I am a Nigerian marrying a USA woman but I ever since I arrived here it has been from one verbal abuse to the other..But the worst happened on the 17 of February the day she physically pushed me out of our house, with no clothes neither do I have my vital documents which include my passport, certificates

,permanent resident card, debit credit card, and no phone for contact,

I invited the police but they said they could not do anything except  if I can obtain a warrant of arrest because of the physical abuse and threat to my life.I have called domestic violent hot line and I am waiting to consult with the local offices of the resource persons on domestic violent on Monday for legal aid.

please,I want to be properly advised on what to do since she is threatening me with deportation and she boasted to my younger brother that she has burnt my green card and my Nigerian passport.I want to know what my options are going forward.
I have limited funds to pursue the case as I just came back from burning my mum two weeks ago.

The officer should have escorted you to the house to collect your belongings. It's possible he or you didn't know what help you needed.

You have your passport and your debit card, not sure what your certificate of permanent resident card is? Do you mean your Green Card? If so she can't do anything unless she has real proof you scammed her, not just being a petty verdictive person. Do you have your social security number too? If so get a job if you don't already have one and move on with your life. That is the best revenge, when the abusive person realizes they can't scare you anymore.

Sympathies for the loss of your mother.

That's very strange regarding what the police said; normally, they'll accompany you in retrieving your things.

Check your state's laws to learn your rights about being locked out of your house.

If your wife burned your green card, it sounds like a Federal crime.  Report it.

Monday is a holiday here (Presidents' Day), which hopefully won't affect your consultation with legal aid.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

I interpreted this to mean empty-handed.  Correct?

I meant that  my personal belongings including my international passport permanent resident card, ,bank cards, different certificates from previous institutions I have attended are all in her possession. From a call to my bank shows that  she used $152 to purchase tems from Walmart using my debit card.

I have my social security number by heart.

Thanks

Thanks very much.I am in Alabama,I guess the police could not do anything because I am an immigrant.I was very much surprised that I could not get help from them.

Ok first thing first empty that account and open another. You can't cancel her card to that account but you can drain it low.

Next ask to get a police escort to get your belongings. If she did indeed burn them you can have the officer file charges on her. Use that report to get a new card and passport. Then you fill out the forms to get the card replaced. I'm very sorry you have to go through this and very sorry for the loss of your mother.

Thanks very much, She used my card to do the purchase because she knows my PIN code.I have called the bank to put a temporary lock on the debit and credit cards.I do not know how the law works here but they said it is a civil case except for the threat to life and destruction of my belongings.

Destruction of a green card might be a Federal crime.  Ask your police.

If the first policeman you talk to won't help you, politely keep asking for supervisors until one helps you.

Thank you very much.I will do that tomorrow,The Good Samaritan that harbored me has volunteered to speak to  her too.

Tell the police straight that she locked you out and keeps your belongings hostage. Say you need help to retrieve your property. They very much can help you with this. When you first asked it might wasn't clear that you don't have your belongings. While the police is there with you check if everything is there. If property was destroyed have the police write it down so that you can file a police report and it won't be a he say- she say thing.

Do not approach her alone.

Police came to the scene, and there has been a number assigned to the case, the officer said he needed warrant to get her arrested but it was already late and it was on a Friday evening.I am doing my best.I was honestly frustrated when he said they could not do anything for me to retrieve what rightfully belonged to me.
