No I didn't as the previous one is still valid. But does it make any difference in processing time?

i had an active k1 status but Cancelled it and opted to stay and marry now. I don’t know how the situation would be for an IR1 but I suggest creating a topic on the forum so that more experienced members can give you advice. There are tonnes of people I’m sure in the same boat as you right now :)

Yeah, I guess you did the right thing. I've been waiting for my visa for almost 2 years and the consulate does not even tell me what's going on and can't do it anymore.

If you were to adjust status you would have to file the i130 and the i485 (please also look it up to be sure. There are timelines and steps here on the forum you can look at) but essentially you’d be starting the process from scratch. So you’d be restarting the wait times again. Not to mention you can’t work or leave the US until you receive your travel and work permit

Not necessarily the case, as the I-130 approval doesn't expire. But at I-485 interview if the I-130 file hasn't arrived from the internal transfer request, then it can delay I-485 adjudication.

I guess as HRQX said I can reuse it but it might extend the processing time and for that reason I will file again. But it really sucks to have to stay in the US when I'm still paying rent for my apartment in Montreal :(

Based on my personal experience, nothing goes well and smooth in my application, so will file again 😥

I have resubmitted my AOS packet yesterday.

I can see that only 2 July (VJ) filers have been acknowledged so far. Hoping more July applications would be approved soon!🤞

Feb 25, 2021 - New card is being produced (EAD) | Feb. 26, 2021 - EAD and AP have been approved

Mar 3, 2021 - Combo card received | Mar. 5, 2021 - SSN card received

Aug 31, 2021 - Case updated online to interview has been scheduled | Sept 8, 2021 - Interview schedule received in the mail via USPS

Oct 5, 2021 - Scheduled interview | Oct 6, 2021 - Approved

Hi July filers.

Joining you as I am submitting my entire AOS packet for the FOURTH TIME. I had 3 rejections stating incorrect fees. Spoke with Tier 2 agent yesterday who confirmed $1225 was indeed the correct fee and my packets should not have been returned. (Originally submitted in MARCH, then MAY, then JUNE) 

Hoping 4th time is the charm?!

I’ve been seeing a lot of people rejected for that reason, hopefully this is the time it finally gets accepted!

  • Form I-944 (Declaration of Self-Sufficiency with applicable supporting documents.) 
  • Copy of beneficiary's Passport with biographical page  
  • Copy of beneficiary's K1 Visa from Passport and entry stamp  
  • Copy of NOA2 Approval letter (from K1 process)  
  • I-94  
  • Copy of beneficiary's Birth Certificate  
  • translation of birth certificate (if needed) 
  • Certified copy of Marriage License  
  • Passport Photos (2) name written on the back  
  • Copy of DS-3025  

  

Form I-864 (completed and signed by USC) (goes with form I-485)

  • Proof of USC's citizenship (copy of birth certificate, copy of passport bio page, or other) 
  • 2018, 2017 (optional), and 2016 (optional) Tax Return (with W-2) or Transcripts 
  • Employment Verification letter (updated one - not the one used during K1 process)  
  • Pay stubs (last 3 months)  

  

Form I-765 (completed and signed by non-US Citizen/beneficiary)

  • Copy of beneficiary's Passport with biographical page  
  • Copy of beneficiary's K1 Visa from Passport and entry stamp  
  • I-94  
  • Passport Photos (2) name written on the back  
  • Copy of NOA2 (from K1 process)  

  

Form I-131 (completed and signed by non-US Citizen/beneficiary)

  • Copy of beneficiary's Passport with biographical page  
  • Copy of beneficiary's K1 Visa from Passport and entry stamp  
  • I-94  
  • Passport Photos (2) name written on the back  
  • Copy of NOA2 (from K1 process

 

 

Be sure to double check for the current fees as fees do sometimes increase, so please check. Additionally check the forms as listed above i.e., current version and or edition date, there has been changes to various forms since February 24, 2020. Consider sending tax transcripts instead of the 1040, and W2's. Also consider preparing a cover letter for each form in addition to the main cover letter.

 

Make sure you send long form birth certificates and not the short form. IMPORTANT: Form I-944 has quite a bit of supporting documents that go with it depending on your situation, be sure to read the instructions for this form carefully. Many people have gotten a RFE for this form so be sure to pay CLOSE attention when filing it out. Hope this helps in your preparation of your AOS. When in doubt ask questions.

I'm going to submit my wife's AOS packet on Friday. I'm just waiting on one letter from TransUnion about the "No Credit Record". Hopefully it comes today or tomorrow. I will post again once it is submitted. @Briberry thank you for the checklist! I'm so glad to have this done!

I’m glad your getting tour package together! And no problem at all! The checklist helped me to get my stuff ready so I figured I’d help everyone else who is filing for July as best as I could!
