    Also where would she place the new name? I assume just the regular name box? And her previous names will be her current maiden name?
     
    Would it matter if we've been married for more than 5 years now?

    Given it has taken over 5 years for USCIS to process N-600K, this is the 10 year old’s last chance.
     
    Why is it difficult for these 4 people to travel?

    Salaries might be just slightly lower, but Canada at least offers a stable stay and the person on h1b wouldn't have to worry if they have to pack up and leave immediately.

    With a valid, unexpired GC you will be v able to board your flight
     
     At POE , if /when challenged-  do not sign the I407 to relinquish your LPR status. 
     
    Tell CBP that you wish to appear before an immigration judge. They are the only ones who can terminate your status. 
     
    Don't forget to apply for a renewal of your GC as soon as you are eligible. 
     
    Immigration court will take years .. the outcome of your case is uncertain but you have time to get a competent lawyer,  build a life , pay taxes etc and hopefully  present a strong  case to retain your your  status

    Please read Mike E's advice carefully.  Filing for your oldest child this week might save you a lot of worries, and money.  You can file for the others in the near future, but do not dismiss the benefits of taking care of your oldest' petition asap.

    You must focus on filing I-130 / I-485 / I-693 / I-864W for the  16 year old now. Your husband and 13 year old are lower priority.
     
    If your 16 year old’s I-485 is approved after each reaches age 18, he will have to wait until at least age 23 to file N-400 to become a citizen.
     
    But if I-485 is approved before he reaches age 18, he will be a U.S. citizen. 
     
    1. How close is he to age 17?
     
    After you get I-130 and I-485 receipts, file his I-131 and I-765. You will want to also request an expedite for your 16 year old’s I-130 and I-485. 
     
    Next priority is to file I-130 / I-485 / I-693 / I-864W / I-131 / I-765 for your 13 year old. Expedite not needed yet, if ever.
     
    In their I-864W filings show evidence each child lives with you.
     
    After the kids are filed, you file for your husband.

    US visas are not given in the US.  R visas are not easy to obtain, as there is a significant history of fraud.
     
    You don't need to "invite" her to use her B visa.  Nor is there any type of sponsorship from you or any 'sponsoring organization.'
     
    She can visit the US, but she cannot adjust status while here.  Just do the right thing and petition her for a sibling visa, which is the only legal path she has.
     
    Also- is there a reason why you posted this in the Waiver/601 section?

    All you can do is try, my wife has done it. And we're the rare exception that she was approved on the first try, and she's lived in the US until about 4 years ago. We've traveled across the world extensively, and moved to other countries as well including countries within the EU. Just plan for a denial so that it's not a shock if they do.

    No Family Left, sincere sympathies.  Rely on friends and friendly acquaintances for support.  Don't go to CBP.  Leave the U.S., recover, and in a few years approach the consulate in Germany for a tourist visa.

    If the consulate accepts your DCF case, USCIS will not be involved....I honestly don't think the consulate will dig too deeply.  I would not be concerned.  Others might disagree.

    Unfortunately it's the only way to stay legally it seems. Obtaining the TPS status to stay legal and then leaving on a good note is light years better explaining for the B visa. I think the B visa will still be active since TPS isn't a "non-immigrant" status like F visas are.
