Timeline

Hello guys , me and my husband who came on a k1 visa just got married this week , and now we are looking to file for adjustment of status. We had planned to file in December , however we also need to make sure he gets all his shots in order (he was missing some due to them being contraindicated at the time of the med exam). 

What we are wondering is if there is a time limit on when we can file for AOS, must we file within the 90 days of his visa ?

If you do not file in 90 days then this can happen:

 

Not filing before 90 days means the K-1 has unauthorized presence. I would never advise anyone to plan to take that route.
 

File at least a week before the 90 days expires.

You don't need to wait to get vaccinated to file the AOS. File AOS on time and you can go through vaccination at your leisure time bring i693 during the interview or uscis will ask it to be mailed later if the interview is waived.

Spouse:

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

2016-05-10: N-400 Sent

2016-05-16: N-400 NOA1

2016-05-26: Biometrics

2017-01-30: Interview

2017-03-02: Oath Ceremony

Remedical is only needed if your DS3025 is marked incomplete.

IF marked incomplete, then the remedical should be completed (as always) as close to the AOS interview as possible.

Read the I485 and I693 instructions carefully. It tells you that you do not have to submit (and it's not advised to as medicals expire and AOS interviews take a LONG time) a new medical with the I485 application (IF NEEDED because we all know ppl are going to read this and think they ALL need a remedical). You bring it to the interview instead.

 

Are you sure you need a new one?

You can be contraindicated and still complete.

What does your DS3025 say on the bottom left corner?

Hello , sorry for the slow reply. It says “immigrant visa or parolee applicant completed vaccination requirements”

So what makes you think he'll need a new medical/ vaccination report if it says vaccination requirements are completed? He's golden.

Then it's complete even though the PP checked the wrong box (should have checked K1 but that's not a problem).

Nothing further needs to be completed.

Provide a photocopy of the completed DS3025 with I485 and bring your personal copy and another photocopy to the GC interview.

Hey! @David and Gianna Looks like we are both in the same field office. We're just waiting on our marriage certificate to arrive and we will file our AOS packet. I have nothing to add to this thread - but it's cool to see someone with a similar timeline as me on here. :D

  • 02-02-2022 - Credit Card Charged
  • 02-12-2022 - Notice of Biometrics
  • 03-09-2022 - Biometrics Appointment
