    A lawyer can't stop issues. Lawyers are only needed for legal matters. Sorry you are going through this but this happens alot trust me. And sorry you wasted money on a ticket. never ever buy a ticket until Visa in hand.  CO's change minds, Visa machines break, our systems get hacked and delays can be for weeks and months. Lessons learned o.

    The process is like this a CO interviews the beneficiary. They may say approved or other things but it's the Supervisor over all the CO's that has final approval authority. So something the Supervisor saw that they needed to look into or more investigative information came in.
     
    let me ask does your husband have children? You said he was never married but does he have children?
     
    Have you and your husband gone over all the questions that were asked? Was there a particular focus on a subject matter?
     
    Do you have red flags in your relationship? Other filings (you or him)?
     
    Big age gap?
     
    Short period of knowing each other?
     
    only one visit and you got married haven't returned and visit was short?
     
    Your next move call your Senator get them involved and tell them you were told nothing and you would like to know. See a lawyer will not look deeper, will not email, call or contact any representative to look into your case. They will shrug their shoulders and say "I don't know" as they collect your money.

    Thanks for all the well-wishers, once more.
     
    I had my oath earlier today (well, yesterday now) in Dallas. There were 110 people being naturalised from 35 different countries, with the most being 23 from India and 24 from Mexico.
     
    There was a minor issue where I had to scribble out the name of my home town on the "Signed at" location on the N-445 questionnaire, since I had already filled that in before arriving. The MC announced that only Dallas or Irving was acceptable there, but it was a quick fix.
     
    Other than that it was a nice event, with a lot of people there, and friends and family. One of the cops I know from the PD showed up, which was a really nice touch and meant a lot.
     
    So, this chapter of my life is now over. Onto the next...

    I didn't get the chance to put in my congrats - but this is really good news that Hypnos won.  Justification and correct ending.  Almost done with the most frustrating US Federal Agency ever!

    So today I get to give the update I have been hoping to give since all of this nonsense began.
     
    I received a flurry of text messages from USCIS this afternoon indicating that my case was updated. Puzzled but hopeful, I began to login to my online account, but before I could do so received a call from a Dallas number. They identified themselves as Officer SomebodyOrOther (I forget the name; I recall it wasn't the person who interviewed me) calling from the Dallas field office. They said they had received my case today, and had seen there was an issue. That she had gone ahead and reversed the denial and approved it, and could schedule me for an oath ceremony next Thursday afternoon, on Valentine's Day, if that would be ok. I said that would absolutely, completely, and totally be fine with me. She said she would mail out a copy of the letter today, and that I should receive it soon. I thanked her, and then called the congressional liaison working my case to let her know what had happened.
     
    So... there we are. It's been a rough couple of weeks. I lost about 5 lbs the first week, which I can't say I'm unhappy about since I wanted to lose 10-15 lbs before the police academy begins later this year that I will hopefully (now) be attending, but this wasn't how I had planned on doing it.
     
    I just want to say that the system works. And by the system I do not mean USCIS. Everyone who has read VJ for more than 5 minutes knows that USCIS is an inefficient and poorly run federal agency in drastic need of an overhaul. No, by system I mean the checks and balances of oversight of them. I'm not sure whether it was my congressman's office or the CIS Ombudsman that got this reversed. I'm choosing to believe a little of both. But to anyone whose naturalisation eligibility date is approaching, I would strongly urge you to wait just a day or two to head this issue off, unless you enjoy uncertainty and stupidity, in which case have at it.
     
    My online USCIS account is currently showing no changes. It still indicates that my application is denied, and there's no oath letter there yet. Perhaps it will change, perhaps it won't. But the older case status site is showing my oath letter was mailed.
     
    I'm glad to finally be able to put this behind me. Thanks to all the well-wishers here on VJ who have given public and private messages of support. It has been very much appreciated during what has not been a stellar couple of weeks up to now.

    Hindsight is certainly 20/20 isn't it.
     
    It's important to remember that this is USCIS' error, not mine. Now, if I knew back then what I know now would I do anything differently? Certainly, I would wait a couple of days, and would urge anyone in a similar situation to do exactly that (that is why I made this post, as a cautionary tale to others). But at the end of the day, this is on USCIS, not me.

    And to re-iterate: I have now found five people who filed under these circumstances. Three have been approved, I was denied, and the fifth has their interview later this month.
     
    At this point I no longer think it's a question of if my denial will be overturned, but when.

    I received notification today from the CIS Ombudsman that they had accepted my request for expedited review of my case and had contacted USCIS on my behalf to seek a resolution.

    I really hope for @Hypnos sake that this thread doesn't get end up getting locked...I think many of us here would want to know the outcome of what happens instead of a "this thread is to be locked and not referred to elsewhere"...also a good learning point for others who later on may be in his same situation.

    I feel you will get this resolved soon! The day you become eligible is the DAY YOU BECOME ELIGIBLE! No further questions should be asked. And thank you for writing this and letting us know that it is good to take a deep breath first before we jump. In the end, you are not obligated to write and share your story, yet you did so that others can learn from your experience. I wish you all the best and let us know how it goes! Adding my good luck!!!

    I just got back from a productive meeting at Congressman Mike Conaway's office and spoke to his very nice staff member. 
     
    Not going to use the word optimistic, but I feel better now than I did 24h ago.

    If you do refile I think a good rule of thumb is to leave no box empty anywhere on the form. I wish you the very best of luck and I'm sorry this happened!

    Very good point.   I-130 instructions say to write n/a if something does not apply. 
     
     
    On the top of page 4 of the form instructions:
     
    3. Answer all questions fully and accurately. If a question does not apply to you (for example, if you have never been 
    married and the question asks, “Provide the name of your current spouse”), type or print “N/A,” unless otherwise 
    directed. If your answer to a question which requires a numeric response is zero or none (for example, “How many 
    children do you have” or “How many times have you departed the United States”), type or print “None,” unless

    Thanks I'm positive, and I believe in karma and I was fortunate that I caught this issue before my ex was granted a green card. This was bad enough, 
    and its getting better each day. I  just can't wait for the judge to grant my annulment so that I can finally be free of all of this. All of the support is amazing,
    and it's sad for me to be judged in this situation when all I did was open my heart to someone who I thought loved me. If he loved men he should have been 
    honest and pursued a relationship with men. I was deceived on many levels, not just about his sexuality but religious beliefs, and everything he portrayed about his life and family as well. It's all sad, but these moments shouldn't define our lives. I'm happy that I have a good life and support of my family and friends. I'm slowly but surely repairing those connections that I lost because of this situation.

    OP, from time to time we get people on VJ who are good souls hurt by bad decisions.  It's hard to see.
     
    But when you see those good souls get through the bad times, come out the other end and start on a path that will get them the happiness they deserve, it makes me smile.

    They're very possible- 
     
    #2- Waivers are only approved for the inadmissibilities listed in the waiver paperwork.  It clearly states this on the USCIS website and the I-601 waiver instructions.  If the inadmissibility is not listed, it is not covered by the waiver, so he would still be inadmissible- and misrep can only be waived through the I-601- which would constitute refiling.  The only "if" to this scenario is that USCIS has stated that if they can determine that there may be another inadmissibility that you could incur at the interview, your waiver will not be approved.  But we all know that things are up in the air with USCIS at times depending on who adjudicates the case.
     
    #3- The discussion between misrepresentation falls in between misrepresentation and "material misrepresentation".  Misrepresentation in itself would not make someone inadmissible, but material misrepresentation would (which requires a waiver).  There is a possibility that they can know that someone misrepresented themselves but it not be material to the case, in which they would not be inadmissible.  "Material" is defined in two ways- 1) If the truth would deem them inadmissible, 2) the misrepresentation would cut off a line of questioning.
     
    In this case, his misrepresentation would be material because had he have told the truth he would have been inadmissible and also because it cut off a line of questioning by them not having the knowledge of inquiring if there was an overstay or an illegal entry.
     
    I was referring to if (for some reason) it was overlooked and they initially approve the visa.
     
    Both scenarios are completely possible- do you have anything to the contrary?  I'd love to be informed if you do!

    My fiance walked in and got it the same day.
    The beneficiary will always need a police report.  I'm not sure why that link doesn't request it but the link that's on the Nigerian US Embassy website does. 
     
    You also need to take note that the page you linked is for immigrant visas. If you look in the instructions it says "After NVC schedules your visa interview..."
    Those are instructions for an immigrant Visa.  A K1 is considered a non-immigrant Visa with immigrant intent, that's why I K1's schedule their own interview and spousal's are scheduled for them.

    There's no packet 4 for K1's in Nigeria.  Packet 3 is just the forms needed and directions for the medical and police report.

    Click that link, go to the second question and download the K1 packet.   That's what they send you in the email,  "packet 3".
     
    If it says "ready for interview", go ahead and complete the DS-160, pay the visa fee, and schedule your interview.  Complete your medical and get your police report as soon as you can.

    From reading from the beginning of this thread, up until now, it comes across that you have a very good head on your shoulders and can be rational when it comes to taking care of business, particularly daunting business such as this. My heart goes out to you for having to experience it at all. A former best friend of mine, while not in an international marriage, found out after 5 years of marriage and a 4 year old son later that her husband was having gay sexual relationships during their marriage. I can't even imagine discovering something like that about your partner. As others have already said - it isn't about the sexual orientation, it's about the deception. Process and grunt work aside, it's a long emotional road ahead, I'm sure. But it seems you have taken some awesome strides at working towards a resolution to this, which is a very good thing.
     
    I think I saw you mention having lost some friends along the way before now. I encourage you to reach out to those people now. I was in a mentally abusive relationship several years ago and lost every one of my friends because of him. When I finally left him, it was a very lonely feeling. You feel like you have no one to turn to. I wound up crossing paths with and reconnecting with some of those friends shortly after, and it was the best decision I could've ever made at that time. Most people who genuinely love and care about you will move past those sort of things and be there for you again, if you allow them to be.

    They do nothing.  They can take some temporary classes or volunteer but they cannot work, including online.  The CR1 has a clear advantage here. 
     
    As for your original question, it would be best if he left after his brother's wedding.  The k1 visa should be valid 6 months from medical date.

    They say this because they just throw away any notebook provided and if things are (for example: in sheet protectors), it is very time consuming for them to disassemble your package to place it in their required folder. 
     
    OP- use what you have but maybe use a binder clip to hold it together.  I used tab dividers to divide the sections, then you can bind them with the clip.

    Im sorry your relationship did not work out. Also I really hate when people post things as "fact" when its simply their (mis)understanding of the process and its rules.
     
    While someone can be asked at POE if they intend to be married- its not a mandatory question they are asked. Many people simply show their documents, exchange pleasantries and go on their way. The 134 is considered 'non-binding' because it is only valid for 90 days (same as the K). 
     
    The K visa can be canceled up until the point it is stamped 'used' at POE. You would contact the Embassy and ask to cancel your 129f/134/visa that was issued. Explain the relationship ended and the visa has not been used yet and you want to withdraw your 129f and have the visa canceled. Embassy should have an email you can find online. You can also send a letter to USCIS but that will take forever to make its way through the system and the visa may be used before your letter is even acknowledged. Contact the Embassy- not USCIS or NVC.
