The guidance is to use the visa for its dedicated purpose, that's why there are different visas. A plane ticket doesn't come with a guide note "not valid for bus/train/ferry". Same concept.

You are worrying for no reason. What if you were returning back today? GC approved, in production or in shipping? You cannot show GC even if approved for it. Or what if the GC gets delivered to your US address in Nov only? That's the reason AP is created and you have it with you. Enjoy the GC approval and enjoy the vacation.

OP is going for CR1/IR1. K3 is just to speed up the CR1/IR1 processing which has allegedly worked for some people.

There is no online filing for i129f. Read the instructions and provide evidences as required for the spouse as K3. Evidences you submitted for i130 won't be linked to i129f. It will need its own evidences including i130 receipt notice. The instruction clearly says filing fee is not required for K3 petition.

Which brings up an interesting scenario for the OP. They thought they were doing good to add the beneficiary's income even though the petitioner met the requirements, and it caused an issue with a less than knowledgeable CO rejected it. It might be a better idea for the OP to simply do a new I864 with just the wife's income.

Even if the petitioner becomes a USC after the i130 is approved, the category is switched to F1 during NVC phase or even during the visa interview. However one can request NVC to retain the F2B category if the wait time is shorter.

OP may be asked about the marriage based on which the GC was obtained. However there is no way an IO would ask for the original Birth Certificate of the USC spouse who is no longer in OP's life. Handy to bring copies of such though that too only if available.

Read the IF condition first. You are not applying for naturalization as the spouse of a USC.

First make sure the i864 is filled out correctly that you aren't listed as sponsor anywhere in the form other than just providing your name and income info on Part 6 Item 8-10 and 22 and that you didn't sign the form. Then include the portions of the instruction you quoted in your response.

While he may be able to enter US using the AP after you give it to him, it's best to file for new i485 since the current i485 is now considered abandoned.

The CO will either ask in local language or have a translator so don't worry about them not speaking english. Questions like what's your son doing there? How did he get the GC/citizenship? are normal.
