Hello everyone, 

 

I need your help. I bring my wife here in America and she got the conditional green card. we have 2 kids. On December 2024, we go back home and we divorced there because we got married in our country(Africa). After that I came back to the US and she stay there with our 6 months son and 2 years daughter. But in one week after I return to the US, I heard that she is back somewhere in America and she left the kids in Africa somewhere. 

Now she want to renew her Green card because on September 2025 will be 2 years since she got it. My questions are: 

1) Do I need to send the Certificate of divorce to the immigration? if yes where and how? Because someone told me if I don't send the certificate of divorce then she can say that we are just separated ( we have certificated of divorce from our country )

2) Can she renew her Green Card without me?

1) Nothing you need to do unless you have solid proof she committed immigration fraud.

2) Yes, she can try with a divorce waiver.  I assume she has a copy of it.

Copy of what? the divorce certificate? if yes then she doesn't have a copy of it

She can get one no doubt.

 

She will need one to remove conditions

She is on her own regarding immigration, but yes, she can remove conditions without you.   Nothing for you to do.  However, be aware that you are still obligated under the I-864 you signed.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I am obligated under the I-864 to do what?  you mean to support her or?

To reimburse the government if she uses public funds. You are obligated until she becomes a US citizen, loses her status a a Green Card holder, has accrued 40 quarters of credited work, or dies......

She is still on her own, and she can remove conditions (renew her Green Card) under some conditions.   What do you mean by "In case we are not really divorced..."?

Are you saying the divorce is not legally accepted in the US?  I am confused.

In muslim way , i can just tell my wife that i am divorcing to you. so if we need the certificate divorce so we can go to do it. so I didn't do anything yet but I am assuming that she is living with someone else somewhere in America. The most important i don't want to be with her anymore.
