    i will appreciate if someone  can be of help with this question. What is going to be the adverse effect when you file for divorce after N400 application. Before getting an interview date ,you and your spouse decided to file for divorce. What is gong to be the consequences ?has anyone been in this situation? please let me know

Was the N-400 filed based on 3-year rule or based on 5-year rule?

 

If based on 3-year rule then how long do you expect the divorce process to take? I.e. which is more like to occur first: the citizenship oath ceremony or the divorce process being finalized? https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-3

If you are getting divorced you should consider withdrawing your n400. You still need to be in a bonafide marriage at every step of the n400 process. You need to swear you are in a bonafide marriage if you are caught lying about it before or even after the fact you could lose the right to become a US citizen with the USA taking you to court to denaturalize you. 

 

Refile your n400 under the 5 year rule then no chance of being caught in a misrepresentation with USCIS. 

 

If you and your spouse can hold off filing for your divorce until after your naturalization then I think you will be okay.

The "living in marital union" requirement is only till the time of filing Form N-400: https://www.uscis.gov/policy-manual/volume-12-part-g-chapter-3 "the statute does not require living in marital union for the period between the date of filing the application and the date of naturalization (date applicant takes the Oath of Allegiance)." "USCIS follows the language of the statute in requiring living in marital union only up until the time of filing."

I passed my interview this morning at the Chicago field office. My interviewing officer was very nice. I brought every document I could think of, but was only asked to provide the lease for an apartment I moved into while my application was pending. Also provided the basics like ID, green card, passport, and interview letter as well as two recent passport quality photos. We started with the civics questions, then reading/writing, and finally the yes or no questions. I had a couple of recent international trips that we updated as well. 

 

Civics Q&A

1. Who is in charge of the executive branch? - President

2. Who vetoes bills? - President

3. Where is the statue of liberty? - New York Harbor 

4. What are two rights of everyone living in the United States? - Freedom of speech and the right to bear arms

5. Why did the colonists fight the British? - Because they didn't have self government

- March 6, 2021 - Application received 

- March 11, 2021 - Biometrics waived 

- October 1, 2021 - Interview was scheduled

- November 10, 2021 - Interview

Thanks! Good luck with your interview! I would say "don't be nervous" but of course it isn't as simple as that. I was nervous as hell. You will do great. Others have said this at length, but they aren't expecting perfection, just honesty. Hell, I'm a native english speaker and struggled to write the damn sentence with a stylus on a vertically mounted iPad. Let me know if you have any questions.

Had a combo interview today at 8AM, 9AM i was out and approved for both, didn't even have to show any documents.  

Status changed immediately.

Almost done with all of this!

  • 04/05/19.   Received interview date for May 10, 8am. Registered their interview and emailed Andrews Hospital to schedule their appointments.
  • 04/26/19.    Medical appointment date 8am.
  • 05/10/19.    Interview 8am approved.  🎉🎊..

  • 05/13/19.    Status changed to ISSUED
  • 05/15/19.    2 youngest kids passport picked up by their dad
  • 05/16/19.     Eldest child passport picked up by her dad

  • 11/01/21      interview descheduled
  • 11/02/21       interview rescheduled to 12/03/21 @8:45am Charleston
  • 12/03/21      I drove 3 hours for my interview only to be told my file wasn't there and I'd have to be rescheduled for another interview. they weren't sure if it would be possible before the holiday. He even said he wasn't sure why they didn't do both interviews that very day when i did removal of conditions interview.  
  • 01/07/22.     Interview rescheduled for 02/14/22 @1:30pm Charleston SC.
  • 02/14/22.      Passed my interview. Now await oath ceremony.
  • 11/02/22.      Letter mailed with oath ceremony date and time 
  • 11/08/22.      Received letter oath ceremony scheduled for 11/15/22 @9am Charleston 
  • 11/15/22.      Oath Ceremony in Charleston (finally a citizen of the USA 🇺🇸) 🥳🍾
