  1. Yeah I strongly encouraged him to apply for the advanced parole and he didn't do it back in 2022. I suggested him to do this so his wife could go to Mexico and let his baby son meet his other grandparents back in Mexico. I sadly think that he wants his wife's freedom limited... But that is another story for another day. Speaking of emergency, his wife's sister passed away during this whole wait down in Mexico and she never got to say goodbye to her sister. They got married in 2021 inside the USA and if she does get the visa she will go directly to the 10 year green card. Is the I-765 so you can work, get a license and open bank accounts for before they approve you for the I-130 and I-485?
  2. They live in an apartment complex that has had a history of giving mail to the wrong unit or arriving at a completely different complex. I know it is weird and I recommended him to use his uncle's house address since its more reliable but hell what do I know right?

He didn't file the I-765 (because she is a stay at home mom and she probably will never work outside the home), I-131 (I told him to file this initially so his wife could have a chance to go home during this process, didn't take my advice) and he filed a I-130 that was approved as stated in the previous topic.
  4. Hello, I have a friend that applied for AOS & I-130 for his wife in September 2022. He told me that he never heard from USCIS for an entire year until September 2023 when he got an RFE for the I-130. In November 2023 he sent in what was asked for and got an approval in December 2023 for the I-130. He didn’t hear anything else from USCIS so last week he decided to get his senator in Phoenix involved for a status check to see if they have an interview date or not. Greg Stanton’s office ended up finding out that USCIS sent out 2 requests: one letter to appear for biometrics in October 2022 & another letter for a rescheduled biometrics in early 2023. My friend said he never received any letters for biometrics. Greg Stanton’s office also uncovered a I-485 denial letter that my friend said he also never received in June 2023. Besides hiring a lawyer what does he have to do to get this on track? Re-open? Or re-apply for the I-485 and start having his mail sent to a more reliable address?
  5. Good evening, I have a question on how to pursue this. My niece (through marriage to my Mexican wife) was born in Mexico to a dual citizen father (US & Mexico citizenship) and a Mexican mother out of wedlock. Throughout her life she has received a lot of conflicting advice on this subject. When she was around 3-4 years old American father abandoned her, her baby brother and mom in Mexico. She hasn’t had contact with him since that day they were abandoned. He did all he could to avoid paying child support and avoided letting her get citizenship through birth so she could go after him for support while she was a minor. His family paid off judges in Mexico so he wouldn’t have to pay support. He also refused to recognize himself of the father of her younger brother. Niece is 22 years old now and is interested in obtaining her citizenship through birth of American father. She has her own Mexican birth certificate with the American father’s name on it. Since he is a dual citizen he had himself listed as “Mexican” on the BC. She also has her fathers BC from Mexico but not the father’s consular birth abroad certificate. We can’t seem to get any direct information from the US Government on the first step. Her father did live at least 5 years in the USA and 2 years after age of 14 to fulfill that requirement. The only thing would be acquiring evidence from a father that won’t cooperate. Would this be an N-600 filing? Or something completely different with her local consulate in Hermosillo? I wrote to the consulate over there but haven’t got a response yet.

I think what the attorney may have meant was; for example if your girlfriend comes into the country on a visitor visa on January 1st, 2023 and then you all get married the next week that it could be determined that she entered the US on intent to marry and stay. A lot of people wait 90 days after arriving on a tourist visa to get married and then stay while filing for AOS so it doesn't look like there was intent to marry and stay versus visit.
  9. I have a friend in Phoenix that went this route. Arrived in January 2021 pregnant on the border crossing card with a permission to travel outside the 100 mile zone. They were married in February 2021 and applied for the spousal visa (adjustment of status) September 2022. They are still currently waiting for an approval/denial/RFE. His wife stayed here because of the baby and now they are having another one this year. This should give you an idea on how long Adjustment of status inside the states is currently taking.
  10. Crazy Cat I wanted to pass along my late congratulations about the good news! I haven't been on here much anymore since my wife got her ROC and Citizenship done in September 2022. I was thinking about you guys this morning and decided to log back in to see if your timeline was updated and it was I am glad that she finally got through removal of conditions and is now a citizen! Did they ever explain to you two on why they drug on your ROC for so dang long?
  11. I have a friend that did this with his girlfriend from Mexico. He brought her over on her border crossing card while she was pregnant. She stayed, they got married and had the child here. And she never went back of course. They just recently filed for AOS at the end of this summer. The border agent almost didn't let them into the USA because this was during the whole essential travel period where Mexican citizens couldn't come in unless it was essential.
  12. I have a question. My wife who is now a US Citizen as of last week and is interested in applying for residency for two sisters down in Mexico. One of the sisters has a border crossing card and comes and goes frequently. Can the sister that already has a border crossing card still visit the US if my wife applies for her residency? Or is she no longer allowed to visit during the process? The other sister does not have a border crossing card but she does have an interview early next year to obtain one from the US Consulate in Hermosillo.
  13. My spouse applied for ROC in July 2020 and got an 18 month extension letter. Last December they sent her a new extension letter for 24 months which expires October 2022. She applied for N-400 in mid May and got her interview July 1st, 2022. She passed the citizenship test with flying colors despite difficulties with the English language still. They had the original submission of the I-751 on the desk during the interview. Her ROC interview was approved without interview. She is now in line for the oath ceremony which will probably be this September/October. We are excited that after 2 years of waiting we are finally at the end of our journey.
  14. In our case my wife went to the N-400 interview (July 1st, 2022) and they waived the I-751 interview and approved it here in Tucson. When she arrived they already had the entire I-751 submission from July 2020 on their desk. Now my spouse is in line for the Oath Ceremony. She should be getting a notice this month.
  15. Paul, I got good news… She passed her ROC/US Citizenship interview today 7/1/22!!! Now we just await the oath ceremony! 🙌🙏

  17. Thank you! I have been reading off 100 questions per day for her since June 1st. Today she got 99 out of 100 right for the citizenship test. I couldn’t believe it only took a week after submission to get an interview scheduled. I guess Tucson and Phoenix offices are fast right now.
  18. My wife has an N400 interview on July 1st, 2022 in Tucson. I am suspecting that they could be doing a combo interview since she has been waiting for her ROC to be approved since July 2020. what should she bring to the I-751 interview if they decide to do a combo? What kind of questions do they ask in the I-751 interview? For the N-400 interview is there anything that should be brought that is not mentioned in the letter?
  19. My wife applied for her citizenship Monday, May 23rd online and this morning received an electronic notice that she has an N-400 interview on July 1st, 2022 at the USCIS in Tucson, AZ. Her ROC is still pending since July 2020 with no response on how it is going. She did biometrics in December 2020 and got a 24 month extension letter on December 24th, 2021. Before that she had received an 18 month extension letter in July 2020. The N-400 interview notice did not mention anything about a combo interview for the pending ROC. Will they still do a combo interview? Should she bring a copy of her submitted I-751 from 2 years ago? Or just the extension letter?
  20. I would like that because the ones that came in on CR1 from the embassies go through hell at removal of conditions time just because they got their CR1 abroad. While someone that adjusted from a tourist visa that gets a CR1 skates through the ROC process just because they did everything here versus at the department of state.
  21. That was our original goal when i was overseas with her. But we just couldn't stand one more second living on the US/Mexican border so we applied as fast as we could at the time. Now we are stuck in the ROC blackhole for two years now. I just helped my spouse file for the US citizenship on the 3 year rule. So we will see if that triggers USCIS to finally get working on our ROC.
  22. In Mexico there are a lot of businesses that work as a facade that doesn't exist. These fake companies operate for people to have fake paystubs that they can take to their tourist visa interviews at the local consulates in Mexico. The facades not only work for this purpose but money laundering and trafficking in some instances. So imagine someone here on a tourist visa that got approved over fake proof of employment staying here? Also each time that the paper permission slip which i believe is an I-94 runs out Mexicans have to present updated proof of employment in order to get a new permission slip.
  23. So I downloaded the tax transcripts this morning after creating a login with the IRS. I deleted all my tax return uploads from Friday that I had uploaded and replaced them with the tax transcripts from 2019, 2020 and 2021. USCIS already sent an electronic letter saying that they received my request and were going to reutilize the fingerprints that my spouse took in December 2020.
