Hi all,

 

Well, it's been closing in on 14 months since I filed an I-824 to have my wife's I-130 moved from USCIS to NVC and still nothing... 

 

The website is saying current processing times are 20 to 24.5 months for I-824. Do you think it is worth it to file a new I-130, or just wait out the next 6 to 10 months and hope the 824 doesn't get delayed further.

 

Also, if I file a new I-130, does that void the original?

Inquiry won't help move it along, and besides, it is still well within the normal process time, so no real use in getting congressman involved.

No. 1000 times no. Why would you do this?

 

If they are telling you how long it will take and you are within that time, why would you complicate things by adding a new file???

 

They tell you how long it will take so you can know and sit and wait until that time arrives. They don't tell you so you can come up with ideas on nudging them to move faster. 

 

I apologize if this response sounds a bit harsh but you will not be helping with this antic. They are still catching up from the backlog of Covid. I know patience is hard to have in some cases but it is also a virtue.

I agree that inquiring is a lot better than applying for a new I-130.

 

However, they are still within normal processing times. There is a reason they post processing times. Asking a Congressperson to inquire about a case when it is in normal processing time would be wasteful. Usually, inquiries are done for cases that are taking longer than usual. A Congressperson can NOT influence immigration to go faster than normal processing times. 

 

What happened with you case may be different than the OP.

Understood, and no, it does not sound harsh, :)

 

The processing times are bouncing all over the place. In October or November it was showing as 3 months to 36 months, so I really don't have any confidence in the posted wait times. 

At least we are more fortunate than a lot of other members here, in that she is at least here while we wait out the process.
