    K-3 visa could become relevant again now that all the other timelines are taking so long.  They essentially phased that visa out because it was no faster than the CR-1's.   It took us about 9 months for our CR-1 in 2016, and I thought that was long at the time.  I won't complain for sure now.

    I'm confused since your first post said: "Ideally I would want to come back to Canada" Wouldn't you also encounter the $2000 hotel in that situation?
    You cannot AOS from abroad. You could marry in the US (either with the K-1 or as a Canadian B-2 visitor), leave, and then start IR-1/CR-1 path.

    It has nothing to do with the approval of the petition.  Approved petitions have just been sitting at the NVC, since K-1 interviews are not happening for the most part.
     
    Like others have said, the visa is valid for six months after the medical.

    Thus, proving that a visa is not approved until after all administrative processing is completed after the interview.  Hopefully, your AP will be completed soon.

    Hi,
    I came to know from someone (with some immigration law background, but not in practice) THAT if someone owns a self employment business such an LLC with no or limited income but has all IRS fillings in good standing (i.e filing annual income tax and other Forms with zero income etc. ) can get an income qualification waiver from the USCIS?
    I'm skeptical because it makes no good sense of applying for financial supporting ANYONE without income? Doesn't filing for I-864 require someone to have a CURRENT income and proof such as pay-stubs?
    Perhaps a joint-sponsor could be the solution?

    I highly recommend you educate yourself prior to applying for this visa to make sure this is the correct path you want to take

    Oh dear. Yes the ESTA could have been extended for 30 days without much hassle under Covid, using “satisfactory departure” (I know you say no one told you but it was quite well publicized on the Uscis websites for anyone doing a search from what I recall), so there would have been a big difference between 10 days and 179 days. You will almost certainly need a B visa, you can try for another ESTA but I’d guess it’s an automatic denial. Even without an extension, if you had stayed for the exact time of the doctors letter and left immediately thereafter, you would have had  a reasonable case to make at the embassy when applying for your B visa. If you basically maxed out your overstay to the limit of where you knew you’d get a ban, which it sounds like you did, I suspect you will get a much less sympathetic hearing at the consulate. Not sure when you can find out, seems they are only doing emergency visa appointments for B visas in Switzerland at the moment.

    So he has multiple issues with entering illegally?
     
    That is going to big a big issue as the previous deportation (catch and release) is on record.
     
    Biden is NOT going to change the law of illegal crossings. Please do not even get your hopes up for that. Border security, including defining crossing the US border without proper authorization and inspection illegal, will always be a thing. 
     
    With that said, there is a path for him but is long, difficult, and expensive. And you will likely need a very good, experienced immigration lawyer. You will have to establish domicile in the US. Then apply for him for a spousal visa. But you will have to apply for a waiver since he likely has a lifetime ban for multiple illegal entries. This process is going to take years and cost thousands of dollars.
