My Fiancé had his interview in Feb 2020

We were placed on AP. And never heard anything until Feb 2021, stating their sending the case back to USCIS pending revocation! The case is now at NVC. Can anyone give me some advice as to what to do? Should we get married? Or wait to see what the issue was? Thanks!

Wait and see what the issues are in the official letter.  Marriage might not cure the problem.

Registered Nurse- Retired- I practiced in the areas of Labor & Delivery, Home Health, Adolescent Psych, & Adult Psych.

IT Professional- Retired- Web Site Design, Hardware Maintenance, Compound Pharmacy Software Trainer, On-site go live support, Database Manager, App Designer.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I called them and they stated, they don’t know how long it would take. Because it’s in AP stage..

It's no longer in AP if it has been returned to the US.  

 

Your fiance may have some idea of the reason for the denial.  If it is a matter of the consulate not believing your relationship is bonafide, then the way to fix that is more time spent together in person.

The time he went for interview was my 2nd time visiting. The CO told him he would hear something in 3 days, and then Covid hit, and his Country was on the banned until Biden took office. So honestly I really don’t know what the issue was/is. 🤷🏽‍♀️

When I called the NVC, they told me it was going through administrative Process and when they complete the file, they will send it USCIS and they will send me a letter indicating if they approve the revocation or allow me the opportunity to correct the issue/issues..

For Nigeria, this could be the problem.  I recommend more time in person together, multiple visits, then get married in Nigeria and file for a CR-1 visa with lots of evidence of time together, plus any financial co-mingling that you can do while living in separate countries.  Good luck!

Unfortunately this is not the case for K1s. Once the embassy sends the case back to the US K1s are done. They can't appeal anything. The only letter you'll get from USCIS is the reason why you were denied a visa. For some reasons embassies and NVC tells everybody the same no matter what visa category they're going for.

 

The safe bet would be to wait for the letter to see what the issue is you need to overcome. Of course you can already get married, spend more time together which is never wrong and start the financial co-mingling but don't apply for the CR-1 right away.

Filing a K1 after 1 visit in Nigeria is a problem, unless that visit lasted months.  And no visits in between is a complete deal breaker. The only way a K1 is reaffirmed by USCIS is if some USCIS approval / clearance is missing.  And I have only seen that once.  Your K1 is dead.  Hopefully your fiance can be more forthcoming about why they feel they were refused.

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I don't think 1 visit is a problem especially during COVID and exceptional difficulty in travel vs to Europe. Africa in general has a harder time. I would ask others K1s from Nigeria their experiences vs comparing with other embassies the local issue.

Many, many threads here on VJ, including the current one, would indicate that one visit for K-1s in Nigeria is indeed a problem.

I am doing a second visit, and have heard its benefit, but that's only one element, having a good sponsor, quality evidence and having interview focus for dealing with a fraud heavy embassy would suggest to do all you can. But freaking out won't help the situation, including just waiting and waiting. I would seek local representative support, legal help and find all options at this stage. If you can get married there, that is likely equal solution changing the case. Reaching out and being proactive is much better than sitting and waiting or looking backwards. I pray you find solution.

Thanks! Actually, I’ve visited X3. I have also reached out to my Congressman Rep. However, the person in charge of immigration acted as if he wasn’t too experienced.. LOl 😂 I really believe a lot had to do with the Ban on Nigeria and the past issues with the Country immigration system. This time when I visit for the 4th time we will get married. Thanks Everyone for your comments. I greatly appreciate the information.

Congress members can make inquiries on your behalf, but they cannot impact or reverse decisions made by DOS or USCIS.
