Someone correct me if I'm wrong, but I think the passport photos need to be less than 6 months old....??

It means you used an old I-485 form. Get the latest from USCIS and send again: https://www.uscis.gov/i-485
The I-131 and I-765 were rejected because they are dependent on the I-485. Send them again with the updated I-485.
Edit: And be sure they are the latest forms from USCIS as well!

I don't think you need to consult a lawyer. Go ahead with your plans, just don't get legally married. I don't think that's too difficult to do here in the States. It shouldn't be an issue, as you say. Just don't bring pictures of the ceremony or mention it in your K-1 interview.

A lot of VJ posters are very cautious about this process. Some of us less so.

First rule of K1 Visa is do not make wedding plans. It’s taking longer and longer every day now. I don’t think you’re gonna be done by April.

    Rule is
do not make any plans,  wedding or airline reserations or quit your job or sell property until you have the visa in hand
you are looking to loose money if you make plans ahead of immigration process
    quit stressing and cancel now
be patient and just get ready for the interview

I strongly suggest you postpone the wedfing. There may of course be fees involved. April is *possible* as end of June's are getting NOA2 now but it takes another month to get to your country then scheduling interview.  It would be close.

If it were me I'd postpone now while there's still time. Don't give them a new date unless it's maybe December. You could just do a court wedding when you get here and do your big ceremony later

Why do you think you need a lawyer?

An I-751 with a waiver is the same as an I-751 filed jointly, apart from the obvious exception of it being just you instead of both of you involved.
They are both adjudicated on the evidence of bona-fide-ness provided and a lawyer won't change that.

$3500 is a hefty fee for doing not a lot.

You would need to have some sort of resolution of the K1 which could take a long time - your fiance could get put on AP - why bother with the religious ceremony in August? Why not just wait?

Sure you could go to Canada and do CR1 - it's more fees and takes another 12-14+ months for approval. Would you really want to wait another year to be together instead of just postponing the ceremony?

It's definitely not a grey area, and your husband is out of status until his I-485 is accepted by USCIS.

Travelling outside of a life-and-death situation isn't something I would do. And I didn't do, since I was out of status for some time.

Your mother will not be denied entry based on her disability. However, she will still be required to answer a border officer's questions at port of entry. The port of entry is required to make reasonable accommodations for disabilities.

My first piece of advice is that your mother should carry an official doctor's note/certificate, in English, stating that she is unable to verbally communicate.

If your mother will be traveling and crossing port of entry with another family member, they may be able to speak on your mother's behalf. However, there will always be a chance that your mother will be brought in to secondary for further screening. This is a possibility for anyone entering the U.S., and I would not think your mother would be at an increased risk of this.

I would recommend calling U.S. Customs & Border Protection prior to your mother's trip, particularly if she will be traveling alone. Inform them of your mother's condition and ask what arrangements should be made prior to arriving at her port of entry.

Remember to also inform your mother's airline of her requirements.

I’m not sure how far away your mom lives, but from a practical perspective it surely may be better to visit her rather than have her visit you give her current physical condition? Or do you have a family member traveling with her who is able to take care of her on the flight, through customs, etc?

Sounds like she's giving you all the signs that she's just not that into you.

On an aside, if you have mentioned to her in the past over this relationship, something along the lines of "It's been X amount of minutes/hours since I sent you this message and you haven't responded yet!" as you keep mentioning it in this thread, perhaps over time it began to tick her off...

Just because she is not texting you 45 times a day to charm the pants off of you does not mean she is not scamming you. She has strung you along this long and look how hard it is for you to break it off. Not loving you the way you deserve to get to the US is scamming you.

You don't need to be a horrible person. Just tell her that you two are not compatible and you are parting ways. Wish her the best and be done.
This is the part where you need to turn your heart off and only use your head above the shoulders.

Your initial post still doesn't explain how a school advised her to attend while she was here on as a tourist. Did a teacher randomly walk up to her and tell her to start going to class? The story doesn't add up.

That's a negative, shows strong ties to the Unites States and even less reason for them not to abuse the tourist visa. And that's on top of previous abuse.

Honesty I can't tell you the outcome or the decision the officer could have, I don't think anyone here could either. However when you go to your interview you will be asked those questions again, answer them truthfully. So if that means Yes say yes and explain what happened to the officer. Saying the truth now will cover you in the future.

    Good luck.
