This certainly seems to outside the scope of a DIY case.  The possibility of 4 months in jail is significant, imho.

It was not terror threats. The second link you are referring to came to law about 1 and a half year after my latest crimes, and 2 and a half year of my first 2 crimes against the journalists. The evidence isn't 100 percent either. So If I get acquitted there should not be a problem, otherwise I would like to see some sort of proof of that. But those links does not really tell me anything so far. I've heard people with 6 month sentences getting visa. 

Also, third link? What has that even to do with my case I am asking about? I was not spying LAMO. 

So, u r not talking (as u say) as 1st offense / u r talking about a continuous series of unlawful behavior

all of which show this behavior would threaten the US 

 

And u say living in Sweden not i am a Swedish citizen which ,  itself should be noted as if u r just a resident there ,  u committed these acts in a foreign country and could do the same in the US ,  if allowed in.

But, again, I get selected, should I just write on the DS-260 that the case is currently pending, because of an appeal? So they know it when I will have my interview? I will probably go for an B2 Visa anyway. But since the 260 needs to be filled out I would like to know what to put in the crime section, because the results comes out in soon 1 week and my appeal is 1 month after. So what can I write there since I yet don't know the full outcome of the sentence? 

it asks "have u ever been arrested........."   u have so u say "yes"

that includes any and all arrests ,  convictions and prison time

it is for a US visa

I knew all this sounded familiar... We went through this whole exercise with OP last year, and then they did not take these crimes very seriously either and even considered lying about them:

If you do take it seriously, then please stop minimizing your actions by saying that the crimes were not a big deal and were not serious.   I think you have received excellent advice today and also a year ago.  Apply and if it gets approved, seek an immigration attorney who specializes in arrests.

Given you've had a year to digest what people had suggested and still seem to want to minimalize the seriousness of your crimes, I'd suspect there's a high likelihood that you wouldn't get past the interview stage.  Immigration is a PRIVILEDGE and you don't seem to take that seriously. 

 

Repeated encounters with the police were just the beginning of your issues.  It indicates a pattern.  Then, the charges against you - you don't think they are that serious but the US takes uttering any type of threat extremely seriously.  You claim you uttered a threat to a police officer during a traffic stop.  Entire US high schools get locked down and put under heavy police presence and the perpetrator arrested for uttering what someone deems an "innocent" threat.  It 100% is a big deal and is taken seriously.   

 

Find an attorney and possibly even a therapist to work on your anger issues.  Clearly something needs to be done to calm yourself down and manage your issues with authority.  At least that would possibly demonstrate acceptance for your behaviors and a seriousness for stopping the repeat pattern.

It means "not guilty" only as it pertains to (Swedish) criminal law.

@FONA, you can answer no to all the questions.  If you interpret the resolution to mean “acquitted = never arrested.”  Sure, i will give you that point. 

 

Everyone applying for a visa at the consulate has to supply a police report.  Everyone.  
 

What will your police report say if you are completely acquitted? Will it still note the arrest?

 

It is up to the officer.  They may approve you or most likely look into what the arrests were for.  If they do, you will be ruled inadmissible.  Or they simply sit on your case and the visa allocation runs out, making your lottery win useless.

According to US law as well. If you are acquitted, you are NOT guilty.

I will answer YES and be truthful. Because they will find out through screening anyways. I am not a lier. 

 

Why will you give me that point? Acquitted does not mean you have never been arrested if you now were arrested. Acquitted means you are not guilty of those crimes you got convicted for in the court if your appeal proves otherwise. 

 

I don't really know about Swedish police reports... what it will say about anything if I get acquitted. 

 

How do you know I will be inadmissible? It isn't felonies. Do they just reject people because of small misdemeanors?

You're minimising it again. If they were 'small misdemeanours' you wouldn't be facing 4 months in jail.

 

Whether they're felonies or not doesn't matter. Most CIMT's aren't felonies, but they can still mean people are inadmissible (or deportable even with a green card, as per the document I linked to above). 

 

Bottom line is none of us know for sure if you'd be admissible or not, we're only guessing - you need to consult a good lawyer.
