    As a LPR Customs and Border Protection won't issue a new I-94 when you enter the country. So your I-94 is probably 5 years old or more (last time u entered the country before receiving the GC)

     

    I think the travel documents refers to Passport, Greencard, Advance Parole, Refugee travel document etc. I think you will be fine. Just bring what you have.

    Probably you can wait a week to travel after approval, so you would have the card in hand.... That would be the safest I think...

    What if it has a misspelled name on it? Or wrong expiration date, etc and you are out of the country?

    It is not relevant unless he has/had a 2 years home country physical presence requirement. Even with that is not relevant, but it will be harder to get an exception for the 2 years requirement if applies to him.

     

    When he will complete the DS-160 for the consulate interview he will have a chance (required on the DS-160) to answer questions about being in the US.

She would not tell me what was the mistake or share any information. I no longer live in that state.  It has been over a year since my naturalization. 

    I am little concern that it is a spam call.  

     

    Is it normal to receive a call from USCIS about certificate?

    Try calling the number back? Or just call the USCIS hotline and try to talk to somebody there....

    He doesn't need a DL to work unless he needs to drive to work. He can use his passport and stamped visa to complete the I-9 for employment

    I thought once he had his social card he could apply with his passport and visa.

    The IR/CR visa (not K1) in his passport is the green card until he receives his plastic GC.

     

    He can use it to get a DL and start working.

     

    Btw I assume your dad was referring to the I-9 completion. Even without a DL he can use his foreign passport with the stamped visa as listed in List A of the I-9 as proof of legal status and eligibility to work.

    Sure you can lie if you want but don't be surprised when they are gonna ask for more evidence about the period you lied about and you can't produce the evidence or dig yourself even deeper. They will catch you for sure, the consulate ppl are not stupid, they saw every possible combination by now. Also even if you made it they still can catch you and strip your LPR or citizenship when the lie is discovered.

     

    You definitely can overcome a big age gap, but not in a few months old relationship. Also proposing on the first visit???? Huge red flag. Probably you will need to date for a while (a year or two) then file...

     

    Visiting orphanages won't help your case  and taking pictures in an orphanage seems super desperate. It's not a shopping mall geez.

    Thank you for your input, definitely ruling out the ESTA. I’m just wondering if the fact I applied for a B2 will have any effect on my spousal application? I suppose they contradict each other? I DO plan on immigrating, just not on the B2. Not sure if that will fly.

    No. Approved or denied B2 has no effect on it, just make sure you filled out all the forms correctly where it asks about previous visas..

    That NOA1 is so weird. In theory it should help you but it has a box where it says in BIG letters that it doesn't grant any immigration benefit.... so I never carried that. Once I've got my EAD I got a DL and carried that. When I got my GC I made a color copy and put it in my wallet, but never have the real thing with me (even tho the law requires it) unless I am traveling out of state or country. It is just too valuable to lose it. It takes forever to replace it not even thinking about the price of it. Also printed out my A number, visa number, MSC numbers etc to a tiny bit of paper and put it in my wallet. I assume based on that somebody competent can look up my status based on those information.

    You have to have a valid ID with you all the time. Even when you walk your dog or whatever. Which right now is your passport.

    In theory you don't need anything beside your ID to travel the states, but it's better to have the marriage license/certificate with you and the proof that you field for AOS. As others said try to avoid the border area +- 25 to 50 miles (don't remember exactly) because some regions have immigration checkpoints.

    Also you can fly nationally if you want.  I used my passport to board the flights without any issue.

    On a site node, I think we have some kind of white privilege because we can pass as Americans (before we start talking lol) and it's more less likely to be targeted at airports or traffic stops for "random checks".

Then, today I saw the notification that they scheduled our green card interview and that they will mail me a notice with the date and the time.     Usually they schedule the interview anywhere 30 to 45 days as far as I saw on this site. Most likely around 45 days.   You won't get any extension because of the letter! Most likely if you don't provide it at the interview they are going to issue an RFE and you have to send it in (which can delay everything a few weeks to months depending how busy they are)

    It should be on the approval letter above the name of the beneficiary. Starts with an A and then a bunch of numbers.

    Worst case just fill out his/her name and when was it approved and you should be good to go.

    As others said your ESTA is gone at the moment you overstayed. Based on your history you have more ties to the US  (husband and an American child) than to the UK and you also tried to adjust status while on ESTA which is not illegal, but in the eyes of the CO might be a huge red flag that you are not going to return. You can try the visitor visa (B) and see how it goes...

    Going to Canada or Mexico doesn't count anymore, she is not going to get a new I-94 that way.

    Hope u didnt pay $400-$500 for the EAD. If not sent with AOS or with an AOS receipt and category C9 by the time you receive it will be expired.

    Put her name on a name tag and stick it inside of the mailbox, right on the bottom where the door is. I assume the complex has those boxes where the mailman have a master key and can open the front panel of the boxes and puts the mail in that way.

    You don't have to. I assume she is a citizen by birth and is not doing ROC.

     

    As others said if there is no way around it you can take her with you but depending on your local office it might be a long wait to get to the interview, so that might not be the best experience for her.  I don't think USCIS won't allow you in with the baby. Or you can pay a baby sitter for a couple of hours.

    The idea is that we indeed got married in one week, but that is just because we decided to do so. You can do all the same things in one day in Portland.

     

    If you read my posts in the thread you will see that I'm explaining how to remove the delays and get all the same things done in one day, it's absolutely doable and does not require too much effort.

    I see. For us we needed to wait after we submitted the marridge license, they couldn't give copies and register at the same day.
