  2. Congratulations @Tikitch! I had to send in the email requesting my passport, the courier slip and updated passport photos (they are only valid 6 months from date taken) and as an added measure I sent in an updated police background certificate as others were asked for that. I wasn't, but didn't want to give them any excuse to turn around and have to ask for additional things delaying the process even further.
  3. Hi @SGtoMurica, the group I was referencing in that post is inactive now as we have all been issued our visas. That group was formed back in early 2022 when there was a large number of us all filing WOM's at the same time. Agreed. @Admitt @APRIL2023 So many of us had Congress person support and it made no difference, and @throwitawayis correct, the senators and congresspeople's offices all get the same responses we do, despite the various legitimate and proven hardships (medical, pregnancy, separation from children, school admission deadline for children), they don't have jurisdiction over the DHS which is who has your DS-5535 file. No idea if the consulate feels any pressure on the back end by these requests, anecdotal data from this thread shows that they make no difference whatsoever - but we were all in your shoes and it's worth it to try everything you have at your disposal. If anything, if more and more senators and congresspeople keep getting these requests, perhaps they will actually do something about the broken system for legitimate and legal immigration.
  5. You can only contact them via email : Montreal-IV-DV@state.gov And you will never know why you were placed in DS-5535 which is one of the most frustrating parts of being in this situation. If you are just in regular AP, you know why - missing or incorrect documents.

If you have been in DS-5535 AP for 2 years I would 100% retain a lawyer and file a WOM - read about the process here: https://immigrationlawyerslosangeles.com/los-angeles-writ-of-mandamus-lawyer/ There are many litigators out there that do them and they are all mentioned in this thread. We used Goldstein and despite some other reviews on this site about him, we had a good experience and I was issued my visa within 93 days of filing the suit after waiting 7.5 months in DS-5535 with no action from the consulate despite clear examples of hardship and Senator inquires.   7. Yes, there were a few (I think 3 or 4) people in our group of WOM filers last year that had "motion to dismiss cases". The good news is they all received their visas in the end, and not with significant delay. As @throwitaway mentions, if you have a good lawyer, this will not be the first time they have seen this and will know what to do. I know it's hard, but try to stay positive.

  9. That series of changes all took place the week before it was issued. I believe it was two or three days when it read refused and the next day it was "issued". It's been a while now, so can't remember exactly, and it's likely different for every case, but rest assured, the end is near!!
  10. It will likely show "refused" or even switch to "administrative processing" and then back to "refused" right before they issue it. This is what happened to me. It's a roller coaster for sure. The updates are a really good sign, something is happening. A few more weeks and you should be there!

For me personally, it took 95 days from file to case closed. It generally takes 2 weeks from signing on with a lawyer for them to prepare your WOM and file it with the court. Hope this helps. Wish I had filed a lot sooner. we waited for 7 months in DS-5535. If I could do it all over again, I would have filed at 90 days. Good luck to you!
  13. No, not everyone gets a confirmation. I believe very few of us did. I personally didn't, and I emailed them to confirm and 3 weeks later I received a response that they had gotten it.
  14. Assuming you are in DS-5535 processing, they will send instructions to redo his medical once they intend to approve the visa. Typically once they receive the new medical, it is 3-4 weeks until the passport is returned back to him.
  15. I'm sorry. It's a frustrating and gut wrenching place to be in. Fill in all the information as best as you can and prepare for a long wait. If you haven't had any movement four months from submitting your return DS-5535 email consider the WOM. I waited 7 months before filing and wish I had done it months before. My WOM took 92 days from filing until I had my visa in hand. Best of luck to you.
  16. You are definitely one of the lucky ones! Congratulations! Wonder if they are starting to clear DS-5535s out at a faster rate - would also be interesting to see if the rate of issue was as high as it was Fall/winter 2021. I guess we will never know...
  17. @ice-qube Congrats buddy!!! YOU MADE IT - Get packing!! You should get your tracking by tomorrow if you haven't gotten it already and passport by Monday/Tuesday! Really happy for you, it's been a long road indeed.
