    Wonderful. What state are you licensed in? Are you a member of AILA? Or are you a family law attorney?
    I've posted numerous times that he should speak with a family law attorney licensed in his state about divorce. Annulment v. divorce and service is all state dependent.
    If he is super concerned about getting remarried and bringing over another immigrant spouse who speaks "bad English" (but they communicate through Viper!)...buyer beware.

    Absolutely! OP, you both agreed she should leave and end the relationship. Not only that, you had your mom go all the way to the gate to make sure she got on a plane. Then, you tracked her luggage and went back to the airport to see if she really got on a plane.
    When you mutually agreed to end the relationship, that means she can go do whatever she wants. Its her decision to get on a plane, or not, or talk to her family friends, or not. You can't control what she does, where she goes, who she is with. You and your family following this woman around could absolutely be seen as controlling behavior. That's why the police told you to stay away from her. Divorce. Move on. Its not your concern what she does or doesn't do. Its not your concern if she tricked you, or how or if she will ROC, its over.
    Was it fraud or not should be the last of your concerns. You wanted her gone, and she is gone. It sounds like the ideal outcome, the outcome you wanted so badly you had your mom make sure she left.

    What would you do in this situation if your wife were American, say from another state? You'd get divorced, right? That's the solution. Get divorced and move on. Don't go tracking her luggage and going after her in airports and getting your mom involved and getting yourself into trouble.
    In any marriage, there's always 2 options. Stay married or divorce. I don't see how your marriage can recover. So option 2 it is.
    She doesn't need to claim abuse to stay. She has her green card, even if it hasn't arrived. When she entered the US, she got a stamp and that serves as a green card. She can divorce you tomorrow and still remove conditions on her own. You should be happy to get divorced, sever ties, and move on from a clearly bad situation.

    The sponsorship isn't what you are making it out to be. You can't hurt their finances. If you applied for and received means-tested benefits like food stamps, the government could, if it wanted, sue them to get the benefit back. The possibility of that happening is so slight.
    You as an employed adult have nothing to worry about.
    What they are doing is WRONG. So her family is concerned and doesn't want to be on the hook. The answer isn't deporting you. They can't return you to sender because the relationship didn't work out. You made a life here, now make it without her and her family. They have nothing over you. They can't call immigration and revoke a contract they signed and deport you. You have a 10 year green card. Your residency is permanent, it doesn't expire. Your card expires every 10 years, but your right to live here is unconditional and never expires. Its not dependent on sponsorship or anyone. Its like if you have a passport and it expires. You don't lose your citizenship.

    Capital One has two levels of authorized users.  For "Account Managers" with online access they require a Social Security number or ITIN.  For "Authorized Users" (without online access)  The SS# is optional.  Either type of authorized user will be listed on the statement.
     
    That is specific to Capital One. "Most" other banks allow you to skip the SS number for authorized users.  Generally all they need is a name and birth date.

    Your second option is a personal opinion, and a bad one. There's no obligation to return home to restart his life if his marriage failed. He already restarted his life once coming to the US.
    It amazes me that people want to ship their exes back, or recommend someone else leave voluntarily, when their (then) love of their life already made a huge sacrifice to leave their home, family, career, everything they know to move to the US, a place where they may not even speak the language. People can't be returned to sender. The OP has been in the US for what, 3 years? I assume he's established himself, and saying he should yet again "restart" his life is unfair and impractical. He may have no home to return to.

    You should look up and see N400 timelines for your office. It really varies. My office of Boston is slower than some others. There's no real way to compare N400 times nationwide.

    For the I-601A, you apply for the CR-1 (if married less than 2 years) or IR-1 (2+ years of marriage) starting with the I-130. That's approved, and then you do the waiver that only waives the 3/10 year bans for illegal presence. It could theoretically be approved and then the immigrant travels to the interview only to be denied due to another inadmissibility that wasn't caught.
     
    The posts about whether he filed taxes, how he was "approached at customs", etc are incorrect. USCIS doesn't arbitrarily apply bans based on whether they think you're a good person or some subjective values. They have to follow the statues. Bars aren't discretionary.
     
    The concern is he seems to have a 9C ban, which is a lifetime ban for which there's a waiver after 10 years out of the US.
     
    DO NOT have him leave the US to apply for anything until you have definite answers. I would post on immigrate2us.net and do consults with multiple attorneys who specialize in waivers. Not all immigration attorneys do this, which also may be a source of conflicting information.

    Thank you for your opinion.  While I disagree, I appreciate you taking the time to reply since it was important to you to share that.  I disagree that each day he remains he is making things worse; there is actually nothing that supports that statement, but everyone can have his opinion.  
     
    I came here to get advice from people who have more knowledge on this than I do, not to violate any rules or have anyone encourage us to do something illegal.  Rather we are trying to find out the best option for our family.  I'm not sure why one would be so hateful to someone trying to learn the best way and right way to handle a situation that directly impacts their family.

    No he is NOT using someone else's SSN to pay taxes. I'm not sure what the "pay taxes" is about, but he has always paid taxes.  Just because someone doesn't have a SSN, doesn't mean they don't or can't pay taxes.  This is inaccurate information that people who are not educated about this situation often believe.  The IRS issues undocumented people ITIN's just so they can file taxes.  Ironic, huh, they aren't allowed to be here and can't get benefits, but the government will be sure to take as much money as possible and doesn't make them leave?  No he isn't using fake ID's either.

    The person posting is a USC  asking what the possible immigration paths are for their spouse.  Nothing against the TOS for asking and advising on  how to get on the right path no matter how sideways they are at the moment.   Against the TOS would be advising places to cross the border or to tell them to lie or continue on the wrong path .   VJ regularly helps people that overstay visa or "happen" to get married on a visitors visa.  If you think a thread is against the TOS use the report button.

    He passed today! He had the first interview of the day. Unfortunately I couldn't go with him (to sit in the waiting room). I couldn't get off work. His interview was at 8:15, and it finished at 9. He had the SAME INTERVIEWER from the first time!!
     
    The interviewer asked him every single question from the N-400 paperwork, all 50-some questions. Luckily, we'd printed them out and went over them. There was one question that he didn't understand the interviewer's accent, but he recognized the question, so he said "Are you asking me if I'd blah blah" to confirm that was the question.
     
    As a previous poster said, he did not have to re-do the civics questions or read/write a sentence in English. 
     
    The interviewer told him, "oh you've worked hard on your English since the last time". Ummm...ok...whatever. The first interview was late Nov. Highly unlikely someone can master a new language in a couple months, but we'll take it!

    Hi All
     
    I am the same person who started this thread and wanted to update you all of the final outcome.
     
    - I was forced to leave the country and go back to India in Mar 2016
    - Spouse came to India, was physically and verbally abusive to me at my parents place in front of them
    - Police complaints were filed against him, I got detected with clinical depression 
    - Underwent treatment for 3 months and was decided to come back to USA and give a try to removal of conditions
    - June 2016 I was back in USA with just 2 bags of my luggage standing at the airport with nowhere to go
    - Found a job, accommodation and a lawyer to help me with i751
    - Gathered all documentation required for ROC with my lawyer's support and gods grace
    - Filed i751 in Aug 2016 under extreme cruelty
    - Stabilized emotionally and physically
    - i751 approved in Aug 2017 without any RFE / interview
     
    All I want to say is life is unplanned, but as human beings all we can do is try. God is great and will make ways for us but the first step needs to be taken by us.

    First I would like to say I am sorry this happened to you.  Just let it go.  It is not your job to get him deported.  You will only torment yourself.  Let him go.  Let it all go and move on with your own life.

    That maybe the rule but he cheated and that is a normal part albeit crummy part of marriage. The USCIS will not budge on this. Believe me. So they are going to deny ROC because some guy or girl cheats. That rule you mention is an add on rule/provision that is used when another scenario occurs and they want to add more fuel to the fire. Think about it, how many guys or girls, email or call the USCIS daily sayingj this exact thing, "Hey I met this guy and we got married, AOSd and then he got his 2 yr gc and cheated on me? This is an abomination and I want him/her denied ROC and they must go home" Believe me they get A TON! They will do nothing im sure!
     
    ALSO OP is from a no fault state so the part about the USCIS finding out about adultery is irrelevant. I can cheat on my wife or husband with 10 people and then we can claim irreconcilable differences.

    1) You don't need to do anything. He will file for Removal of Conditions with a divorce waiver indicating you're divorced.
    2) Why are affidavits saying you were once happily married not "actual" or "truthful"? Bonafide marriage doesn't mean happily ever after. Your marriage didn't become fraud when he cheated or when you decided to divorce instead of reconcile. 
    3) As others stated, divorce doesn't end the affidavit of support. But its good he's working. I wouldn't worry about this. 
     
    Move on with your life and find someone who doesn't cheat. Don't try to hurt him with immigration because that will just be sinking to his low level. You are no doubt a better person than that.

    1)  I'm surprised he agreed to sign that, at all, in the first place.
    2)  It's not a legally binding "contract" in any way, and would not hold up in court.
    3)  You know how easy it would be for him or a lawyer to say he signed it under duress, if it ever did become an issue?
     
    Frankly, it sounds like one of those "sign this or else you can't marry my daughter..."  kind of deal from your parents, and he probably signed it because he wasn't given much choice in the matter, since at the time he was inlove with you and wished to marry you.

    I love how people think getting a letter notarized makes it legal. All a notarization does is provide proof that "A" person signed said document. LOL

    No such contract would be enforceable. You can't legally enter into a contract like that...it would entirely defeat the purpose of the I-864. Not to mention that if he doesn't have the money in the first place and needs government assistance, then what can they sue him for? You can't squeeze blood from a stone. The contract wouldn't be worth the paper it's written on, sorry.
