Sent off today for delivery on Friday; filing window opened on the 3rd.  Compared to the K-1 - where I was anxiously waiting for my husband (well, fiancé back then!) to arrive - I hardly put much time into this one!  Even if they send an RFE he'll still be here, which is all that matters to me 😁

Included all the usual stuff, plus we just bought a house so had a few nice documents to add.  Car titles, leases, insurance, bank statements, utilities, etc. etc...we all know the drill.  Hope to get the extension letter by April, ha.  Best of luck to us all.

Hello everyone and happy new year!

Packet sent today priority mail express via USPS! hopefully it should arrive tomorrow. Window opened on December 7 but I was busy with school and job applications and I didn't want to make mistakes like for my AOS! I read a while ago that the ROC applications were pretty backed up, hopefully I can get the NOA before my GC expires! Can the NOA be used as an extension and if so for how long?

    Thanks!

Hi all, I guess I will be Jan 2021. Our window opened up early Nov but with working from home during a pandemic with our 3 year old, it's been hectic. Sent off our docs with UPS Thursday but it won't arrive till Friday. My husband's green card expires 1/26. Should of done it sooner especially now that I see there are quite a few delays but hopeful all will go well. I won't be a nervous wreck as I was during the CR1 process because we are now together as a family but still hoping it won't be a long process.. Good luck to everyone

I do not remember exactly when they updated it, but it has been a little while.

I remember when USCIS just made the change, some people here on the forum asked what they should do after they had sent their applications to TX.

Today is one of the best days of my life!!
I have received an notification that USCIS has ordered a new card for me. Exactly 257 days since I filed for the removal of condition. I'm so happy and I feel like so much weight got lifted of my back. I would like to thank all of you with the information that I have read on Visa Journey that helped me prepare my paperwork for I-751 and people cases that I have read to avoid any unnecessary issues and RFE. I have never posted here but I read so many stories that help em with my application. Just BIG Thank You to all of you! I'll pray that you all get your cases resolved soon and that you will get the approval outcome.

Everyone is using terms like priority dates and visa bulletin, which while accurate, may be unfamiliar to @CSG046186 and may be going over their head. So maybe using simpler terms will help.

You seem to be familiar with AOS and know that it's a common way for immigrants already in the US (even on tourist visas) to get their green card. What you may be missing is that the category of eligible immigrants is limited. Most of the people you read about adjusting status are the spouses of US citizens, and as mentioned by others, someone like your son (21+) is not eligible for AOS. You are free to file all necessary forms, but the current wait time for your son's category is at least 6 years (11 years if from the Philippines, 23 years if from Mexico). He cannot spend this time in the US on a tourist visa, as his overstay will not be forgiven as it would be for a spouse.

JoJoJoJo reacted to classyam in My N-400 and I-751 combined interview experience
Today I had the interview at 26 Federal Plaza in NYC,  it's been really a long time coming because I filed I-751 in Dec. 2017.
Anyway,  the security at the main entrance was pretty strict with who gets to go in.   Getting through the metal detectors and then off to the 7th Floor,  it's probably the first time or last time anyone would ever see a waiting room this empty there. lol    There were probably only 5-6 people waiting by the time we got called in by our officer.
Officer was professional,  did a little chit chat.   Then she asked what documentations I brought.  So I handed her our tax returns, bank statements,  a variety of utility bills, lease renewal----all joint and about two years' worth,   life insurance.    Also showed her our original birth certificates and marriage certificate.  She also asked for some pictures.    She didn't ask a ton of marriage related questions,  was more interested in my immigration related history starting from the first day I arrived here.
Then she said she was done with my spouse,  walked him out.   Then came back to conduct the N-400,  questions were easy, she stopped, I believe, at the 6th one probably because I got them all correct.   Proceeded to ask me to read a sentence and write it down on an Ipad.
In the end, she handed me a piece of paper on which "A decision cannot be made yet about your application" is checked and said to wait a month for a decision in the mail.   Arghhh,  more waiting:-(
I don't know what I should expect from this point,  more RFE?  or some other hurdle?

Also, you may want to check Form 8621 https://www.irs.gov/forms-pubs/about-form-8621 and Form 3520 https://www.irs.gov/forms-pubs/about-form-3520

You may need to file 8621 for "Passive Foreign Investment Company or Qualified Electing Fund", which could include mutual funds or ETFs from foreign countries. Also, 3520 is for reporting foreign trusts, which probably include 401(k) type of trusts of foreign countries. It is required when a US person receives a gift of more than $100k in a year from foreign persons.
So it would be important to know what you as a couple have and then figure out what you need to file, because delinquent filings could result in large penalties.

A separate point: were you able to get the exact information about how much interest, dividend, capital gains, rental income, etc. she made from foreign countries? You needed to report them in your joint 1040 return, because US (and maybe your state) taxes worldwide income.
  21. Thanks
JoJoJoJo got a reaction from Wilson & Hannah in Filing taxes after OPT and during AOS
Hi, assuming your parents were non-resident aliens (foreign persons), and you were a resident alien (a US person) in 2019, and they sent you more than $100,000 in 2019, then you need to file 3520, which needs to be filed with the IRS in Utah by mail, separately from 1040.

    https://www.irs.gov/forms-pubs/about-form-3520

It should not be considered as income, and should not be reported on 1040.

USCIS should just extend the EAD until AOS is approved or declined. Having 1year validity is only waste of time and money and resources for the applicants and USCIS themselves.

From 0.87 cases per hour to 0.53 cases per hour is NOT an improvement. in 2014, USCIS could finish almost ONE case in ONE hour, now it roughly needs TWO hours to finish ONE case.
