Your most recent tax return would be 2021.  Is that the one they have? Did you also list and document liquid assets?

The notice you got would be sent even if you had a million bucks in the bank.  If you are confident you qualify based on your 2021 tax return and your savings, simply ignore the message.

Hi. I also received this notice stating that my income doesn’t meet the minimum requirement, but according to the Poverty guideline chart my income is adequately above the cut off value. And they are asking me to submit a joint sponsor even though my father, household member is adding his supporting income. What do I do in that case? Appreciate any input!

Hi everyone,

So, after 12 days my ceac account has updated, at least in most of the part. I got two FE review messages, one says that the case does not meet the minimum income requirement, the second asks for my(petitioner) proof of income, even though I'm pretty sure I wrote that it's 0 when completing the I-864 form. I've read some topics on the forum and I was thinking that I will probably need to upload a written statement under proof of current or self-employment category, that my income is completely foreign-based, so I don't have any proof of income to provide, is there anything else I can do?

The other problem is that all but two of my joint-sponsor's documents say Accepted. The first is her's I-864 form and the other is proof of US citizenship. Every other document says accepted, there is also no message about them from after the review, so I don't know if this is because of CEAC website issues or for some other reason. I was convinced that there should be no documents with 'Submitted' status after the review.

Hi, I’m also in a similar situation. I don’t have an income and therefore I didn’t file taxes as I was a full time student financially dependent on my parents. When you submitted your documents, what did you select under the federal income tax return tab? Did you select document not available? Because next to mine it says missing and I’m unsure what to upload. My father is my household member who’s helping me meet the minimum income requirement for my husbands sponsorship. I uploaded a statement and documentation of my degree proving that I was a full time student and not earning. It says approved next to those documents, but says missing next to my Fed Inclme Tax Return. Appreciate any help!

First what category you are filling the 130 petition for F1 , F2 , F3 or F4?

I am filing for my husband, CR-1. I am a full time student, therefore I have not filed taxes, since I was financially dependent on my parents. My father is a household member and is using his income for financial support. He submitted his tax transcripts for the past 3 years. And the income for each year is well above poverty guideline yet I still received this message. I have not been DQ’d.

i think you need a joint sponsor in that case but you can creat a new topic so your topic can be visible in top of list and people with experience can guide you through it, best of luck!

Hi, I am sponsoring my husband for CR-1. I was a full time medical student and therefore not filing taxes as I was not earning. My father is my household member and helping me meet the min income requirement for sponsorship. His income for the past 3 years is above the poverty guideline according to our household size yet NVC still messaged saying it does not meet the requirement for this case. He submitted tax transcripts for the past 3 years as well. They also requested his evidence of income. What do I send in that case? Why is NVC saying we don’t meet income requirement even tho we do. As he is self employed, and renting out his business as well as some property.

If you were not obligated to file tax return because e.g. you didn't earn enough(around $12000), then you write a statement that you were not obligated to file for the last 3 years this condition applies. I was filling all previous three years, except for 2019 where I didn't earn enough to file and that's what I did, I wrote a statement and uploaded it under 'Explanation for not filing taxes' category. As for the evidence of income RFE that I got - I sent them a statement that I don't have evidence to provide since all my income is from outside the US and I'm not using it to sponsor my spouse. Additonally, in the same pdf, I added the most recent invoice for my services, plus a bank transfer confirmation that covers that invoice. Of course I emphasized, that it's not being used to sponsor my wife, not to confuse them too much. I hope I cleared the situation a little bit for you.

Yes that’s exactly what I did. I submitted a statement explaining why I did not file taxes for the previous 3 years, but what document do I upload under the AOS category where it says Federal Income tax, do I just select document unavailable? Because currently after the FE messages from NVC it says ‘missing’ next to to my federal income tax return. Even tho below, I have attached documentation for why I’m not filing. I hope this is making sense! 🥴

In your situation, I would have recommended your father act as joint sponsor, not household member, but read that message again, or quote it here.  There's a difference between "suggesting" you may want to do something and actually "asking" you to do something.  Messages that use the terms "may" and "Consular Officer will decide" are not requests.  They are suggestions.

When I originally uploaded my documents, I gave an explanation with documentation on why I was not required to file taxes. But now under AOS field, it says my federal income tax return is missing. What do I do? Since I don’t have a tax return because I was not earning and not required to file what do I select there?

Hello, this forum has been really helpful to me and I’ve gained a lot of info regarding the whole immigration process. Any further help would be much appreciated!
I am the petitioner sponsoring my husband on CR-1 visa, I have 0 income as I am a full time med student, my father is a household member who’s income we are using to meet the min requirement. My father and I are both US citizens.
NVC is asking proof of relationship between my father and I as household member. What document can I submit for that? I submitted a document of my country’s (Pakistan) Identity card (NICOP)  which has him listed as my father, and we had the same residence address but they rejected it. I think maybe because it wasn’t a US based document?
Any guidance and help would be great!

First, since you have zero income to combine with your father, he should be your joint sponsor, not your household member.  Yes, really.  Yes, I'm sure.

Replace both your form and  your fathers with yours not mentioning your father at all, and his as a joint sponsor.  If your father is married, his spouse should submit an I-854a as HIS household member, even if they have no income.  This is the proper way, and will dismiss the issue of your relationship.

Note that you would have to submit not only evidence of relationship but evidence you live in the same household, but still WRONG way to do it.
