    Why do you feel bad for someone who lied to CBP in order to gain entry into our country? I don't. We have immigration laws for a reason and as far as I'm concerned anyone who lies to CBP, USCIS, or the consulate should be permanently banned. Our immigration laws are far too lenient. Tell me in what other country in the world would you be allowed a second chance after blatantly lying to their government? Answer: none!

    People are allowed to visit girlfriends. They wouldn't have denied him entry necessarily for being honest. Now he pays the consequences.

    Don't beat yourself up over the ticket. It happens, and excitement to see a loved one is hardly something to be ashamed of...ticket prices should remain low.
    Suggest you think in more detail as to what might have caused the file to go to AP, in the unlikely event it takes an extended period of time to clear. From experience (and I have experience) AP is something of a black hole. For what it's worth, in our case I was expecting months and months in AP and it was not so long - it just kind of ended. Before I knew it, my wife was here in LA.

    I checked again, and it's listed among the documents that need notarization, apostille, and legalization. All US side stuff.
    The process here was entertaining as well. I'm pretty sure that was this doctor's first mental health check for foreign marriage purposes. And it seemed like the first mobile notary to come in the office too.

    what you are suggesting is visa fraud.-material misrepresentation. When she is caught she will be deported and banned, she will get caught sooner or later. You would face prosecution, too. USCIS knows a lot more than you think they do. When my husband had his interview they knew things about both of us that we never told them, they do their homework Your only option is to divorce and for her to go home. Her staying to take care of her family isn't your problem.

    It is VERY unlikely (impossible) to get the religious waver for not meeting. You can have this meeting being chaperoned there is nothing that say you must meet alone.

    Rule of thumb is to never purchase a ticket until the visa is in hand. Assuming he is flying from Accra to Phoenix, you should have no problem getting a $900 one way fare. Las Vegas about the same, Los Angeles less I imagine. Check out google flights and Hipmunk.com. Best of luck!

    My Vietnamese wife says the same things.
    Let's add #12 - our wives came here because they loved us and wanted to be with us. My wife had a nice job in Vietnam, a large loving (and comfortably middle class, well traveled family).
    We will purchase a second house in Vietnam when I retire, but we'll spend most of our time here in California. Our life is in the US, understanding it is far from perfect. Besides, how can I reliably watch Ohio State football and San Antonio Spurs basketball in Vietnam?

    Upon consultation, Mrs. T-B. says that she would have been content to remain in Ecu had she not been exposed to living here. Her analogy is that it's like always having stayed in a Motel 6 -- it's OK when it's all that you know. However, the difference becomes clear when you stay in a Hilton or Westin, and then you're not satisfied with the Motel 6 any longer.

    As others have said, no issue. Unless I'm mistaken, your fiancé will pass thru immigration at ORD (Chicago), Detroit, etc but not in Ohio. I don't think you can fly direct to Asia from any Ohio airport. If that's the case, it wouldn't matter anyways.

    Same here. My sister in law (single, 30) and mother in law (from Vietnam) just received tourist visas. My sister in law brought her work contract, and has travelled to Japan and Korea. My mother in law has property in Vietnam. All that said, the CO read the letter I wrote, spelling out the financial details, purpose of the trip, etc. I didn't think it would get attention, but it did.
    If someone wants to draft a letter, clearly no guarantee it will help. However, what's the cost and the harm?

    I assume you are suggesting she use the VWP. Traveling late in a pregnancy is dangerous, and flying to the US simply to have the baby on American soil to seems a bit sketchy to me.
    Most importantly, are you sure about the comment "...and they'll pay any medical fees you had in the past"? I've worked in the insurance business for almost 30 years (Personal Lines, not health, but still) and have never heard of a consumer insurance policy that provides coverage before the policy term. <I am almost certain that in order for her to be covered on her husband's policy, she needs to be a resident of the US. Her presence here as a tourist won't allow her to be covered>. Maybe you can show me I am wrong. OP, if you get this far, do a lot of homework.
    I also have experience with children (fourth on the way) and it's expensive. What you are suggesting could potentially be financially ruinous.

    Agree. Nor is it sufficient to obtain the opportunity to immigrate to the US. Since you are married, you have to apply for a CR-1 visa. Suggest you understand why your K-1 application was rejected, so that you are prepared to move forward.

    Many skilled jobs go unfilled - do some digging and look for an employer that would be willing to train your husband (or help with his education), in return for work as an apprentice. And I really think the English skills are necessary and urgent. Education (in a trade is perfectly good) and English language skills are a key to advancing economically in the US.

    My wife took free ESL classes at a local community college for a year, until she qualified for instate tuition (we live in the SF Valley). Suggest your husband pursue his ESL and a trade school, and in the meantime look for work as others have suggested (e.g., maintenance, janitorial, etc. that won't require a lot of interaction. Although, why not Starbucks - he is a barrista. Aren't they offering education reimbursement?). Going to the local mosque and networking sounds like a great idea - anything to get him plugged in with daily life is good.

    I had the same issue purchasing a ticket for my wife to travel from Vietnam, after her visa was approved. The airline can validate everything - call them and explain the situation. In our case, my wife took the printed validation (I believe I sent a scanned copy of my passport to the airline, but can't remember) and everything was fine.

    Pretty much wait to be called from what my wife said....
    Turn in documents requested in IV, do biometrics and then wait for interview. Interview was less than 5min for my wife and asked a few basic questions and then she was approved.
    Really not a concern if sent a good packet in and everything is genuine.
    Wife was entertained by quite a few dodgy k1 applicants while she was waiting.

    I am sorry that your father is sick. However the only legal route open to you now is to have your spouse or yourself petition for your son. If the USC petitions it takes about a year. If you petition it takes much longer.

    What they should have explained is that as your spouse she qualifies for the waiver, but that the consulate typically will not grant the waiver but rather send it to "Washington".
    I have specific experience with the process, the waiver, etc. (not China, but similar as you can see from my background). You should have already prepared a dossier that explains in detail your wife's rationale for party membership (job related), the fact that she did not hold any sort of office, etc. We also provided documentation that showed the link between party membership and job promotion (with everything translated). We provided this at the time of the interview at the consulate, and it was forwarded to the Visa Services office with our case file. We spent about 4 months in AP. My wife quit the party and the job at the same time - perhaps coincidentally, perhaps not, the approval was granted shortly after we submitted this paperwork to Visa Services. I can't remember if we submitted this paperwork to the Consulate and then to Visa Services, or direct to Visa Services. At that point my wife had been in AP for about 3 months.
    We had an attorney with experience in these matters assist - I spent a lot of time on paperwork and at the end of the process I felt like I understood the process as well as the attorney. Nevertheless, his fee was worth what we paid in that we were prepared ahead of time for what to expect, and, with documentation to support the waiver request. That said, end to end it was almost 18 months.

    You don't get to circumvent the law simply because the kind of visa you need is currently taking longer to process than you were "told."
    As others have mentioned (and as you already know), it is fraud and your spouse can face lengthy bans from the country if she is caught. There are multiple steps along the way where she could be found out, including entry, AOS interview, and all the way up to (and after) citizenship.
    If she is asked about her marriage to you by CBP and she is honest, she might not even be allowed into the country unless she can demonstrate very strong ties to her home country.

    Visa on arrival is very easy to arrange over the internet, for Vietnam. You can purchase a single or multi-entry visa. Cost is something on the order of $150 (it's been a while and I don't remember exact price). I do remember it as being very easy and reliable.
    Cambodia has, I believe, a similar type of visa but you can easily verify on the internet. Others know better than me, for Cambodia.
