Help a +18 Artist Getting a K-1 Visa?

Hey everyone. Thanks for the attention, first of all.

Secondly, obviously I won't be going into details about any of what I do. But, you know, like the title implies there will be mentions of +18 topics so please keep that in mind if it makes you uncomfortable.

---

With that being said:

I'm in a bit of a situation here!

Me and my fiancée have been in the process of filing for a K-1 for quite some time now.

We have received the NOA2 and are on the process of preparing for the interview process. However, I have been having some issues filing the DS-160.

See, I work with providing Adult-Oriented Commissioned Digital Artwork. Pornography. Straight up no ifs or buts. VERY kinky at that.

For the last couple of days I have been having trouble figuring out if that would be an issue during the interview process.

I know I need to inform the Consulate of my main source of income, and this is it! I draw. But I have no clue if this is something that would be considered undesirable for the interview process. Or even downright illegal, I have been having a lot of trouble determining where the U.S stands when it comes to pornographic digital artwork being illegal.

I am going to provide them with my socials (which will be damn awkward I am sure) but what can I do? I use Twitter to advertise myself, I need to give them my Twitter profile both for the sake of it being a social platform I use and also part of what makes my job work.

At least, that is what I think I need to do...

Frankly, I wouldn't really know what to do in case it is something that will get me denied from the Visa. Because this is what I do for a living, there is no way around that. And I don't think lying will get me anywhere.

I think I am just asking to know what I should be prepared to listen from the consulate?

Is it okay to inform them what I do for a living in this case?

I'm still fairly new to all of this, but if there is one thing I've learned from everyone here on VJ, it's to be completely honest. As far as I know you're not doing anything illegal and it's how you make your living, so there's no way to avoid it. I think your best bet is to be completely open and honest about it, and if someone is uncomfortable about the images, that's on them! Good luck!!

Yeah, I get you... The thing is that I REALLY want this, you know? I really want to be with my fiancée and I just get very anxious at the thought that I am doing something wrong.

I just can't seem to find any certainty on the legality of it, but if it is legal, then I will continue to press on

Thank you again, hoping you have a good day!

You’re asking us if the images you create are legal?

Yes, as well. I have no idea what the U.S law's stance on pornography is. Specially when it's more specifically about artwork like what I do.

And not only that but I also just want to know if it is the kind of thing that would be okay to bring up in the interview process, you know

Since u r coming on   a K1,  your work and income are not important for the interview

the income of the USC is what is looked at

U will not be able to continue your present  digital photography or do any other type of work in the US until the AOS process is complete and u have a EAD or 2 year green card to work

Yeah, not sure why you don't just, as others have said, state your career/employment as "artist" or "digital creator" (for example). I certainly would NOT, if I was you, bring graphic samples of the work to the interview in any sense...some may disagree, but I certainly wouldn't want to get into a constitutional/moral argument during the interview process with a CO who may or may not be "offended" by the work, as it is just not worth the gamble. That said, if asked what type of work you do, say what you do: "artist." If asked what type of art, just be honest: "adult content for 18+" for example.

Also, you will have to discontinue your paid work until you receive your work authorization, which will give you time to study the rules/laws regarding the distribution of adult content in the United States.

Why a K1?

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

Depends entirely on the nature and subject of the images, but I think you know that.

K-1 isn’t a great option for you because you will not be able to work for up to 8 months when you arrive.

In the US, creating images that some consider obscene or pornography, is completely legal and is protected by the 1st Amendment of the Constitution.  There are numerous court cases that confirm this, including the US Supreme Court.  A simple Google search will put your mind at ease about this.  Child pornography is illegal in the US and could get you in big trouble after you arrive, or could cause a denial of your K-1 visa.  If none of your digital images depict children you should be fine.  I suggest that you describe your work/career as a "digital art creator."  The officer doing the interview in Rio will most likely not even ask you about it.  They will be more concerned about the circumstances of how you met, how many times you have been together in person, ability of your petitioner to financially sponsor you, and your past US immigration/non-immigration visa applications/history, if any.

Gotcha!

Ok yeah, ALL images are always +18 I have never done anything with children... I think this is a safe enough space to say I find that disgusting lol

Do you think I should even mention like... My Twitter? Because I was under the impression they would want to know my socials as well!

That I also do realize! Thanks for the heads up, though.

I have no intention to work on the US until I am allowed to do such

OH Gods, yes totally agree.

I had no intention of bringing work examples into the interview or anything like that. I mostly was (and still am) just confused about the possibility of needing to provide my social media accounts I used for that business on the DS-160 or if I can just leave it out and just put my personal social media which has none of that.

Basically, I have a Twitter which I use professionally and I have a Facebook which is very much just a me thing that maybe 5 other people know exist haha

I am still a tad bit unsure if the Consulate will want to know about my Twitter and possibly investigate it or if I can just inform them that I am an "Artist", "Digital Creator" and just mention (if prompted) that it is Adult Content?

Depends whether this question is mandatory or optional. For example, from what I learned recently, it's optional when getting ESTA. Not sure about visa.
