Hi all

 

My girlfriend wants to spend some time with me in the US on the b1/b2 visa, we are hoping she can stay for 6 months. She’s a civil engineer with a degree from Germany and currently has a job, an apartment and some savings. 
 

While she is here, she would like to go to job interviews and we were wondering if that is possible to do and what would we have to do if she is offered sponsored employment. Would she be able to stay with an adjustment of status if the petition for the work visa is filed?

If she is German can she not use the VWP? Being realistic with the time lines for work visas even if she could get a job and an agreement to sponsor the time lines would not work out.

She should be honest and answer any and all questions the CO asks her... 

I was questioned about my work, my future plans for work and my relationship to the person I was planning to visit (how long I knew them, where we met, their citizenship). 

 

Why is she applying for a B1/B2? Is she from Germany or is she a citizen of another country living in Germany? 

 

Also, have her look at potential jobs on indeed or any other job search engine. Most are clear about their residency requirements (a lot of jobs I've searched state they do not sponsor work visas/ only citizens and those with work authorization should apply). 

 

ETA: Sounds like she has clear immigrant intent. She wants to visit the US to search for a job and adjust status.

If she can even get an interview in the first place. Even tho it is not even legal the first question usually due to my foreign name is.. do you have an EAD, GC or citizen and send a picture of it.... Maybe in her field is different but I doubt it...

 

Applying to jobs while on vacation is sketchy at best and might indicate immigrant intent so the CO might think that she might stay illegally and hope that she can marry a citizen to adjust status...

Event with a job offer she would need to apply for a H1B or similar category visa which is not guaranteed and basically it is like a lottery due to many ppl are applying. The majority goes to Indian tech workers if I am not mistaken.

What type of employment letter will she be showing the interviewer? We thought her work contract, but not really sure what the best is.

Have you met your girlfriend before? Yes and she was here on ESTA before

Will she be staying with you? Yes

She has an interview in January. How is a work visa a lottery?

Coming over to look for a job and then possibly adjust isn't really the point of a B visa. Why does she need to be physically in the US to get a job? Most Americans now apply online and have remote interviews. Since Covid, it's a lot rarer to go in person to an interview anymore, especially not in fields like engineering. Engineering jobs often weed people out with online questionnaires about their work status in the US and if the applicant will need sponsorship. She could spend hours applying to hundreds of jobs online before even getting a phone interview or even an email reply. It's not as simple as it seems. She could do all that from Germany, no need to come over, give up the VWP and stay longer on a B.

The point of being here would also be to spend time with me. She actually got an interview here while on ESTA, was offered the job, all in a 24 hour window because she walked in, but ultimately the president didnt understand well that they would need to sponsor and backed down

Yes, which is why many companies now weed people out by making them take the questionnaire first. She will be limited to the very small pool of employers who are actually willing to sponsor. Not to be blunt but her talking to companies without telling them right off the bat that she needs sponsorship only wastes their time.

 

For the B visa, she needs to convince them why ESTA isn't enough. If the goal is to spend time with you, then she needs to say and explain during the interview. Questions about her relationship to you will probably also be asked and she must be truthful.
