when my EAD was expiring) to show the new card which I won't be able to because it will take a while to get one, and the extension letter is a hit or miss depending how well versed the specific HR department is.

Anyway it is not super urgent but better to do it sooner than later.

    Dear All,

We have file a petition that need to address the issue of calling foreigners as Aliens in United States.

This has been used for a long time and almost everyone is not happy to be called ''Aliens'' and I think this need to stop, especially now that there is new government that respect dignity of all human being. Your part and mine is to sign this petition link below so we can push this change for generation to come.

    Thank you.

    https://www.thepetitionsite.com/485/917/361/alien-end-the-word-in-united-states/

Note: Admin - Please you know the category this can be to boost our motives, appreciate your support to move/repost it if necessary. (Thank you)

I appreciate you are trying, but why not a bill or petition to reduce the year long waits to get a GC interview, or ROC, etc?

Honestly I don't think it matters much. I don't feel offended by it. Just look at the refugee crisis in Europe caused by the wars in Syria, Afghanistan, Iraq, etc. The news labeled them "migrants" instead of refugees. Do you want to be called migrant? Is it better than resident alien?

Changing a wording on a card or documentation that a typical american knows NOTHING about it won't change anything. Y

You are still going to be an alien, immigrant, etc and face the same discrimination if you are unlucky as before. Nobody uses the term resident alien when they try to discriminate against you, they will just call you illegal and threaten you with ICE. Also even if you become USC and you have an accent everybody will now that you are not from here, regardless what your status is. Just embrace it, it makes you unique, don't need to be assimilated. Do I work time to time on my pronunciation? Yes I do, BUT only to be able to express myself clearly to others and I am not trying to get rid of my accent. I think I am privileged because I am white and otherwise blend in and 100% for sure I had a way different immigration experience due to being white than others might had and I am not denying it, but feels like spending a bunch of money on semantics won't fix the underlying issue.

I have another question. Here in this country (Colombia) they give marriage visas to a foreigner in a civil union.

In the eyes of the US, would the civil union make us ineligible for the K1 process? I'm just looking at the civil union as a way for us to stay together here more permanently while waiting for the K1 time haul and then actually get married in the US.

Looks like that civil union is very similar to a common law marriage in the US, so probably it does have implications for k1

    1. They want documents that cover the entire marriage. Yes it's redundant. But you also never know what may have been lost.

Also it is a good way to try to weed out fraud since for example I have no idea what I submitted almost 3 years ago. (yeah it is my bad). Regardless they might receive new evidence from the previous time period or contradicting ones. I am sure they have everything scanned in lately so less chance to lose something.

Hi everyone I don’t know if iam in the right section to ask my question related to tourism visa .
i overstayed my esta and I have a 3 year bar . I know That there is a waiver called 212 (d)(3) to be admissible to the us through a b2 visa. Everything through the the ambassy as it is g the discretion to the co to recommend you for a waiver .
does anyone here have already gone through this path and had an approved waiver ? if yes can you tell me how you convive the co to recommend you for the waiver and what evidences you put when you file .
your help is so much needed

    tank you so much

I think you can pay and try but the burden is on you to prove that you won't overstay again which will be pretty hard most likely. You will need to provide convincing ties to your country. If you got a 3 years ban it means you overstayed at least 180 days which is probably proves that it was intentional.... Another question for B1 will be even if you get the wavier if you worked illegally while in the US....

When did you receive the 3 year ban? Did 3 years passed since then?

  15. I had accident and critical illness insurance from National General  Insurance https://natgenhealth.com/ . Not sure if it started immediately or the first of the month tho... If I remember correctly it was month by month and could cancel anytime. Even if you start working in 40 days, your insurance might not kick in on the first day (depends on your employer) and you can have multiple overages too. And yeah it was not a $100, but also not $500  it was around in the middle and basically it was for being in a car crash etc. As others said since you are already an LPR you can get on https://www.healthcare.gov/

and buy insurance from the market place.

And btw, my employer asked for my green card too for verification

Mine previous job asked for it too, and I told them that is not going to happen and send them the instruction for the I-9 highlighted that they can't dictate which documents I use for the verification. After a bit of back and forth I did SSN and DL. I think it depends a lot on the employer and how many immigrants or works on different type of visas they have.
