    Thank you for your input. To answer your questions: yes she knows, both her parents are deceased. The country of her location is the Philippines. That culture seems to be rather accepting. She has two children 18 & 22 of whom I claim as my own (not on paper yet of course). I have been there to see her and her other family members and friends.

    Guys, we just received an email from NVC and they said they already sent our k1 application file to Guangzhou where I'm expecting a visa interview. I'm hoping to receive package 3 before we are flying to Bangkok on Sep 5th.

    I in no way feel "pissed off" or angry nor do I think we deserve an approval right now, ..but it is emotionally draining to be this close and not know whether an approval is coming or an RFE or nothing at all for another month!  So many things are up in the air.  My fiance has sold her salon in Thailand because that wasn't something that could wait until we find out concrete dates ..there are just some things that HAVE to be done in preparation.  Ok I'm going to take a deep breath now and continue waiting! LOL

    Not everyone that uses VJ and its timeline tools posts in the forums. I chuckle a little bit when I see the "omg no approvals today!" post in the morning, yet Igor's list has a handful. They probably don't want to check the forums every day and see stuff like that. 😉

    Pretty packages that go to USCIS get thrown into the garbage and slow the process. USCIS gives instructions what they prefer. https://www.uscis.gov/forms-filing-tips

    I think the only issue is a previous named used.  Just like anyone who has changed either their first or last name legally, under any circumstances.  Your gender is a legally recognized status, as evidenced by your updated BC, etc.
     
    The only other roadblock I can see (and this is for later on in your immigration journey) is depending on the political culture of your fiancee's country, she may be subject to aggressive questioning in the embassy interview.  This is just a generalization of course, but.....I could see this being different in the UK vs. a MENA country, for example.  
     
    As long as she is prepared for potentially invasive personal questions, she should be fine.  Oh, and for some consulates, it counts big time if you are able and allowed to accompany her to the interview.

    I'm shaking! We were approved! I received an email this morning saying they have taken action on our case - approved!!! My fiancé (US petitioner) has not received any texts or anything. I am the beneficiary who signed up for an account on the new site.
     
    NOA1: Feb 15 (old site), Feb 19 (new site)
    NOA2: August 21
     
    Wow! I am beyond thrilled. Just so everyone knows, my fiancé has a very common last name, we didn't send passport stamps in our petition (I did send lots of boarding passes, itineraries, hotel receipts, 6-10 photos printed on regular printer paper), we met online and I didn't include the DOS or terms (but I did mention the website name and that it was a blogging website).

    NOA2 - 21th August
     
    So we were actually approved yesterday I just limit myself to checking once a day to prevent torturing myself with the dreaded “we’ve received your case” 😂
     
    We checked just after 4:30am (in Texas) this morning and saw our new approval message.
    About an hour later my fiancé received a text message from USCIS saying there was an update 🙌🏼 (Don’t worry USCIS we know we are addicted to refreshing your site) 😂
     
    BRING ON THE REST OF THE FEB APPROVALS AND ALL THE JANS AND 2017 CASES STILL HANGING IN THERE!!

    The problem is you don’t seem to understand what’s important.
     
    did you read the link to another thread someone posted? The denial letter they got from USCIS seems extremely important to your case.
     
    particulalry in your case I would think the following is important - note the first point.
     
    “The approval of any petition is automatically terminated when the petitioner dies or files a written withdrawal of the petition before the beneficiary arrives in the United States".
    "Because the withdrawal predated the approval of your I-129F petition you are subject to the withdrawal regulation 8 CFR 103.2(b)(6)."
    "Withdrawal may not be retracted."
    "Because a withdrawal may not be retracted and may not be refused, USCIS cannot adjudicate a petition that has been withdrawn".
     
    Good luck with your case, when this thread gets closed I hope the mod doesn’t put in a “not to be referred to” so that you can come and update us in due course.

    “Up against”? It’s not a battle with people out to get you, it’s understanding the process, which in your case means refiling. 
     
    Also, you have been asked to read TOS before I believe.

    By sending the letter, you have withdrawn it.
    Even if it does get approved later on, the letter you wrote is on record.  
    There have been cases reported here on VJ where an application/petition was approved and then the withdrawal letter later discovered at a later stage in that person's immigration journey, which resulted in the initial approval reversed.
     
    So just be aware of that, too.

    Just because you are hearing something other than what you want to hear doesnt mean people don't support you or want to help. 
     
    You withdrew your initial support of the I-129F.  You can't cancel that withdrawal of support. It really is in your relationship, self, and fiance's best interest to make sure the current I-129F is fully cancelled and to start over.   While this isn't what you want to do, it will save any heartache later and ensure a smoother process overall.  You can obviously continue on your current course if you choose.  If so I suggest asking a mod to close this thread so that do not continue to get advice you don't want to hear. 
     
    I suggest rereading the TOS again as well.

    Still too early to call. It takes about 2 weeks before NVC receives your file and then another week to receive and create the case number. So a little more patience.
     
    Checking on your embassy case number from NVC:
    It will take 7 - 10 business days for NVC to receive your file from USCIS after you receive the NOA2, then another 2 - 5 business days for NVC to get your file in there system and produce your case number.  Call 7:00 am eastern time for shorter wait times.
     
    1-603-334-0700 or 603-334-0888. Operator assistance is available Monday through Friday from 7:00 AM to 12:00 AM (Eastern Time)
     
    1 for English, then 7 (or 5, but I would go 7 as they would tell you if you should call 5 instead after they receive your case.)
     
    Best time to call:
    Right after they open which is around 7:00pm Philippine time/ 7:00am US Eastern Time, Mon-Fri. I was always able to have the phone answered after the first ring if I called right at 7am.

    Just received my RFE. It is a statement of Intent to marry from my fiancee within 90 days admission in the US. Easy fix. I am relief it was not something difficult.😊

    Public service announcement:
     
    My NOA1 was February 6. I got very dismayed as a saw a flurry of approvals for people with that date and after that date come in last week. I got even more depressed as our VJ timeline date came and went. 
     
    This morning, I received an envelope from DHS and opened it to find my NOA2 dated to August 16. I was shocked!!! I had signed up for email and text alerts and had been religiously checking the new and old UCICS websites--none of them ever said that our case had been approved. Even now, the only notification is via snail mail. Not really sure why I was not informed digitally as requested, but maybe other people out there have NOA2s in the mail and don't even know it yet.

    It is not legal to use a tourist visa to enter the US to marry.  It is fraudulent.  Believe me, we would ALL be doing that if we could!  We all want to be with our SOs ASAP.  But you have to jump through the hoops and do things legally and queue up with the rest of us...
     
    Not knowing your details, it is hard to tell you which visa (K-1 vs CR-1) would make the most sense.  CR-1 (spousal) takes longer at this point, but the alien spouse enters the US with a two year conditional green card, and can work.  It is also cheaper.
     
    K-1 is faster, but when the fiancee arrives, she must wait a period of time for both a work permit and parole to exit and come back.  And, there is the AOS, which is spendy ($1225ish).   So, as you can see, there are pros and cons to each option.  You must weigh them for your particular situation.  
     
    The one UNIVERSAL thing about bringing your sweetie over is that there is no way around WAITING.   Best of luck!  There are many resources and wise folks here at VJ.  I recommend reading like a fiend.
