Approved!!! (CR-1 Islamabad embassy)

Hello and salam,

finally my wife’s case is approved and she came here 2 days ago. My PD was feb 10th  2019 and she got her first interview In October 2019 we were waiting since then. Last year in September 2020 I decided to file mandamus and as expected she got call from Islamabad embassy for the second time in December 15th. She got her passport back in a week with CR-1 visa. 

All my brothers and sister who got stuck more then 8 months after the first interview, go ahead and file mandamus. I know if pricey but it’s worth it. other wise they will keep you waiting for years.

do you know why was she put in AP in the first place? Any travel history, second marriage, age gap, documents missing etc?

Congratulations!!!  But a WOM does NOT always result in success. It only causes them to make a decision.....it does not require them to approve a case.  Just a couple weeks ago, someone ended up with a denial.  Seems a real gamble.

Source please. I doubt they were waiting more than 8 months in AP. 

 

If spouses have a clean background (and they know it) it's a good idea to file the WoM if they are waiting more than 8 months in AP. I haven't seen anyone get denied unless they had a serious national security suspicion. Besides background checks (administrative processing) shouldn't take more than 1 year.

I doubt the people in the recent case  I mentioned would have filed a writ if they had not been in ap for many months.   Do you really think a WOM forces them to approve a case?  How do they know if spouse have a clean background until the actual background checks are done? What says a check shouldn't take more than a year?  Like I said, filing a WOM is a big gamble.

You haven't given me the source. Each case is different and from what lawyers have said most WoM are successful. A lawyer will tell you the success rate of a WoM, they usually wont even file it if they know it'll likely fail. It tarnishes their reputation. 

Like i've said multiple times, 99% of background checks take less than 3 months. I've worked for a background check firm. WoM is not a big gamble if you have a good lawyer and a good background. Most people know if their background is good or bad. Most people know if they have done things that are criminal. 

 

Also, please stop putting words in my mouth. I never said WoM forces them to approve your case.

 

Bottom line is, if an applicant who has a good background is waiting more than ~10 months in AP should consult a lawyer and look at their options (which include WoM)

It's normally not the petitioner who is being checked in those countries.....the fact is that the Pakistan (for example) infrastructure is not trusted.  I think you are making biased assumptions about what is required in other countries.

No travel history, that’s my second marriage and that’s about it.

If you hide facts then you might not get the result you want. In CR1 cases it works most of the time as they don’t have any reason to deny until and unless you hide some info from them.

Exactly how do they know if a person has hidden facts....unless they complete the background checks???

That’s why you should file WOM after 8-10 months. That’s enough time to check any background. If they fail to do so, then file WOM. We can’t give them life time to check it.
