Adjustment of status from B1B2

Hello all,

Thank you for this space to share info first off. 
I have a few questions so I’ll post my situation.

 

Came to the US as a B1B2 (Tourist Visa). Intention at POE was to travel a bit, spend time with long term partner and then head back eventually. Long term partner then proposed to me and we decided to just tie the knot and make it official soon after (under 90 days) I arrived to the US. Personal Situation changed, both are thinking it’s better to not be separated at this point so is it fine to just create an Adjustment of Status package at this point? I-94 is still valid so no one has overstayed.

 

- Is it fine to just go ahead and file for Adjustment? (Partner is US Cit)

- I read there is a 90 day rule?

- Will there be any scrutiny on the case?

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

Blame it on the moon ( cause when the moon hits your eye…)  …and USC who declared he could not live without you! You will be fine and you clearly addressed the answer u will be asked at the interview “ Why did you come / what was purpose of your visit..”

You’re ok to proceed with AOS. How long after your arrived did you get married?

also bear in mind that you won’t be able to travel or work for 8-9 months. If you’re fine with that go ahead

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

Unless you misrepresented yourself when you entered the US, there will be no issues with having entered on a B2.  The IO's asking about intent virtually NEVER even arises......ever.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

As in to check if your relationship is genuine? If unannounced USCIS home visits are not unheard of then of course they can ask you to turn your phone over. 
 

If you mean to show pictures through your phone instead of printing them, then no, they will not accept electronic evidence. You will have to choose a few nice photos, print them out and bring them to the interview along other evidence of a bonafide marriage.
