Upgrade from permanent resident to Citizen [merged threads]

Hello beautiful people, 

I have filed for spouse visa for my wife last June, I am green card holder now, but I have an appointment by the end of October to become citizen, 

After I get my citizenship,  how to change from status of green card holder onto citizen?

And is the time consumed from June to now will make the witing time shorter or no effect? (Knowing that usually it takes 2 years for resident, and just 1 years for citizens)

It will change automatically to IR/CR1   as USCIS updates your status 

It will not reduce the processing time, however some consulates may prioritize interviews of USC spouse visas over LPR spouse visas.. so it may be a little faster to get the interview date after the NVC process is finished. Or not … 

 

Do you have any  minor children who are derivatives in your spouses visa application ? IR1 does not allow derivatives so the change to IR1 for your spouse means that any derivatives must now have their own I130 filed after you become a USC. Delaying the Oath ceremony until after the spouse and children enter the US can be simpler

So you mean it would have been better if I waited until I got the citizenship to file for her? Or I did better when I filed as a green card holder?

(We don't have children yet)

Only need to consider waiting if you have children. Go for your interview and oath. All good

In June I applied for my wife to bring her to the US, and now I just got my citizenship, I called the USCIS to change my status but the lady said that she doesn't know the effect of the upgrade if it gonna make the decision faster or longer. And when I logged in to my account I found processing time 7 months but the lady said it's 2 years.

What do advice me guys?

The overall process will take close to two years.   The petition approval is only one part of the process.

CR1/IR1 will always have precedence over F2A, there is no scenario I can think of in which upgrading the petition is a bad idea - not that you actually have an option , you have to make the change when you become a citizen. I can think of situations in which not upgrading is a bad idea, including the possibility that F2A retrogresses priority dates.

 

 

edit: the embassy in Algeria also explicitly notes it prioritizes immediate relative cases  https://dz.usembassy.gov/visas/immigrant-visas/

Well, let’s look at this logically. Will it really be 2 years? Once the petition is approved, it goes to NVC. Current NVC time frames are (1) one month for case creation and (2) about 3 weeks for document review (see https://travel.state.gov/content/travel/en/us-visas/immigrate/nvc-timeframes.html ) So if OP has all his ducks in a row with documents ready to go etc , that takes him to about 9 months from filing if uscis is indeed 7 months.  Then it depends on how long the queue for interview at the embassy.  Is Algeria really 1 year 3 months to get an interview from DQ?

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Who knows.   Perhaps it is, but I haven’t seen reports of anyone getting visas in 7 months from filing.

Hello beautiful people,

I filed for my spouse on June 6, 22

Got my citizenship on Oct 27, 22

Called USCIS to update my spouse's status from wife of resident to wife of citizen on Nov 1, 22

They sent me a letter on Dec 1, 22 asking me to send a copy of my citizenship certificate and a letter to demand the update of status.

My certificate I send it for passport, and I don't have a copy until now they didn't send it back.

On my USCIS account they say processing time 5 months.

My question is:

1- is this gonna delay the process?

2- are they gonna consider the time from June till now?

3- can we apply for a visit visa for her meanwhile so if they make any delay we have a back up plan? If yes what type of visa should we apply for?

Any children in the petition?

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.
