Travel History after getting DQ [merged threads]

Hi all, 

 

I needed suggestions regarding my on-going CR1 visa case. 

 

Details about the case:
Priority date - 15th September 2022
NVC DQ date - 25th September 2023

 

As per the above dates, we are expecting an interview from Mumbai Embassy around Feb 2024. I have a travel history in US and wanted to ask if anyone has been through a similar situation. 

 

I live in India and I had US tourist visa so sometime after our marriage, I decided to visit my husband in US (who is a US citizen). I stayed for 6 months (Jan 2023 - Jun 2023). After our case got DQed by NVC, the expected interview was too late as the estimated time was 4-5 months at the least. I did not want to stay away from my husband for that long so I again visited US in late Oct 2023. The immigration officer did give me an entry, but warned me to not use tourist visa casually next time and that I should return back to India after the holidays and not stay for 6 months again. 

My question is, will this travel history affect my interview at Mumbai for CR1 visa? I understand I have used my tourist visa frequently but I hope that just proves that I wanted to spend time with my husband. I am planning on returning back in Jan 3rd week (or earlier if I get any update about IL till then). 

 

Did anybody over here go through a similar situation (travel to spouse after being DQed by NVC?) If so, what was the interview experience, are any additional proofs required? Any help/suggestion is most welcome.

For CR-1, you'll be fine as long as you didn't overstay.

 

For January 2024 visit, you need to be careful. How long ago was your last departure from the US? You got already flagged for long visit. If you come too soon, you may get denied entry. Make sure not to misrepresent yourself, this would become an issue for CR-1.

You'll be fine, as long as you leave on time and don't use tourist visa to come back again. Just come back on CR-1, hopefully you'll get it soon?

Interview Date - 16th January 2024

DQ date - 25th September 2023

 

I am an Indian Citizen and my husband is US citizen. My interview is in January. I visited him to US on tourist visa this October. I am still in US and I plan to go back to India in December end to complete my medical exam. 

 

Since I visited US after getting DQ, I was not able to update my travel date of US. Can I do it now? 

 

Can I get an updated DS-260 confirmation number?

 

How do I let NVC/Embassy know that I visited US after DQ and that DS-260 needs one more update?

You can update the DS260 in the day of the interview

And it is okay to schedule my biometric OFC appointment at location other than VAC centre?

 

My OFC appointment is in Hyderabad since no slots were available in Mumbai.

My CR-1 interview is in Mumbai. 

 

Also while scheduling biometric OFC appointment, I was not asked for fees. I am scared if I am following the correct procedures.

Schedule medical exam only at an authorized place.  If it's authorized, and not in Mumbai, it's OK.  You have an official list of options, right?

Yeah, my medical is scheduled at an authorized place. 

 

I had a question regarding my biometrics. It is in Hyderabad VAC. While booking the appointment, I wasn't asked to pay fees. 

 

Do I need to collect any documents from the OFC appointment? Because I added my home address for the document delivery.

Hi, 

 

I made a visit to the US after I had submitted my DS-260 form. I had approached us-visa-scheduling regarding the same and they opened DS-260 form for me to edit. 

 

Question - will my Ds-260 confirmation number change?

 

I have taken an OFC biometric appointment with the earlier conformation number. If changing DS-260 changes the confirmation number, can I edit my OFC appointment, since it has barcode with DS-260?

 

If that's the case (change in confirmation number) and I am not able to get a new appointment immediately, can I change my DS-260 after the OFC biometric and before the interview?

 

Any help/idea/suggestion is appreciated.

Honestly, I would not deal with jumping through hoops trying to change the DS260.  I would just document any changes and make those with the CO at the interview.
