If you bring her here on a K1 and you marry, she cannot return to Canada to as you say "have that all process while she is finishing her last semester". She would have to remain in the US with you. K1s can only work and enter/exit the country when they are authorized to do. The wait on that authorization process is growing ever longer and I expect that to continue.

There is nothing wrong with visiting (proof that the person intends to return from wherever they came), marrying in the US, her returning back to Canada, and applying for a spousal visa for her. You do not need a K1 to do that. Marriage is in the domain of the state, so people are allowed to freely travel and marry in the state they choose. However, the person must return home and apply for a spousal visa. K1s are for those couples who cannot otherwise travel to the US to marry (they were previously denied entry, or they want to get married in the US and have no intent on returning home, or they don't want to be apart as a married couple). The question will be timing, and if she is still committed to finishing school in Canada then applying right away may not be prudent. Remember green cards, which she will have at the end of a spousal visa, are for staying in the US, and typically people will want to have their plans in other countries wrapped up. The plus side about spousal visas are instead of having to adjust status as a K1 and be in limbo for a long time to do anything, no adjustment is needed and the person can work immediately. But again, green cards are for living in the US, and she'd want her Canadian commitments finished. You will also need to have met and have established good evidence.

Other things to consider will be: do you make enough to fulfill the financial sponsorship requirements whichever path you choose?

Yesterday was spent drinking punch and cider of the non-alcoholic variety, making up a seafood platter, chicken salad sandwiches, and cheese/crackers for snacking, watching movies with plenty of popcorn, and playing Scrabble-Monopoly - a new mashup of the two games. Dessert was a Smith Island cake by me. Briefly watched Anderson Cooper get silly drunk for a while.

I wanted to give a little update to this old thread. I passed a good deal of information that I was able to dig up involving individuals in this case to the relevant authorities and to some alternative sources. I hope that it provided useful info that the feds could use against this specific criminal. I am pretty ticked off though that the FBI let this guy flee the country.... while they recovered some of the stolen taxpayer money, $1.5 million is a drop in a bucket.

and this was another guy I tried looking into. The FBI's court filing is here: https://www.courtlistener.com/docket/67594550/1/united-states-v-syed/

There's a couple reasons why I'm sharing this story. You see, I've been down the rabbit hole these past few weeks, when a relative received a mysterious package they didn't order in the mail. Inside were very expired, very tampered looking COVID test kits. I was very alarmed, so me and a few tech buddies got together and did some digging as to just who these scumbags were. Turns out the feds have been working cases like this for a while now.

It's not always immediately noticeable to an individual that has Medicare if they have been/their plan has been charged for fraudulent devices. I immediately set to work tracing back months of Medicare billing to see if I could find the fraudulent charges. Not so, because a lot of EOBs and lists of charges are usually running several months behind. A call over to the OIG and federal Medicare fraud investigators, and they could see the charges from back in May, the exact timeframe when many of these packages started showing up over the US. They immediately flagged and created a case file, and unfortunately my relative's info has been compromised (the government is still investigating where and cannot comment yet) and they will have to issue them new cards/numbers. If you have any elderly relatives, or are a recipient of Medicare yourself be on the lookout for any unusual charges and or packages coming to your house. There are extensive news articles online addressing these instances from different states. I must stress in some cases many of these scams are using phishing or phone calls into tricking individuals into giving them their info - but this is a somewhat new tactic, the recipient of the fraudulent goods is unaware of anything coming to their home and never requested it.

The civil surgeon and the consulate are the authorities who would have the info you need.  They made him wait a year because they want him to be clean for a year.  Currently, he is inadmissible.  Now, he needs to PROVE he is clean for a whole year. That is why the consulate will likely require periodic (maybe even random) drug tests over the next year.

What he got me: a coat, clothes, trainers, giant lego set, cookbook, a makeup bag from London (this was especially sweet as it's my favorite brand), and chocolate.
What friends got us: a Japanese subscription box
What we sent to the kids abroad: perfume for the eldest and squishmallows for the youngest

As is traditional a few days before Christmas we head up to Longwood to look at the display and have their absolutely fantastic holiday menu. We also usually take the family out for milkshakes and ride around the neighborhood to look at the light displays. Then we celebrate Christmas, on Christmas Eve, to give everyone an additional day of rest before heading back to work. Daytime is usually reserved for guests and present exchanges, and later in the evening when most have gone is when a quieter more enjoyable time for gift giving is had. It was stressful during the day because of the person that invited themselves over, but we tried our best to make things work. We usually get Chinese takeaway for dinner and dessert by me.

Long story and I did not need it but I was young and ignorant and got it done for no charge, maybe look for Civil Surgeons who serve the Hispanic community.

So in your case you had your K1 medical and did not have a complete vaccination done and elected to complete them in the US.

Generally this is a mistake, there can obviously be situations where this arises and it is what it is but they are pretty rare.

So being in that situation you have the main issue, CS's who will not do only the I 693 and only a few it seems will. Plus of course you need someone local. Then you need that they will do it and how much they charge.

As far as a list sadly not really practical.

    Civil Surgeons come and go
Their charging structure and practices change
This is a rare situation and as I mentioned best avoided
VJ simply does not have enough members, people in this situation, for such a database.
Really only USCIS could do this, incorporate it in their database.

yuna628 reacted to Aimless_wanderer in My N-400 Interview Today was Rough
    Hello everyone,

I just want to share with you all my N400 interview based on my 3-year role experience (I-751 was approved two months ago). My appointment was scheduled for this morning at 8:30 A.M. at Indianapolis. I arrived with my wife at 8:15 am. The security was nice and told us to have a seat, so we did. I was called in at 9:37am for the interview. There was a guy who was making a fuss, saying he had been waiting since 7:30 AM, though his appointment was scheduled for 9:00 AM. He kept talking to every officer when they called someone, and they kept telling him that his case was with another officer and they were behind, advising him to wait for his turn.

When I was called, it turned out that he was after me in line, and the officer told him he would be called after I'm done. The officer walked me to her office, which was at the end of the hall, allowing me to see that all offices had ongoing interviews. The officer was really nice to me at first and was cracking jokes. She asked me to switch my phone off, put it on the table, and hand her my Green Card before she swore me in. After swearing me in, she started talking about the guy who was making a fuss, going on about him for at least five minutes. She said, "He better speaks perfect English when he gets here," hinting that he was in trouble with her. I was extremely uncomfortable with her talking about this gentleman, as I just wanted to complete the interview and go home.

When she tried to engage me in the conversation, I tried my best to stay professional, saying, "I'm sorry officer that you have to deal with this," to which she responded aggressively, asserting that she can take care of herself and I shouldn't be worried. Then, she suddenly became very aggressive and confrontational, saying, "Ok, we will start with the test," and flipped 180 degrees. At this point, I hadn't done anything wrong or answered incorrectly. I was just waiting patiently in the waiting area with my wife, and we didn't complain.

After I passed the civics test, she moved on to English. I almost failed the English test because she was getting in my face. She asked me to read an English sentence, then asked me to write "The people elect Congress." I forgot how to write it due to my nerves from her nonstop confrontation. As soon as I touched the pen to write on the screen, she screamed, "NOT LIKE THIS! YOU DON'T KNOW WHAT YOU ARE DOING!" and got up from her seat to show me how to do it. I was so confused and tried my best to keep my composure, she micromanaging every move I make and every word I say.

Then she became sweet and nice again, talking about the gentleman in the queue after me, saying, "He better be fluent when he gets here, he thinks because he is here at 7:30 AM he should be first." She moved to the Yes/No questions, and it felt like eternity at that point; it was pure hell. She asked if I had ever been arrested, cited, detained, etc. I mentioned my 3 speeding tickets, and she became confrontational and aggressive again. When I told her the last one was in March 2018, she demanded details about the other tickets, but then said she only cared about the 2018 one only talk ask about the 2015 ticket again. I explained it was a minor speed ticket for which I took a safety course then she said she doesn't care about it, she only cares about the ticket from 2018.

Next, she asked about false citizenship claims. When I said I never claimed to be a U.S. citizen, she aggressively asked, "How would someone claim to be a U.S. citizen?" I answered, "Verbally or in writing," but she pushed for more, leading me to mention registering to vote or voting in a federal election. She asked if I was tricked into registering to vote in college she can see it in her screen I better tell the truth, to which I replied loudly, "NO!" She stared at me silently for a few seconds, then smiled, said "Good!", and moved on to the next question.

She asked if I was willing to take the oath and understand it. I explained it as giving up any loyalty to other countries and obeying U.S. laws. She confronted me for missing a point, aggressively insisting I mention defending the United States and bearing arms if required by law and I was suppose to list it as the first point. She said, " You are willing to take the oath and you don't even know what it means, you don't EVEN KNOW WHAT THE OATH OF ALLEGIANCE MEANS !!!' She also violently questioned my response about the Selective Service and confronted me about it though I became a permanent resident after 26 years but I registered anyway but I answered no to being younger than 26 when I was admitted as a lawful permanent resident; after showing my registration, she said she would correct it and moved on. She asked if I wanted to provide more evidence I said, " I have bank.." she interrupted me saying, " DID I ASK WHAT YOU HAVE?" and snatched our joint account bank statements, I don't believe she even looked at them as she didn't ask about our relationship during the interview at all.

Finally, she asked for my travel document, which I didn't have with me, and instructed me to mail it back. She said, "If you don't have it now, mail it to us, DO YOU UNDERSTAND? WE NEED IT BACK!!!!! THE TRAVEL DOCUMENT TO APPLIED TO WHEN YOU WERE WAITING ON YOUR GREEN CARD, WE NEED IT BACK!!!' She had a thick file with all my immigration forms including my I-485 and my I-751. She was complaining the officer who approved my I-485 didn't sign something, but it wasn't a big deal. She then typed on her computer, still complaining about the man waiting outside. It was 10:10 AM at this point. She informed me that my ceremony was at 11 AM and that I needed to be back by then. She said, "Wherever you go, I NEED YOU BACK BY 11 FOR YOUR OATH!!" handing me a paper with "Congratulations, you are recommended for approval."

On the way out, she asked how I felt now that my immigration journey had ended, becoming sweet again. She mentioned that I was lucky because they only have same-day oaths on Tuesdays and Thursdays. When we reached the waiting area door, she called the man's name and he went in. I left with my wife and returned at 11. The security read the officer's name on my paper and shook his head in disappointment. We entered the room, they took my green cards (2yr and 10yr), and 40 minutes later, an immigration supervisor walked in, apologized for being late saying the supervisor who was supposed to conduct the ceremony got busy, and conducted a brief and informal swearing-in ceremony. It was so causal, the officer wasn't sure if we were supposed to stand up for the oath or remain seated lol. After reciting the Oath of Allegiance by himself, we replied " I do!" when he finished, and congratulated us for becoming citizens and passed on our naturalization certificates.

Overall, I'm happy that I'm finally a U.S. citizen and won't have to deal with USCIS anymore. I just wish my interview experience had been better because it was totally unprofessional. Everyone else in that office seemed nice, including the supervisors. I just wanted to share my experience with you all. For all of you who are waiting, your time will come soon; be patient, the journey is totally worth it.

In the states, cordials are considered alcoholic beverages or types of chocolates, but in the UK they are non-alcoholic - a syrupy fruit juice with sparkling added. Though you can make them alcoholic - like a Cider & Black (alcoholic cider + blackcurrant juice cordial) or a type of snakebite. My great grandma used to make cordials and they were added to alcohol like a sort of mixer at parties. I would often debate with my husband if Martinelli's Sparkling Cider or Welch's is considered a type of cordial rather than just a non-alcoholic cider or wine, but we couldn't get a definite answer. You can get non-alcoholic cordial in the US, but they are like mixers right?

K1s are authorized to work for those 90 days they’re given once they enter the US. CBP used to issue work authorizations for 90 days at the POE. That practice has stopped more than a decade ago. Now you still need a valid EAD to work those 90 days but knowing how long USCIS takes to issue them, it’s just impossible that you’ll actually work in those 90 days. Plus you’d actually have to pay a fee because this isn’t based off of a pending I-485.

In short; they’re not wrong in the paperwork they gave you. But as I explained above it is just not practical and isn’t really a possibility. You will have to wait until you get an EAD based on your I-485.

You are allowed to work once you have authorization. The SSN card you will receive should say ''valid for work only with DHS authorization" on it and the EAD you apply for will be that authorization. You can remove that 'restriction' by going back to the SSA once you obtain your green card.

yuna628 got a reaction from Chancy in New Regulations for Those Wanting to Return to the UK
Over the years there's been many persons on this forum that have inquired about returning to the UK with their American spouses and children. There has always been visa requirements involved with that, which included financial requirements that for some, were too great. Based on yesterday's announcement by the UK government, they intend to increase that burden further.

The old rules required that the UK citizen and only the UK citizen had a UK job and guarantied salary held for six months or more of £18,600 (roughly $23,000), or a large sum of savings of £62,500. This amount increased with each non-UK citizen child.

As of yesterday and becoming effective in spring 2024, these guarantied salary amount will be increased to £38,700 (roughly $48,800). No doubt that means the amount for savings and for any additional child will also increase. If the math works out that would increase to £112,000 in savings. No joint sponsors or joint income may be used.

There is also price rises in the visa fees itself, as well as significant increase to the amount you would have to pay each year under the health immigration surcharge.

This was a part of additional changes and measures which will negatively affect legal immigration to the UK. This post is just for informative purposes. I've had numerous discussions with UK-based lawyers and legal immigration support organizers. I'm sure that everyone will have a variety of thoughts on it. There may be legal challenges to come and things could theoretically change in a new election. My advice is always: make sure you have your UK citizen spouse's status settled here first, before thinking of uprooting yourselves and be aware that the UK's requirements are a lot harsher than the US.
