I am told getting married in the usa on ESTA is illegal (even if I intend to go back home)?

My wife came to the US on an F1 visa about 10 years ago.

You can get Deported if you entered under a B.

Not if you have filed a 485. They have to wait for that to be adjudicated.

Which is very true... hence why i said be mindful... i am not suggesting that a person lie but i am letting them be aware of the possibilities...

So as advised the safest way is  K1 visa, or face the possibility. We must remember here that because some people got through a process seamlessly doing certain things does not guarantee others the same and i just wanted the person to know of all possibilities and that they do whatever at their own risk...i didnt have a planned wedding, i married my husband in a courthouse with his parents as witnesses in a dress i bought 2 days before the wedding. I didnt have to lie to anyone on entry because o was on a 4 week vacation... but this poster seems to have a wedding planned. She should walk with proof of returning home if she plans to announce that her sole purpose of visiting is to get married to her us partner. All officers are not the same and they make the decision.

All that said, I would give a generic but truthful answer when asked the purpose of your visit.  Avoid, saying that you are coming for your wedding.  It's also true you'll be visiting friends, doing tourist things, etc.  No sense risking an ignorant officer that makes the wrong assumption about your intentions.

Been trying to make this point. People need to be mindful of all possibilities and not told it is cut and dry ok because others have been sucessful. My question is always about those who were not and had good intent.

we get married on my tourist visa. i am pretty sure it is legal.then we filed I130 for CR1 visa.

now i went back to my country waiting for the visa processing.

I think the point is not "you can't get married in the US",the point is "DON'T Stay in the US to adjust status".

It's a long long journey till i find my way home to you

 

I-751 Timeline

1/3 Filled I-751 and Sent on 1/10

1/17 Got USCIS IOE#.Case was received and a receipt notice was sent.

1/23 Check cashed

1/26 Case Tracker update :Biometrics appointment was scheduled.

2/2 Received Bio appointment in mail and rescheduled the bio appointment online

2/6 Received  NOA and extension letter in mail

2/7 Done Bio in person and status changed to "Actively reviewed"

Go to Serbia for 14 days, so much cheaper and closer than Mexico. And you have direct flight to JFK.

What do you mean "The only 90 day visa I can think of is a K1"?  A tourist visa usually is 90 days.

6 Months, you can be admitted for less but pretty unusual.

You are probably thinking of the ESTA/VWP vs a tourist visa.  Most B visa holders are admitted for six months.
