I would expect he would have to enter the visitor lines since he is not an LPR until he is processed.  That being said, advise him to ask, there is usually someone directing folks to the proper lines when a flight arrives.

    Good Luck!

So, he entered the US under an improper visa category?  That could be seen as misrepresentation or fraud.

This is general advice that applies to you and to everyone dealing with USCIS, either by yourself or by an attorney: always, always keep a copy of everything you submit to them, and the notices they sent you.
I still think that the denial did not come because of a mix up of addresses. There has to be something else. Maybe your ex sent them a letter stating you married to get an immigration benefit.
If I were you, I would retain a top notch attorney and ask them to file a FOIA  (Freedom Of Information Act) for you. That way, you can see what is on your file and see if it is something you can overcome. It's certainly not a DIY anymore.

    NO.

Your wife did NOT become a permanent resident UNTIL SHE ENTERED THE US. Which is 2 weeks ago. So your wife was not a LPR in 2019. So she does not qualify for a stimulus check.

I agree with @geowrian, and the only thing I would add is don’t submit your application on the first day your filing window opens up.  Some folks have been caught with computer date stamping issues.  Wait a day or two to file.

    Good Luck!

You can apply fine. They will still send receipt notices. There may be some delays but they are processing.
They will not be able to perrform the interview until their local field offices resume interviews.

I am not aware of needing to provide a valid reason.  Here is some information that may be helpful.

The vast, vast majority of B2 visas are denied due to insufficient ties to the home country.  Having a relationship to someone in the US is a very strong tie to the US.......I suggest, he make arrangement to visit you outside the US.

My 17 year-old brother just got approved for his visit visa B2 (6-month visa) and he's coming to the U.S on May 24th. So my question is:

Can he come here by himself since he's under 18?

My wife is a U.S citizen. We had no problems or criminal records. We had no red flags. She applied I-130 for me in June, 2015 and got approved in April, 2017.
a year and 10 months. Almost 2 years.
Guess what? the NVC stage was so smooth, and the embassy stage was so easy and smooth as well. and I received my visa the next business day. and at the POE was so easy and it took me to finish the whole process 15 minutes.
but at the USCIS stage we had to go through long security checks. the uscis said FBI checks. I'm currently in the U.S and till now we have no idea what that was. we waited so long but it worth it to wait. because now we're together.
My point is immigration process is not easy at all and not short. expect always to wait so long.
I wish you the best of luck.

__immigrant__ got a reaction from silviafini in K1 visa NOA2 long wait
We've been through this security checks thing. it took us a year and 10 months to get our NOA2. there are steps we did that made the USCIS approve us.
We contacted our congressman. We set an infopass and asked why our case was delayed for so long we were told because of the security checks. We hired a lawyer and he told us to gather more evidence. We weren't convinced of what the lawyer or the congressman told us BUT when we did all of this we got our NOA2 right away.

    Good Luck.

__immigrant__ reacted to yuna628 in The USA should be the land of freedom but...
OP: Until you discuss your feelings with your fiancé, I don't think you should honestly proceed. If YOU are not ready to leave your country behind, and he is unwilling to learn or make certain sacrifices for you, then this will only be miserable for you. When it comes to immigration your entire lives are laid bare for the government to see, and we've all had to make sacrifices to make our lives together. If you find yourself contemplating that you will be filled with regret.. think about how the future will be more, and if you're really ready for it.

America is a land of freedom, in that we have many personal freedoms and liberties that other countries do not. We also have many opportunities for those that are willing. But that does not mean everything is free, nor should anyone expect that. We are a country, unique as any other. How do you expect that a person feels American? Ask yourself what does it mean to feel American? America is filled with people... people that are immigrants, a melting pot of children and grandchildren and great grand children of immigrants. We each have our own cultures and differences, and not necessarily united under a notion of a specific identity. You should not expect to set foot here and suddenly 'feel American'... because there is really no such thing as that. You may likely experience culture shock for a very long time, you may adjust or never adjust. You may feel floundering for a while, and then slowly normalize. America will never be exactly like your home. Your home will always be your home and special to you.

__immigrant__ got a reaction from Sunnyland in So my lawyer used an old I129f form...
Usually it takes a few weeks to be rejected and returned. my thoughts to you is as I've seen and heard immigration lawyers mess things up most of the time. Save yourself time and money and do it yourself since it's a basic form that doesn't need a lawyer to fill.

__immigrant__ reacted to geowrian in So my lawyer used an old I129f form...
Usually they return an improperly filed packet within a few weeks of actually receiving it. Sometimes longer, sometimes sooner. This week is possible, but slightly on the early side of things IMO. Next week seems a little more likely.

But yeah...that's a pretty major mistake. is there a particular reason you are using a lawyer at this stage? The I-129F is a fairly basic form...in many cases, you're more likely to have something getting mistaken during relaying it to a 3rd party than just filling out the form yourself.

    MY INTERVIEW APRIL 16 EXPERIENCE

Hi guys! I just want to share my interview experience yesterday and hopefully it helps in you preparation in your upcoming interview! Good luck!

My interview was scheduled at 8:00am, I arrived 25 mins early. I was checked in and called by the officer around 7:50am.
    Documents I brought with me
    - Interview Letter
    - Green Card/ Driver's License
    - Passport (expired and renewed)
    - Husband's birth cert & passport
    - Updated form of recent travels
    - Marriage certificate
    - IRS we filled joint
I  brought the original &photocopied them as well

    Documents that the officer asked
    - Interview Letter
    - Green Card/ Driver's License
    - IRS tax that we filled joint

I started with the English test and just have to read 1 sentence and then write the sentence he asked me to write. That was it! I then proceed to the CIVIC questions. They gave me this red booklet about the 100 questions to study for Naturalization when I did my biometrics. Everything is on the booklet.  The officer probably asked me 10 questions total. Like how many supreme court justice? What does declaration of the independence entails? Give me one branch of the government? etc. I got them all right. Then we proceed to the next part of the interview...

So, Its kinda like adjustment of status interview but w/o my husband. lol. I was asked about our relationship. Me and my husband are together for 4 years and no kids yet. He asked me like maybe 5 times if I have kids. I said "we don't have kids" and I" don't have kids". So he asked for more evidence. Health insurance, bank accounts, life insurance etc. But I didn't bring any with me. Luckily I brought the IRS tax we filled joint 2014-2016  with me so I gave it to him. So that kinda stopped him and then he write notes in his computer. I was then asked about the yes or no questions in the N-400 form that we filled up and questions about pledging loyalty to the United States. I also wanted to point out that the officer also asked me if I have arrested or had any traffic violations. So I kinda paused because I just had a recent one, its obstruction of control/vision. From holding my phone! lol. Anyway I told him that I went to court and pay the fees so I wont get the points. Its my 1st ever ticket. So he put that in his computer again. Kinda freak me out because I thought its gonna be the only reason that I wont be approved. The officer is nice and professional. After that, I was asked to review infos he typed in his computer in this IPAD and signed couple pages. And then he told me Congratulations! I will send recommendation in your case for approval ! He congratulate me 3 times. Yeyyy!!

I just checked my status online when I woke up today and it says

    We approved your application
Your final step to becoming a citizen is to attend your naturalization ceremony
We will mail you a letter when we schedule your naturalization ceremony.

I'm over the moon. I'm gonna kissed the USCIS good bye soon. Over all it was a smooth process. Our field office here is very organize and not so busy. I wont be able to complete this journey w/o my VisaJourney family my no.1 source of information  .
Let me know guys if you have more questions. Good luck to everyone!!!

Why does it matter though? You have the same chance you will divorce your foreign spouse just like it would be your US spouse.

People visit the US all the time during K-1 or CR/IR-1 visa processes.

Obviously they are subject to admittance only by immigration and can be turned away yes, but it isn't because of the visa process you're going through.

File AOS immediately and you won't have anything to worry about.

There is a chance ICE will somehow react if they will be notified about illegal foreigner (who also apparently works illegally.. sorry but that's a huge mistake) and then your wife will get deported. They might also not bother but better to be safe than sorry.

Again Immigration is NOT a right. It's a privilege. People don't have the right to immigrate to America just because their relative lives there so it's their right.
