    Yes, I’ve been trying to keep myself occupied for the last 10 months to distract myself...I think it is just getting harder as the time ticks on with no obvious light at the end of the tunnel. I’m a “planner” so this process makes that impossible! Sending positive vibes into the universe that this has an outcome for us all soon!

    Lawyers can do things to cause issues or delays so more money can be made off their clients. 
     
    I subscribe to a monthly lawyer plan through my work where legal fee for K-1 is covered with zero deductibles.  However, I still filed my K-1 by myself since for this simple form, I trust myself more than any other third party.  
     
    I suggest get your money back and file for yourself once you get the form rejection notice by yourself or through your lawyer.

    They send petitions to the country mentioned as the physical address.
     
    what can be done if the person no longer resides in Costa Rica, and will have the interview in another country. You will contact the embassy in the country that you want the interview to happen and ask them to request the files from the embassy forms went (in this case Nicaragua will request them from Costa Rica) it takes about 2-3 weeks usually.
     
    and then after the petition is ready in Nicaragua things can go forward and you can follow their instructions.
     
     
    To sum up where you can interview: nationality doesn’t matter where the residency is matters. If your fiancé is in Costa Rica then can interview etc in Costa Rica doesn’t have to move back to her origin.

    There's a bit of a loophole around that which the OP's lawyer may have taken.
     
    One can paper-mail the tax return with a copy of the ITIN application (and fill in the fields with "Applied For" where it asks for the dependent's SSN/ITIN number).  This should naturally be done only in cases of those who are actually eligible to receive an ITIN number.
     
    Unscrupulous of the lawyer, if he went that route, considering the OP's girlfriend shouldn't be listed as a dependent anyhow (because they didn't reside in the household).  Or he left that field blank.  Or he put in a fake number.  Anything sounds possible now.
     
    OP could know how attorney filled out that portion by looking at his copy.

    She could be using you for the visa to enter the US alone and then hook up with someone she already knows.
     
    It's surprisingly quite common from Vietnam and Philippines.
     
    But.. and this is a big but.. you're not on the hook for anything unless you marry her within those 90 days. Remember she has no other path to legalization except through marriage to YOU.
     
    So trust your instincts and ignore them at your peril.

    I suspect that the situation may be actually quite complex.
     
    Divorce is ruled by the state in which the divorce is filed.  Some states seem fairly fair about child support and some, at least in my opinion are not fair at all.  I know you have little funds but if possible try to find a divorce lawyer for it may' be much to your advantage to divorce her in Oregon versus her filing divorce in Florida.  In a sense, sometimes it can be a race to see who gets to divorce first.  It may matter a lot and may not matter at all.  Worse, it may be worlds better for you to have to go to your local Court than to hire a lawyer in Florida.
     
    Again, no matter how rational it may seem to you I advise you to not fall back on the logical reasoning of but I have no money, for that will never, ever work. 
     
    You have two distinct issues.  First is the support under USCIS.  If she uses, as someone has already said, WIC (Women and Infants Care) she rings up a bill, and you technically are responsible for it.  The paternity of the father may or may not materially affect what you would owe, and worse, you can contest the bill and/or counter-sue the father of the child, but this however, is not an easy thing to do.  The short story is that if she uses WIC, TANF or Food Stamps, you owe.  Whether you have money or not does not ever matter to any Governmental agency, or Court.
     
    As far as child support, you likely do not owe any.  But that is "to the child," and the child has a mother, again a complex situation.  The documentation that you have is a start, but, as someone pointed out correctly, the Court will likely demand a new genetic paternity test.  Here, even though the child is not yours the Court may look upon the case as, since you brought her here, you owe her a certain level of support.  What you owe, if any, will come out of a usually painful legal battle.  If you choose to ignore Court actions or if you cannot afford legal action it is likely that the other side (her side) will take advantage of that and make high demands.  Without a counter-argument, the Court will often grant those demands.
     
    In a sense, your best and worst defense is that you do not make enough money.  Therefore, it may be wise to come to some agreement with her, in other words, pay her off to go away and be done with it.  Even there though, I'm sad to say, this is an area where someone who can work well as "pro se" (a person who represents themselves without a lawyer) will have trouble.  Therefore, my advice, which I hate to give, for I loathe lawyers, is hire a lawyer.  Any contact that you make with her without a lawyer may simply be thrown out in Court.  And worse, is an agreement is made and she has NOT had it reviewed with a lawyer it will likely be thrown out by a Court.  Try to be amicable with her, no matter how furious you are for you are likely the one to suffer here as unfair as that may be.
     
    Do not ever think that because you have on money, you are safe.  My neighbor, during the economic crash of 2008-2009 found himself unable to pay child support because he was a contractor and almost all building stopped and there was no work.  The Court demanded he pay.  He said: "I cannot, there is no work."  And the result: He spent a month in jail.  The only way he was able to get out was to agree to sell his back-hoe which he had bought in 2006 for $45,000.  I was sold for $17,000 and he used that to pay the back child support.  In the eyes of the Courts and government agencies it seems every decade gets worse and worse.
     
    You are in a terrible situation and I hope that you are able to navigate and get through it and someday find a woman who won't cheat on you.  I do wish you the best of luck.

    If you were married when the baby was born, the child is assumed too be yours, and you are responsible for child support.  If this is the case, be sure your divorce attorney takes proper step to disestablish you as the father.

    Looking forward to finally being with my fiancee.  As of this time we still do not have her police clearance from Denmark (she stayed there for a year back in 2009*2010).  The process took 174 days from NOA1.

    I am happy and proud to say that as of today I am an American citizen!

    Finally noa2 after a long wait .  Was working, minding my own business and got the text!  I'm thankful to have found this forum and the people in this forum.  It has helped me get through this process and I hope that everyone else waiting in July will get theirs soon too.  It's around the corner.

    No credit history/poor credit history or lack of background check information is NOT discrimination as long as they treat all prospective tenants the same way.  Denial based on age, sex, religion, disability or one of the other protected classes would be which is not the situation here

    I never said you are a bad abusive American. I am trying to point out that you have some ownership in this situation. And I tried to explain that your reflection on how you would do things differently is not realistic.
     
    But hey, I'll stay away from this thread, I am not interested in a discussion with someone with such an aggressive attitude. Good luck with your situation, I sincerely hope you'll be able to heal and find love again.

    Yes, mostly people have a sense of what they need in a partner, so abusers see who is a potential victim and victims are attracted to a potential abuser. But I had a great marriage for many years, became a widow, probably my abuser saw a widow, they know the widow is in a grieving weak stage but it's temporary.

    I think marriage is not a lottery.  It's more like bowling.  There's still an element of chance, but with talent and skill and persistence you can greatly improve your odds.

    Also the people behave different when they see an American abroad, walking dollar, free meal ticket, free way to America and it cost only a nice smile and love, easy game for many of them.
     
    After my experience, I would say, more face time but here, in US, not marrying so fast. Maybe the new law, not 90 days but 1 year here for a foreigner to see our country, to see both of us in the same house and decide to marry. 1 year living together can give you the idea if it works. 1 year with a work permit but no green card, AOS after 1 year together here.

    This Topic is for to share our experience, many USC are suffering the Marriage Fraud, manipulation, abuse and many things more hurting us for years or for life.
     
    Let's share our stories and think what could we do different based on our experience and knowledge now.
    Immigrants have all the rights and protection in our country. What do we have, we US citizens? Spending a lot and making a lot of documents for to be with our loved ones. Do we deserve being used, manipulated, abused and even send to jail because of our best feelings and intentions? What kind of legal help do we have? What kind of support?
