Co-Sponsor Didn't file Taxes for 2024 due to financial reasons. Will this give us trouble..

Hi all, 

Our co-sponsor wasn't able to file taxes for the current tax year due to financial reasons. Would using her as a Co-sponsor be an issue?

 

I'm not sure if they would find her illegible to help sponsor, even though she's filed all previous tax years.

 

Anyone have thoughts on this?

Yes, very likely it's going to be an issue.

Yes this will be a problem - USCIS requires copies of the most recent tax year's returns or Tax Return Transcript. This is mandatory. Prior year's returns/transcripts are optional. 

 

Item Numbers 15. - 19. Federal Income Tax Return Information. You must provide either an Internal Revenue Service (IRS) transcript or a photocopy from your own records of your Federal individual income tax return for the most recent tax year, counting from the date of signing Form I-864. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your Federal individual income tax returns for the three most recent years.

I agree with @OldUser and @Edward and Jaycel. You must have filed for most recent tax year, if required (and the two previous, if required) to qualify as a sponsor.

The bigger question is - if she could not afford to file (not too expensive), then how can she afford to sponsor someone?

I don’t think this is a good excuse not to file taxes or file for an extension. Taxes can be filed late with a penalty, but not filing them at all is asking for trouble

What do you mean financial reasons?  The IRS sponsors thousands of locations in the US where they file taxes for free using volunteers. It's called the IRS VITA program.  All you do is go into their website and find a VITA location.
