My spouse got her temp GC on Sept 19 2019, we filed the I-751 since June 2021. She receive enxtensions of 18 months and 24 months . Notice was dated 6/24/2021 and the second 11/8/2021. We filed the N-400 in June 2022 and USCIS rejected it said its outside the 90 days. Which dates are going by? Is it the extension dates or the original date on her GC?

My wife's conditional GC was issued on Sept 19 2019. Filed the I-751  in June 2021 and its still pending. While waiting, she received two extention notices of 18 and 24 months which were dated 6/24/2021 and 11/08/2021. We filed her N-400 in June 17, 2022 which was within the 90 day period. USCIS rejected it and said its outside the 90 day period. My question is, are they going by the extension dates or the original date on her GC?

My guess is that if Sep 19, 2019, is the original date, then the 3-year minus 90-day is about Jun 19, 2022. So I'm guessing that you may have applied before Jun 19, 2022, which is too soon? But if you apply again after Jun 19, 2022, then it may be okay?

 

Or since you have the 2-year green card, you may have to wait till after the Removal of Condition to apply for N-400?

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

90 days means literally 90 days, not three months. Your 90 day window started on June 18.
