Canerican got a reaction from GOOOOOB in How long can you stay in the US on a K1 visa.
Here is your process once you have the visa in your passport and it is in hand:

    1. Enter the USA, when this happens CBP (US border patrol) will issue you an I-94 good for 90 days(now online, so you will not get a paper one)

    2. Get your SSN if you can before you marry, if not you will have to wait till you get your Employment Authorization

    3. Get your marriage certificate

    4. Get married within the 90 days on your I-94

    5. After marrying and receiving your marriage certificate, apply for I-485, adjustment of status, I-765, Employment authorization, and I-131, advanced parole, as soon as possible. Advanced parole is in case you want to travel while green card is in process (as mentioned, when you get your NOA1 for your I-485 you are in an authorized period of stay till a decision is made on your green card)

Hope this helps. If you have questions feel free to message me.

    Good Afternoon All,

I would like to proudly announce that my application was approved!!!! Here are the details of the appointment:

Once in the office the IO asked for my passport, DL, and GC. After she all my demographics such as address, phone number, etc. She then asked my wife's name as well as how many times I have been married. Then I had the tests of reading, writing, and civics.

For the reading I had to read off the tabet, "Who can vote?" and then the writing portion was "Citizens can vote." Then was the civics questions:
1.What was one war that we were involved in the 1800's?
2.What was one war that we were involved in 1900's?
    3.Who is the current president?
4.Why did the colonists fight the British?
5.What are the first 10 amendments to the Constitution?
6.Why does the flag have 50 stars?

The IO then went over the questions on the application and added the two dates that I traveled after applying for citizenship. The IO then put everything through the system and approved my applications. Once I got in my car and turned my phone back on I got a text that my status changed to "In line for Oath Ceremony"

I requested June 27, 2019 for my oath date as I have training for work the rest of this week and next.

As a side note, anyone doing their oath in Fort Myers, they do them on Tues and Thurs, mine will be a Thurs, but as I was waiting some people were coming into wait for their oath ceremony. ******As well when I walked in the office there was a sign on the door stating that I believe starting July 2019 that some cases will be transferred to Tampa and Jacksonville to lighten the load. Cannot remember which counties are being sent to which office though.******
Good luck to all those who are still waiting and congratulations to all those who have been approved.

    Hey there Rusk,

I understand your impatience, my now wife and I were there once. We started this journey March 14, 2012 and as my timeline shows, if you go to the link in my signature, it took a year and sixteen days from the day my K-1 was sent in to the day I crossed the border. My visa was approved and in hand in just under a year. Then for my I-485 Adjustment of Status I only had to wait five months but I got an interview waiver. Furthermore, when I applied for my I-751 it took exactly 10 months. Lastly, when I sent in my N-400 to naturalize and become a US citizen it took another 10 months. I say all this to say that this process will test your patience. You probably understand that most things such as how long it takes for the petition to get to Consulate, etc are out of your control. But I leave you with the serenity prayer:

God, grant me the serenity to accept the things I cannot change,
The courage to change the things that I can,
And the wisdom to know the difference.

Be patient and know that there are many other people going through the same trial as you. They all want to be with their fiances but are waiting to be approved as well. Visajourney is only a small portion of the people going through this process. Your time will come.
  8. Thanks

Well the first thing for me is how are you going to provide a divorce decree for a fake wife? The answer is you can’t, you may be able to go to the Jamaican govt and get a notarized document saying that you were never married from a notary public in Jamaica. They would have to look through marriage records I assume and attest to the fact you weren’t married. Lying to the USA Embassy is another kettle of fish. They could ban you for misrepresentation on a visa application. I suggest you read the following: https://www.uscis.gov/policymanual/HTML/PolicyManual-Volume8-PartJ-Chapter2.html. You have put yourself in a predicament by lying on a visa application. I hope you can figure things out and everything works out if you genuinely want to be with your US girlfriend. Hope what I posted helps you.  You could get a ban.

First we need to know how long you have been a PR for and how long you have been married for? The requirements to apply for US Citizenship are that you have been married to and living with your American spouse for 3 years and that you have at least been a PR for 3 years minus 90 days at the time you apply.

I would also suggest renewing your Canadian passport even if you are going to get US Citizenship.

Here are the numbers for the days he was out of the USA if I calculated them correctly:
    2012-126
    2013-241
    2014-100
    2015-99
    2016-184
In the last five years that totals 750 days outside of the USA. In the eligibility worksheet it says that you cannot be out of the USA for 30 months or more, which is 2.5 years, which when you translate it into days is 912.50 days. He is fine, but I would suggest he stays in the country until he gets citizenship as he is only 162.5 days from being ineligible for citizenship. If he goes for another 6 month trip before applying for citizenship he will be ineligible to apply for citizenship.
My calculations could be off by a day or two above.

Yes, welcome and good luck. And yes do relax as TBoneTX stated. I remember being in your shoes 3 years ago March of this year. My now wife and I filed the I-129F and waited for approval. I had work and other things to preoccupy my time as you can tell from my signature that the visa took a little bit. My one advice is to relax when you can and then when you need to remember to be prepared and organized, but for now sit tight and wait for the approval. I can tell you from experience that it does cause anxiety when you are gathering evidence, etc, but with that it will cause anxiety in your relationship which is also not the best. As said before relax and stay occupied.

    1. When the instructions talk about filing your EAD or AP alone it means that you can file them alone after filing your AOS. Due to the fact that you had not filed AOS that disqualified you for an EAD and AP. You might ask, well it says that I can apply for an EAD when I enter the USA. That EAD is only for 90 days and expires when your I-94 expires and has a price tag. It takes about 70-90 days to get the EAD approved thus it is a waste of money.
    2. If you had filed your AOS before applying for the EAD it would have been code c(9) and would have cost nothing due the pending AOS.
    3. Now that it is over a year since you entered the USA ,I believe, that you now have to fill out and file the I-130,I-485 (AOS), I-765 (EAD), I-131 (AP) concurrently and get a new medical done. If someone else could respond definitively on this that would be great.
I'm sorry to hear about your situation.

If your sister is getting a visitor visa, the Consular Officer (CO) is going to base everything on whether or not she has sufficient ties to her country. Nothing you say or do will help at the interview, it may actually hurt it even though she has a priority date.

OP, please keep in mind for next time to be specific as to whether or not your fiancee entered on a K-1 or entered without a visa. As was mentioned above if he entered with a visa (K-1) the border patrol should have done an electronic I-94. If this is the case go to your closest deferred inspection site to get this fixed. I am a Canadian and entered on a K-1 and had record of an I-94 and a stamp by my visa. If he did not come with a visa just put as was mentioned "none-Canadian Visitor"
