You need to clarify the exact dates.  What is your residence since date on your GC?  Did you file a joint I751 first, then switch to a divorce waiver, or was the I751 file with divorce waiver in June 2020 the initial submission?  Are you filing the N400 under the 5 year rule?

I took the liberty of viewing a few recent posts you have made and though you have stated that you applied for N-400;under “ 5 “ year rule…that is not clear in the dates here….and means your I-751 was very late filed since you would have needed to be LPR since Jan 2016 to satisfy the “ 5 year rule” .

 

1. Do you think your I-751 is perhaps  being investigated , were there red flags ? Many members on VJ have first hand knowledge of long drawn out experiences especially in cases with difficult ex wives ..

 

2. Check the the of LPR on your plastic green card and if it does not say LPR since 2016 ( or 90 day window) then you filed incorrectly and need to withdraw N-400

I think somewhere you posted that you requested a FOIA -that tells me there’s more to this story. Not being nosy, but just please give us all the relevant details at once.

Otherwise, if my understanding is correct, you were not eligible to file N400 and it will be denied. You can only file based on 5 year rule.

my first i751 and n400 were both denied together because of divorce. my divorce took a while.

after the denial, i got divorced and filed a new i751 (june 2020)

then with the 5 year rule, i filed second n400 (january 2021)

as far as i know i'm not in removal proceedings

now i have i751 and n400 pending. i751 never got transferred after n400. both cases show fingerprints taken as last update.

i hope i cleared the confusion. i'm depressed and broken. 

thanks for any insight.

i understand and sorry for mess if i created. i just can't find any help or money to talk to lawyers. its just hard to be alone in this.

i requested FOIA because that's what people said it would help. it was completed yesterday and i didn't receive an interview.

They do it when they do it. Welcome to the USCIS way of doing things. 

my motivation in life is so low due to stress USCIS brought in my life. i know stress can't help but i can't break the cycle.

i don't know what i could expect next - i tried info pass, congressman, online message. nothing works.

requested FOIA and now waiting for them to send me results. it is in last step.

i don't know why people applied MONTHS after me already took their oath but i don't even have i751.

some say i751 delays n400 some says it helps.

i can't figure out what is true.

not sure what it would help.

If you’re really depressed seek mental health help. If you mean you’re just sad like we all get sometimes, it shall pass.

 

Aside from that I think you will just have to wait since you don’t have the money for lawyers. Or you could file a writ of mandamus yourself.

Thank you for clarifying…now let’s get down to business. You cannot afford to go down without a fight. You are NOT in removal and won’t be put in removal until the deny this second I-751 …and if you are to go down that road , you get ONE more chance to prove your marriage was bonafide. 
 

One of the most inspiring VJ members @Demisehas been through that path and willingly shares her spirit and victory. 
 

Glad you are posting and hope you get lots of engagement. Maybe share the colorful details of battle of the exes , as @mindthegapdoes w good cheer!

You are probably right.  But you are not in removal proceedings.

Yep, been there, done ALL of that (extensively and repeatedly), and had the stress. 
My second I-751, and the first n-400 which was filed not long after, took 3.5 years to adjudicate before another denial (and this time due to USCIS error and failure to follow their own damn policies).

When I say they don’t care, I mean it. When I say don’t stress or dwell on it, I mean it. There is nothing you can do but wait.

CR1 / DCF (London): 2012 / 2013 (4 months from I-130 petition to visa in hand)

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

I AM JACK'S COMPLETE LACK OF SURPRISE

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

First of ALL, there is no such thing as a combo interview.  The policy states that you cannot apply or be approved for n400 until you have completed ROC.  This ploy to push for quicker adjudication on the I-751 does not apply in your case.  Until your divorce waiver has been finalized, your N400 will be denied.  They will not combine the interviews, as you tried to file under the 3 year married rule.  You have wasted your money twice.  You will have to wait until Divorce waiver if finalized.
