    Happy New Year, Everyone! We had great news in the mail today! Removal of Conditions approved on 12/21/17! (We filed 1/14/17 at Vermont Service Center.) We received an I-797 Notice of Action stating the new card will arrive within 60 days. Next stop N-400! Hoping this brings good fortune and speedy processing now to anyone else waiting!

    I'm not sure how it works there. So this is what I did and how it worked for me, maybe it's similar there.
     
    I filed for divorce 6/20 (not real dates I can't remember them) my husband at the time had until 7/20 to respond. No response means he doesn't contest the divorce. He was served and had 30 days to respond. He didn't because the drunk figured he could sweet talk me out of it. 
     
    Here's the thing though my divorce was filed after only 5 months of separation. In Canada you have a 1  year waiting period so my divorce had to wait till the 1 year of separation was hit but it was on the Judges desk first thing when that date hit. As the divorce was filed and uncontested months earlier it was just a matter of the courts signing off on it and start the 30 day waiting period for it to be final. So nothing my ex could do when he got the notice that the divorce was going through in Feb. 
     
    The courts sent us both letters to notify us it was going through. Remember I filed back in June so I didn't have anything else to do other then wait my 30 days. The mandatory waiting period in Canada to make the divorce final. 
     
    So I'm going to guess maybe that is why you have different dates. If I was you I would call the court house to get your final divorce decree or annulment papers. I would never ever trust your ex. I mean I am one of the biggest suckers for bleeding hearts and it took me 16 yrs of  mental, psychological, financial, and physical abuse and I still believed he would change when he cried and begged me. It wasn't until he went after our oldest child, did my heart turn stone cold and momma bear come ranging out did I stand my ground. 
     
    So when I say to stop letting your heart make decisions, I'm saying this with experience. Let your head guide you, don't fall for the lies and let your heart sucker you in again. Cancel his plans to see you at Christmas stand tall and stand strong. You are worth more then this.

    Yes there are some questions at POE.  Just simple general questions and they  usually make sure that you know you have to marry within 90 days. It’s nothing to stress over.

    That’s a great way of getting an immigrant to America: lying to USCIS. Man, just do it the right way. No lying. Everyone is. What makes you so special? We all have been waiting months, some years, to be with our loved ones, you will not be the exception. It will take as long as it takes. Work out the pros and cons of each type of visa and go from there. But expect a long wait and no ways of bending around the rules.

    What if I get married there but do not say I am married when I apply?  How would they know if the marriage is in Aruba? We have not yet met. We have talked for a long time but this will be our first face to face due to the current situation in Venezuela and my and her inability to get a tourist visa.

    I rec'd the letter yesterday - no update to case status. I rec'd a text this morning saying that there was an update to my case. When I logged in, the CRI-89 case was updated to show that "New Card Is Being Produced".

    Hi, just got my approval letter yesterday.
    We applied on 1/3/2017. Got NOA 1/7/2017 for me and my daughter. Got both approvals 12/13/2017. Vermont.

    I'm in the ROC stage post K-1. I had a difficult time finding a job with my EAD, but once I had my GC in hand I received a lot more interest. My first job here in the US was with a software company, my position was office assistant. Within one year of being with the company I transitioned into the development side of the business and I'm still with the same company. Knowing four languages is great - I know two languages, and it certainly helped me move up where I work.

    I met my now husband in FFXI - this wasn't an issue at all. The officer who interviewed me for the K-1 Visa actually laughed and asked, "People still play that game?" 
     
    I'm not sure if things have changed since we filed for my K-1 in 2013, but we had no issue.

    My wife claims she can't hear all words when I speak so she assumes some words which causes lots of miscommunication.
    But she has no problem hearing me pour a glass of wine 2 rooms away.

    Clean your browser after posting/login here, in case your husband has access to your cellphone or computer.
     
    First of all, call the National Violence Hotline and find a shelter for victims of domestic violence and leave immediately. Do not tell your husband when you are leaving, pack your stuff and leave, if you are not able to pack yours belongs because your husband is at home, go outside call 911 and tell the 911 operator  that you are a victim of abuse and you need  the police comes to your house in order for you to get your belongs and leave, and say you fear for your life, wait for the cops outside the house.  You should file a police report because the abuse you suffered.
     
    To file VAWA you must be married or to live in a State that recognizes "common-law marriage and if yes you need to find out if your  State requires you to record the common Law marriage with State or local authorities.   Common Law marriage occurs when a couple lives together, and holds themselves out as husband and wife, without being legally married. To file VAwa you must prove abuse, to prove abuse you should have a police report and/or a shelter letter, restraining order, hospital letter, or a psychological evaluation stating you were abused and if you will need a diagnose of Post Traumatic Disorder and/or Depression due to the abuse suffered.
     
     To file U visa you don't need to be married but you MUST HAVE A POLICE REPORT an obtain a  U Nonimmigrant Status Certification (I-918)issued by any Federal, state, or local law enforcement authority, including prosecutors and judges,  stating that you collaborated with the investigation of the criminal activity.

    I agree with the above poster.  he may he backdating to get around a legal separation requirement in your state to start the divorce faster.   Which is, of course, fraudulent.  Do not sign it.  
    You need a lawyer.

    Sorry, I don't know the answers to your questions, but one thing I will say is DO NOT sign a separation agreement that has been backdated to January, 2017.  I don't know whether it's legal to create a document and then backdate it, but the most important thing is never lie to USCIS.  If you sign a document saying you filed for separation in January but have applied for ROC in July (claiming you're still in a bona fide marriage),  USCIS may consider this misrepresentation and deny your I-751.  It sounds like these are questions for an attorney.

    If you get called in for an interview before your departure and got denied, then you will become deportable but will not be imprisoned. You just have to leave the US. If you don't show up, then USCIS will think you abandoned your petition. Same thing, you will have to leave when your GC expires.
     
    The real question is, are you sure you want to leave the US? If you abandon your petition, you give up your chance on being a permanent resident here. Is there a better opportunity, career-wise for you back in China?
     
    Also, please ditch your lawyer. He gives some awful advice.

    He's made it clear you are not a priority. Let him leave do not file for AOS. Talk to a lawyer you never consummated the marriage and he seems to have kept a drinking problem from you. If this man was in love with you he would want to be intimate with his wife. I understand not before marriage but after getting married, he should have been sweeping you off you feet and carrying you to bed. (ok ya a bit exaggerated but you get the idea)
     
    Now to point out a few things from your post. Yes you can apply for EAD before AOS, but here's the thing. It takes forever and a day to come in and expires the same time his 90 days are up. 
    He's being emotionally abusive and manipulative. 
    At this point you are not financially responsible for him.
    Don't worry about him leaving before you start divorce preceding. It's really not that big of a deal to have him served if you know his where about. If you don't the courts can tell you how to do it by publication. Him leaving without a fight is better then getting him to sign papers.

    My view and I know that I am skirting the VJ ToS, my bible.
     
    The number of views you will get on this is only limited by the number of people you talk to, Lawyers included. K1 is authorised to work through status but the EAD is evidence of that authorisation and is needed for the I9. If you are employed by a company not in the US, in this case on the Canadian payroll obviously I9 not needed. Obviously simpler if you go the CR1 route. IRS just want their tax, yes it gets complicated but there are Accountants familiar with this so just a cost issue. In any event even if you could be held to be undertaking unauthorised work such work is for the want of a better term forgiven when adjusting through marriage to a USC.

    No, it is not like this. I had an EAD. The EAD is the authorization to work. Before you get it, you are not authorized to work. 
     
    People without EADs pay taxes. As  I said above, and someone else also said, paying taxes is not directly related to the visa status or the immigration status. 
     
    A company in country A does not care about laws country B if they hire someone in country B. That is a concern of the person in country B. 
     
     
    If the company has an affiliate in the US then it is worse that you work without the EAD for the branch in Canada. 
     
    Again, taxes and being authorized to work are 2 different things. And the US does not care if you pay taxes to Canada. Immigration and the IRS are two different entities. 
     
    Yes, the L1 would be for a few months because once you get the EAD your L1 will be void. We are talking about 3-4 months from the moment you file for AOS. If you give them a job offer from the US branch they will expedite the EAD.
     
    It is for seasonal workers. Not for people working for companies and planning to stay in the US. 
     
    You won't be able to get 2 visas anyway. 
     
    To start with, you cannot enter the country with 2 visas at the same time. If you want to get marry and AOS, you will have to enter with the K1. If  you want to work you would have to enter with an H2B and you won't be able to marry/AOS. If you leave before AOS is complete (and you have your EAD), you are out of K1 and not able to complete AOS in the US (so back to spousal visa). 
     
    You seem pretty stubborn. The response will always be the same. Resign from the job. Get marry and file AOS with job offer to expedite EAD. THen start working for US branch. The end.

    Oh, I had to pay for my interview when I confirmed it on the website and then I was a sent a confirmation email with proof of payment. If you don't pay until the day of I'd just say print the confirmation email?
