Sorry.  You made a gigantic (and maybe irrevocable) mistake. We would have advised you NOT to apply for a B2.  Until your situation regarding ties to home country have changed, you are wasting your time.  Forget about an attorney.  @Mike E has some great ideas.

Get a job and home in the EU.

We never advise people who have an ESTA to apply for a B visa

You have created a de facto ban for yourself. This was totally unnecessary. You could have spent 90 days USA, then 91 days in the rest of the western hemisphere, and then another 90 days in the USA.

Try again in 5 years. You will then get   a 10 year multi entry  B visa and life will be much better, if you are still inclined to visit the USA (I can understand if you will not be).

If it is any consolation, when ETIAS happens this year, the Schengen Area will be doubt the same thing to Americans that Americans have been doing to citizens of the EU.

I hate electronic travel authorizations.  I have a strong feeling that after November Europe will become inaccessible to me.

Hello. If your situation didn’t change regardless your ties to your home country, will be really hard to get a different result.

ESTA is dead to you. Once you try to apply for a B2 you cannot apply for a ESTA, ever again.

Applying in another country is another red flag, imo. Looks like you are trying to find a back door. The denial was about ties, applying in another country shows 100% that you are not tied tou Netherlands. Also shows a level of desperation .

Looks really difficult to get approved but you will need to apply to check.

By the way, they are not obligated to accept and review any paperwork that you bring to the interview. Normally your case is already decided based on the information provided in the application form.

    Good luck.

OP, I mean this without judgment but if you are having a hard time getting a job where you are, why will it be easier for your husband? I think it's great that he wants to contribute financially to the marriage ASAP but you have an obligation to make sure he doesn't become a public charge if you bring him here and he can't find work.

Not trying to be rude, but go get a job. Even flipping burgers in McDonalds is now $15/h thing. How do you expect to provide for a new immigrant when you can't take care of yourself?

I agree that inquiring is a lot better than applying for a new I-130.

However, they are still within normal processing times. There is a reason they post processing times. Asking a Congressperson to inquire about a case when it is in normal processing time would be wasteful. Usually, inquiries are done for cases that are taking longer than usual. A Congressperson can NOT influence immigration to go faster than normal processing times.

What happened with you case may be different than the OP.

If you're struggling with bills right now, it's only going to get worse if you need to support another person who won't be able to legally work for a long time. Last I checked, work permits were taking 8+ months. You can check the timelines on this website for a more accurate idea.

Maybe check in with her. Doesn't she have an apartment, or other obligations, to go back to?

Propose, but adjustment of status might be a golden cage.  Discuss the length and duration of that process.

Unlockable got a reaction from jp1000 in If I got K1 VISA, can I marry US Citizen in my country first?
@Gabriela Gaghana, as someone who has been on these forums for a long time and have seen a few things. Please do not do this. It is not worth it. Too many people have been denied because of it (please see some examples below). People have even been denied for having a engagement ceremony which is not an official marriage. So any type of formal ceremony of the union of a couple is risky to a K1 visa.

@biscoito1r, you have to understand what others are trying to tell you. It doesn't matter if the ceremony is official or not, if an immigration officer suspect it to be a marriage it can lead to a denial. But the OP specifically asked about legally getting married prior to the K1, which is a no-no for that visa. Also, Mike E provided evidence of people being denied for doing that very thing. Have you read that thread he posted?

If that doesn't convince you it is not a good idea for the OP to get married before their K1, here is more proof of people who did it and got denied.

Don't celebrate too soon. A social security card does not give you authorization to work nor does it give you authorization to travel. Those authorizations will come much later, possibly months from now.

For now, you still can not travel and you can not work. You can use the SS number to open bank accounts, apply for credit cards, and get insurance.

One thing I have learned is that people who are just starting out value speed over all other benefits. I don't know if it is because they are in a honeymoon phase and are anxious to be united with their new love asap.

I joke with my friends irl on how the K1 is like the sports car you've always wanted as a kid. Nevermind that it is expensive, has horrible gas mileage, uncomfortable and impractical for every day use, and cost a lot of money to maintain...you just want it because it goes fast.

OK. If she is here then you can proceed to AOS. However your first sentence in your first post was confusing. Possibly due to a typo?

    Also when you said this...
it makes it seem as if she is not in the US because she should already be aware of how much time she has in the US if she has gone through customs or she can check her duration of stay via her I-94.

Still not allowed in this forum. Doesn't matter who is planning or if they are using the the plausible deniability tactic. Do not discuss fraudulent activity on this site.. period!

SMH.  Sorry, but I think it is irresponsible and cruel to bring a very elderly person here and not provide him with basic health insurance.
