Regular AP in Montreal is about 8 weeks or it was give or take. DS5535 has been a deep hole and most only get out with the WOM. It's a sad place for Canada these days. 

 It was AP with DS5535. 

Topic of WOM comes up so frequently in this forum and many members have their case expedited after filing one. It's frustrating, because there's no where to know how many actual cases of AP with DS5535 there are through Montreal and timeline for resolution other than the information fathered via this forum. 

 

Many members have commented that reaching out to local congress representatives is useless. I have been in contact with mine and they have advised against filing DOM for now, as they are seeing progress with my case. They mentioned that my case is uncommon and they have helped many people that have been in same situation as me (IR1 visa, healthcare professional with American children <4 and American spouse) I have e-mailed Montreal consulate multiple times and they have responded each time within a week. My status have been updated 5-6 times, with some took place at the beginning of this 110 wait and 3 within the two weeks (last being July 31). 

 

I have consulted Goldstein and they did advised that I can proceed at 80ish days-wait given the context of my case. But they also gave me a timeline of 3-4 months wait to hear back after I file with them. I can't help but to question whether or not it's a money grab from lawyers if they know that it'll be resolved soon. 

 

like... how often does Montreal not meet the WOM deadline?

They can file for extensions, and sometimes they do. 

 

Also if you look at DV stats, you can glean a lot of information about 221g at Montreal. The DV sites are a goldmine for this kind of data.

and am I seeing this right? Only ~61% approval rate after extensive checks? I thought it'll be higher than that!

I believe all DS-5535 goes to through same waitlist at DOS, regardless of Embassy/Consulate. So in my opinion, I think it would be more valuable to open this up to all other countries besides Montreal.

I have been trying to make another forum for U.S. Citizens going through the DS-5535 process with their family members in the Middle East but am uncertain how to go about doing that. This forum here has alot of notoriety and Im not sure if I created such a forum if it would reach the same lengths or if people would care.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

How are people who submitted their DS5355 in Feb/Mar 2023 doing right now?

 

I don't have any word yet (a few updates but I'm thinking it was someone opening my file when I emailed asking about progress). Curious to see if anyone has been given any kind of notices without having filed a WOM. Stay strong!

In the same boat since March. We did file a WOM in June so were still waiting on movement with that.

The other plaintiff in the suit can’t compel interview - it’s a different claim from the government’s duty to adjudicate an application, and extremely difficult to win on as there are too many factors involved. 

Thanks for clearing that up. Seems like some people in the 2022 WOM group recieved motions to dismiss but ended up having their visa's adjudicated in the end,don't see much info on here regarding those cases unfortunately.
