Quick case history- I petitioned my wife on a K-1 in May 2018. She came to the US on an approved K-1 visa in July 2019. Married in July 2019, I-485 filed in November 2019, Fingerprinted January 2020, AOS interview November 5 2021.

 

We had our AOS interview on November 5 2021. The interview was a harrowing experience and did not go particularly well, mainly because we simply underestimated how aggressive the officer would be in her questioning (basically she questioned everything we said, even simple things like the fact I completed the paperwork without a lawyer, or that I do our taxes. She thought every answer was a red flag, especially from my wife. My wife was not allowed a moment to think. The officer accused my wife of not speaking English and would not allow her to answer her questions). We knew pretty quickly that not bringing a lawyer was a mistake.

 

After the interview the officer told us "You did not do well, but because this is a young marriage I will go ahead and approve the 2 year GC. I know your relationship is genuine, however you'll need to do this again for the 10 year GC soon, and you need to be more prepared. Another officer may not feel the same way." Our case status changed the next day to "Case is ready to be scheduled for an interview", which does not align with what the officer told us verbally after the interview. On November 11, USCIS scheduled a second interview for December 14, 2021. We have done this entire process so far without a lawyer, but I contacted one after receiving this notice to make sure we were better prepared. We have a consultation with him on November 24. Now today, on November 21 our case status has changed to "New card is being produced", but our second interview has not been cancelled.

 

Has anyone experienced this before? Will the second interview be cancelled? I hate to pay for a lawyer just to have the interview cancelled, but I also want to have time to collect any missing documents recommended by the lawyer.

Why would they even schedule another interview?  I believe the scheduling of the second interview is a mistake on the part of USCIS.    The officer said "I am going to approve your case".....and the card is being created.  I expect the 2nd interview will be cancelled.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

No, we received a second interview notice for the I-485. I believe you are referring to the I-751 which is the form you file to get a 10 year gc after having been a permanent resident for 18 months.

 

What's strange is that we got the second interview notice but our case status changed to "new card is being produced" before the second interview date.

That's what I would expect as well.

Cancel the lawyer first thing tomorrow morning and save $$$. You will get your card somewhere this week. It pretty much takes a week to ship. 

 

If indeed you need a second interview, which I doubt, you have enough time to contact the lawyer again.

 

 

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

@svartpest if this were me, I would  plan to attend the interview unless you get written communication that the interview is canceled, and I would bring an immigration attorney. 

 

Even if a green card shows up.  
 

USCIS has been known to rescind an approval even after a green card arrives.

Good to know about the history of rescinding green cards. I plan to call USCIS in the morning and see if they can offer any more information. Assuming I don;t learn anything new I'll just delay meeting with the attorney until we are closer to our interview date. Hopefully the interview gets cancelled and we can move on.

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!
