I-751 with Divorce Waiver Interview Done today, no decision (merged)

So I just got back from my interview. The IO was nice but when she explained to me why I was being interviewed, I was so confused. She said there were a lot of discrepancies with my file. First one was our address (which doesn't make sense because we lived together in the same address for 8 years).  I had submitted both of our driver's licenses, our apartment lease which we renewed every year, Joint bank account statements,  utility bills (that spanned the whole 8 years at our address),  Tax returns,  Life Insurance, etc... all of which have the same address for 8 years.  She said they looked it up at the DMV and it shows we lived in separate address. I was shocked. I told her there had to be some sort of mistake because we had not lived anywhere else other than the address I submitted. I have no idea what she's talking about the DMV having different addresses on file. That was shocking and confusing and I told her we absolutely had no other addresses. Second she said I didn't have enough evidence of a bona fide marriage, she claimed we never took trips together, we don't have kids, we don't have a house/mortgage, loans etc... I told her we did have plans to eventually buy a house together but we just weren't financially ready yet, which is why we had been living in the same apartment for 8 years. As far as the trips, I did submit itineraries for trips that we took together, she asked if I had any of those itineraries with me. I had a big file with me but only managed to find ONE 😕 . I told her I did submit all the itineraries to our trips/vacations and that it should be in my file. She claims there weren't any. Another discrepancy was our bank accounts; she asked why the statements I provided only had my ex's direct deposits on there. I told her, my job at the time did not offer direct deposits so I had to deposit my checks into that account, she claimed in did not show that. I told her the statements should show that I deposited money into our account and that we paid for bills together on those accounts. She still claimed none of the statements showed any of that. I already felt defeated from the beginning because nothing was adding up with what she was saying about our addresses and not having enough evidence of a bona marriage. We were together for 8 years, only married for almost 2 years. We were a legitimate couple. I provided evidence from the entire 8 years. Then she asked me in detail how we met, when we first met, a little about our dating life, who proposed, when was the proposal, when did we get married, did we have a big celebration, did my ex know my family, did I know my ex's family, how/when did the trouble start in our marriage, who ultimately decided to end the marriage, what was done to try and save the marriage. I answered everything in detail and I think she tried to confuse me by reiterating my answers but changing them around a bit but I always corrected her, for example I told her my ex proposed in November of 2016, she later says ok so your ex proposed in January 2017? I corrected her and said no, November 2016. There was a lot of that, where she would repeat questions and answer them with a different answer that what I gave so I had to correct her. Anyway, in the end, she said because of COVID she still has a lot of files to review and that I would likely get an answer in a minimum of 90 days.  That's how my interview went. I didn't leave feeling great but at the end of the day, I submitted all the evidence I had and I told the 100% truth and that is all I can do. As far as all the things she was saying about my file not showing/having certain things and the whole DMV discrepancy, I really don't know what to say or think about that and I can't really do anything about it because I have no idea what other address they are talking about. How can the DMV have different addresses when our licenses and car registrations and insurance have had the same address for 8 years? 

 

Has anyone else had an interview where they claimed you did not submit things that you actually did? Also has anyone experienced anything like them saying they checked DMV records and addresses don't match?

They lie. 

They sometimes do it out of ignorance, but they do also do it sometimes to try to trip you up.... 

If you submitted it, it will be in your file (as an FOIA request would show you it is).

 

Nothing you can do now, wait and see what happens. Try not to worry.

I-751 #1- April 2015 [Denied]

 

April 2015 : I-751 Joint filing package sent fedex next day 09:00am from UK ($lots - thanks). 
Jan 2017: Notification that an interview has been scheduled at a local office. Bizarrely still no RFE... 
Jan 2017: 2hr wait, then interview terminated before it began, due to moving my ID to another state 2 wks prior. New interview 'in a few months...maybe.'   Informed them that divorce proceedings are underway, but not finalised at this time. 
March 2017: An Interview was scheduled - marked as no-show as they didn't actually send out a notification of interview. FML 
April  2017: Filed an official complaint with the ombudsman, and have requested Senator & Congressman assistance
August 2017: Interview - switched to a (finalised) divorce waiver. Told that decision will be made that afternoon, but no problems foreseen with my case. 
October 2017: Letter of Denial received - reason given as 'I-751 petition was not properly filed'. Discovered ex-spouse made false allegations to USCIS in 2015. No opportunity given to review & refute allegations  - contrary to USCIS policy.

I-751 #2 - Oct 2017 - Mar 2021[Denied] 

 

October 2017: Within 72hrs of receiving denial notice, a new waiver I-751, divorce decree & $680 cheque, sent to Vermont via FedEx overnight 9am priority.  
Dec 2019: Filed FOIA request for full A# file
Feb 2020: FOIA request completed - entire A# file received as a .PDF; 197 pages fully redacted, and 80 partially redacted. Don't waste your time!
March 2021: I-751 #2 denied for lack of evidence. No RFE, no interview, and evidence in previous I-751 not reviewed - contrary to policy. Huge errors in adjudication.

N-400 - Feb 2018 - Apr 2021 [Denied]

 

February 2018: N-400 filed online.  $725 paid to the USCIS paperwork wastage fund

February  2019: Interview - cancelled after a four hour wait due to 'missing paperwork' on their end. Promised Expedited reschedule.

March 2021: Interview letter received, strangely dated after I-751 denial. No I-751 interview conducted. N-400 interview and test passed, given 'cannot make a decision at this time' paper due to the ongoing I-751 nightmare...

April 2021: N-400 denial received citing recent I-751 denial as basis for ineligibility, even though it should have been a combo interview 🤯

Service Motion - March 2021 [Sent via FedEx & COMPLETELY IGNORED by USCIS]

 

March 2021: Service Motion request sent overnight addressed direectly to field office director, requesting urgent review and re-opening, based on errors in adjudication - citing USCIS policy, AFM and memorandums as basis for errors. This was completely ignored by USCIS.

 I-751 #3 - June 2021 - Jan 2024 [Denied]

 

IT'S GROUNDHOG DAY

June 2021: I-751 #3 (30+lbs/5000 pages of paperwork) & another $680 sent to USCIS via FedEx ($300+..thanks) .... 

June 2021: Receipt issued, card charged, biometrics waived, infopass scheduled for I-551 stamp number ten.....

Feb 2022: RFIE (no, not an RFE, a Request For Initial Evidence) received, for copies of the divorce paperwork that they already have 😑

July 2022: Infopass for I-551 stamp number eleven.....

August 2023: Infopass for I-551 stamp number twelve....

January 2024: Denial received, ignoring the overwhelming majority of the filing, abundance of evidence, and refutation of a provably false allegation. The denial also contradicts itself in multiple places, as if it was written by someone with an IQ <50.

HAPPY NEW YEAR

 

2024: FML. Seriously. I'm done.

Sounds like she didn't even look at your file before the interview and just made up a bunch of BS to confuse or scare you. Give her time to go through your file and she will find exactly what you told her would be there, she will see that you told the truth, and then you'll get your approval.

It's not her business why you did not buy an apartment/house/villa/mansion.

You should have told this to her.

People, please don't be afraid to point out that your personal life is personal ! You submitted all the papers, they have to work with it!

I think those probably are legitimate questions for them to ask, and refusing to answer them likely won't end up with a good result.

 

You did the right thing with staying calm and answering correctly I'd say.

I'm so sorry for that experience, hopefully for you she will go through your case soon and you will receive your approval!

Yeah I really had to bite my tongue not to get into it with the IO especially regarding the Travel, she asked why we never travelled together and I told her, yes we did, I submitted all of our itineraries and some photos from our vacations/trips (I even started stating all the places we had been) and she said no, there are none in your file. I basically had to stop myself from arguing back and forth. Same with the bank statements claiming it only showed direct deposits from my ex's work (not true, we used our joint account to pay bills/rent etc. and I submitted all the statements I had). She also questioned why we had separate bank accounts in addition to our joint accounts and I explained that those were personal accounts we had prior to getting married. I don't know too many people who have joint accounts with boyfriends/girlfriends, maybe that's just me? We got our joint accounts right before we got married and never closed our personal accounts, which is why we have joint and separate. Also, I included every lease we ever renewed at the same apartment. No we didn't own a house or have a mortgage but we a least had an apartment together that we lived in for 8 years straight. But seems like nothing I submitted was in my file?? Who knows...

Geez man! Why no house? Well some of us can’t qualify because of listening to our boomer parents that we need to go to college and get into student loan debt 😆😆😆😆🤦🏻‍♂️🤷🏻‍♂️ No children? Maybe one or both are sterile or have some kind of problem getting pregnant…it’s so common nowadays for a man to have a short sperm count or the woman to have psicosis or polycistic ovaries.  I guess we are getting denied if we get an interview since we don’t have these things either 😆

Some of these questions sounds ridiculous. Not sure if the IO is expecting every married couple to follow a general script.  Many married couples don't even live together but are happily married.  Her script would fall apart in those cases.

@Positive_Vibes sorry you had to go through that. Question, did you submit a detailed Table of Contents outlining each piece of evidence and explaining what the evidence means? As redundant as it may seem, it is important to tell USCIS in full sentences what each piece of evidence means and also break down the bank statements for them. 

 

You will be fine, though.

WOW, SO I HAVE AN UPDATE! It's been over a year (1 year and 7 days to be exact) since I did my I-751 with Divorce Waiver Interview...and I am STILL WAITING for an answer. I originally filed the I-751 with Divorce Waiver in December 2018. Anyway, this morning around 7am...I woke up to 2 IOs banging on my door. I opened my door and they both showed me their Department of Homeland Security badges and stated they were "here for a follow up regarding my green card application." I said okay and asked them if they wanted to come in but they refused. They then asked me for a photo ID, I asked them if I could change since I just woke up and was still in my boxer pajamas. So I put on some pants really quick and grabbed my ID. They took a photo of my ID then began to ask me some questions. First they asked " So you're divorced?" I said yes, they asked when we were divorced, I answered November of 2018. One of the officers had a manila folder with a notepad in it where he was writing my answers down. They asked if we lived here (referring to my place) together. I said yes.  Questions after that were: When did you guys get married? Did you move in together after you got married?  I said no we were already living together prior to getting married in fact we were together for 8 years prior to getting married. Then asked when my ex had moved in with me, how many bedrooms are there, if anybody else had lived with us, why did we get a divorce. They asked where my ex currently lives, I told them I didn't know. They asked if I had a phone number for my ex and also asked for my phone number. One of them asked the other if he had anything to add. He said no, then said "okay well thank you, you have a good one." Then they left. 

 

This whole thing totally caught me off guard. I had no idea they can just come to your house for a surprise follow up interview, but I hope this means I will be getting an answer soon.

I-751 timeline:

  • 12/04/2018: Mailed I-751 with divorce waiver
  • 12/19/2018: Received by USCIS
  • 5/02/2019: Biometrics appointment
  • 5/03/2019: Case updated to show Fingerprints were taken and applied to my case 
  • 1/28/2020: Received an RFE
  • 2/05/2020: Response To Request For Evidence Was Received by USCIS
  • 8/12/2020: Case received at my local office
  • 9/16/2020: Case is Ready to Be Scheduled for An Interview
  • 2/24/2021: Case scheduled for an interview
  • 4/06/2021: Interview done
  • 4/13/2022: Surprise Interview done at  my house
  • 12/08/2022: I-751 with divorce waiver APPROVED!
  • 12/21/2022: 10 yr Green Card Received.

 

N-400 timeline:

  • 01/26/2022: Applied online and received by USCIS, Informed of Biometrics reuse
  • 06/17/2022: Interview scheduled
  • 08/04/2022: Interview done. Passed English and Civics test but no decision could be made due to my pending I-751
  • 06/08/2023: Oath Ceremony Notice Was Mailed
  • 06/22/2023: Oath Ceremony - FINALLY A US CITIZEN!
