    Just wanna add:
A single girl probably in her twenties who’s working her ### off full day while studying part time during night planning to spend hard earned money in Disney!!! The CO wud’ve guessed it right away or way before that she is going to see her American bf. The explanation you are looking for rejection is “why would she return back to brazil?”

Regarding the financial loss you are talking about, their website specifically says not to buy or sell anything until you have visa in hand, so can’t blame them.

Uhm, If strangers from an online forum board can detect it within seconds. What do you think a highly trained US Foreign Services employee such as the Consular Officer, who is stationed in Brazil and seen hundreds of these applications every days and interviewed hundreds of people, not be able to detect that?

A young woman travels alone to the US to visit Disney ? Really?

How many young single people do you think go all the way to the US to visit Disneyland on their own? That was probably a red flag.

It literally took us seconds and a single post from you to figure out what is going on.  It wasn't hard at all for us to figure out.  The CO are better trained.

She doesn't need to say it.  While you think you are being creative, this trick is well known.  You aren't doing anything new that is going to allow her to visit the US.

If you want to see her, then you will need to go to her or meet her in another country.

I am going to assume  did not know but may have suspected, single young female going to the US, but anyway she obviously did not have enough to satisfy the requirements for a B.

Yup, apply for a tourist visa. Nothing is required from you for her to do so - she will get the visa or not based entirely on the merits of her case. Good luck.
She cannot provide care for you. She can visit you. Don't cross those lines.

My now wife and I went K-1 -> AOS -> ROC -> Citizenship without a lawyer. Unless you have red flags in your case a lawyer is not needed.

These sources are correct. It is just as your SS card says  “ valid for work only with DHS authorization”. K1 is Not authorization. EAD or a greencard is.

A K-1 holder is a 'legal alien allowed to work' for the SSA's purposes, because you are technically allowed to apply for employment authorization in the 90 days. However, since it actually takes longer than 90 days to process an employment authorization these days, in practice you can't work on the K-1.

You get a work authorization you can actually use in the adjustment of status process, when you can apply for employment authorization for free, and if you get your green card before EAD, that works too.

K1 visa holder cannot work unless they have an EAD in their hands and an SSN. Entering the US with a K1 grants you the ability to adjust status and file for an EAD after you marry. There is nothing I'm reading in the SSA documents actually that disprove this notion and the lawyer is misinterpreting the rules inappropriately. A person who entered on a K1 is allowed to obtain an SSN from the SSA that legally allows them to work, and that is why they are able to obtain an SSN. HOWEVER, they will not, nor will they ever be able to work with that SSN, UNLESS they file and obtain an EAD. The EAD is the authorization.

I would frankly, fire the lawyer. They can't even read documents properly.

My lawyer is quite competent. They got me this far. My question to them was if I could get my SSN.  As a result of this they discovered that K1 visa holders can work. However only for the 90 day duration.

We are applying for adjustment of status, work permit, travel permit and green card none the less.

No, you are NOT authorized to work. K-1 is not authorized to work without EAD. I don't care what the SSA is telling you because as I mentioned, the SSA does NOT have the authority to grant work authorization to aliens in the US. Only the DHS, which USCIS is part of, can do that. You cannot work until to have an EAD in hand is the right answer.

    Hi everyone.
What I am stating here is that technically the K1 visa entitles you to work according to both the SS website and USCIS. However you still have to apply to DHS to get them to issue you a card that states this fact. You don’t need them to approve it, the visa itself entitles you to work. Applying for the card only requests them to confirm this .  This process takes longer than the 90 days that the visa is valid for. So this is not really worth the time.

    Thanks for all your responses.

Sadly your lawyer isnt as competent as you think. Happens more often than not. Just search the site for horror stories.  Most people on here got this far and further without lawyers. Good luck!

I also question the Lawyer competency as this is pretty basic stuff, is this Lawyer an Immigration Lawyer?

SSN is not work authorisation, it is a Social Security Number, useful as effectively it is used as an identity card in the US. Even if it is not.

Used to be that you could get EAD associated with the K1 as a stamp on arrival or very soon after, could still be useful if you expedite, but might make more sense just to marry file to adjust and expedite EAD associated with that that asap.

Hire a more competent lawyer. The difference between getting married and going the CR-1 route instead of the K-1 is that the CR-1 provides an EAD (ready to work when he/she lands in the U.S.). Not so with the K-1.

The petition by your stepmother is worthless since you can not adjust status and you will have a 10 years ban if you leave the US.

You had a legal way through your stepmother to immigrate to the US and you blew it by jumping the queue by using your visitor visa to illegally immigrate to the US.  This is the unfortunate consequences of your choice.
