Hi
I'm Alec, a 28 year old dual citizen (Danish and American). I've been living in Denmark my whole life and met my girlfriend who is a Korean a year ago. I am working in my own company in Denmark and I've never worked in the US.

Me and my girlfriend are planning to move together and want to live in the US as the process of getting a Visa is much easier in the US compared to Denmark. We want to apply for the K1 Visa so she can move together with me to the US. 
I think the main problem is that I haven't been living in the US at all. Could that affect our K1 application? Is there anything we need to be careful about?

Furthermore, can I apply for the K1 visa on my girlfriends behalf here in Denmark? Or do I have to go to the US to apply?

Get married and file for spousal visa. That one you can file online.

In the meantime sort out issues with the US: voter registration, taxes, domicile and similar as that will be needed come interview time.

You beat me to it, why would you want to go the K1 route when you are living together?

You could do the online Utah marriage and then go see her in Korea or she visits you in Denmark to satisfy the requirement of consummation of marriage and then file.

K1 is less than ideal but if it is impractical to marry in the near future may be your only option.

I see so many problems with this but your first stop is the guides here for K1 and CR1 visas. Do you have a US passport? I can’t imagine how hard it’s going to be for you if you’ve never even lived in the US before.

This is one of those situations which might warrant the US citizen locating to the US first.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Moving to US first makes perfect sense. I imagine it would be he hard to figure things out for two newbies, unless you have family here that can help you in the beginning. 

4/12/13 - sent I-485 package

4/15/13 - USCIS Chicago Lockbox received package

4/22/13 - got email and txt

4/29/13 - received NOA in mail

5/08/13 - received biometrics appointment for 5/22

5/09/13 - successful early walk in at Port Chester, NY office

5/22/13 - I-485 updated to Testing & Interview

6/18/13 - EAD went to production

6/21/13 - Card/Document Production for EAD - second email

6/24/13 - EAD mailed

6/26/13 - EAD arrived

7/18/13 - got email about interview

7/20/13 - got hard copy interview letter

08/23/13 - interview - Approved dancin5hr.gif(card production & decision email)

08/28/13 - card production - second email

08/29/13 - card mailed

09/03/13 - card arrived

05/27/2016 - N-400 mailed

06/02/2016 - NOA date

06/24/2016 - biometrics appointment

11/28/2016 - interview scheduled for January 9th, 2017

Marriage in the near future is possible.

 

I have family in the US both in Florida and Texas. I have visited a couple of times so I wouldn’t be a total newcomer. But as I said I have never lived or worked in the US.

 

For how long do you think I would need to have lived in the US before we can file a strong application?

Assuming you are going to marry first file as soon as you have, plenty of time to sort out the other stuff.

How were you planning to sponsor the fiancé?

 

You need to move to the US, establish domicile, get a job etc.

I would question your assumption that it is easier to get a US visa than a Danish visa, at least if you're planning to marry anyway. Once you are married the Danish family reunification visa for a spouse will almost certainly be faster than the K1 / CR-1 process, and probably less complicated overall since you will be in an environment where you are already established with stable income, housing etc.
