You need to request for info pass before your extension expire and have I-551 stamp with valid passport.

Yes, I submitted the divorce dissolution. And explained everything that happened in detail through my lawyer.

I did send in the divorce dissolution and explained everything that happened. I'm just confused that they're asking for things again I already sent in. I sent the divorce decree as well.

You need everything  i already asked you  but do you have at least two years of college in US as a U.S. Dreamer ?

Hi everyone,

 

I filed ROC in June 2020 (Vermont Service Center). In April of 2021 I got an RFE, which gave me a great chance to update USCIS on my situation (getting a divorce) and to request a Divorce Waiver. At some point, my case got transferred to the local Milwaukee office and in August of 2021, my online status changed to "Ready to be scheduled for interview". Since then, I haven't heard anything.

 

My 24 months extension letter expires at the end of August 2022. Some people in this thread have advised to schedule an InfoPass appointment and to get a stamp in my passport, but my passport has expired as well. I applied for a new one in June, but it takes at least 3 months to issue it.

 

Does anyone have a link to an official document that says "your green card expires, but your status doesn't"? I remember reading that before, but now I can't seem to find it.

 

My SS card still says "valid for work only with DHS authorization" because I never thought to change it. And right now I can't even change that because I'd need my passport again. I'm worried that my employer may want a new extension letter that I don't know how to get.

 

Anyone in a similar situation and have some advice?

06/27/2018 - Interview scheduled. But we couldn't make it that day, so we called USCIS and then sent a letter to local office to re-schedule; it was granted.
08/29/2018 - Interview re-scheduled. Approved on the spot!!! They did not ask why we didn't apply for AOS right after getting married. Review in Milwaukee USCIS office submitted
09/06/2018 - Green card in hand! It took 279 days to get it, but could've been sooner if not for the RFIE and re-scheduling of interview.

6/29/2021 - case transferred to National Benefits Center
8/30/2022 - case status updated to "Ready to be scheduled for an interview".
12/07/2021 - divorce granted (we had been having issues and the marriage didn't survive). I asked to switch my petition to Divorce Waiver and sent the request off along with my reply to the RFE.
05/31/2023 - case was updated at some point to show that my biometrics were taken (they re-used the ones I provided at AOS) and on this date, status update to "Ready to be scheduled for an interview" again.
No more updates were made; I assume this case was approved as I received my citizenship.
 
Citizenship:
2/5/2024 - filed N400 online under the 5-year rule (with pending I-751).
2/9/2024 - Interview scheduled for the end of March! The fastest I ever got anything updated! Not sure if it's a combo interview or not. Following advice here, I uploaded a simple Word doc asking to waive the ROC interview or do a combo.
3/27/2024 - Interview. It was a combo interview of both ROC and 400-N. I passed the test, but a decision could not be made as the officer had to review my 2-inch-thick ROC case file.
4/8/2024 - online status got updated that an Oath Ceremony was scheduled and that they mailed me the notice! I got it in the mail 8 days later.
5/9/2024 - Oath Ceremony. I am a U.S. citizen!!!

So, to answer my own question (kind of), I just looked up Processing Times for form I-751 for Vermont Service Center and realized that my case is outside of the normal processing time! The website allowed me to fill out a Request Form to inquire about my case. Hopefully, in a couple weeks they might have an answer for me.

 

(I'm not sure why, but I've been looking up form I-485! 😅 Which told me I shouldn't inquire about my case until October of 2022. I'm so silly!)

We are in the exact same situation. We sent in the form almost 2 weeks ago. Nothing yet!  I can’t wait for this 2+ year part of the journey to be complete. I hope you hear something soon.

Thank you for replying! So validating, knowing that someone's in the same boat.

I actually got some good news today, I received my new Russian passport! I'm gonna see if I can apply for a new Social Security card, without the restriction on it, so that I can present it at work. If I can and all goes well, waiting for my ROC to be approved will be so much easier.

 

I hope you hear back from them soon! Please, stop in here and let us know what they say. I see that you didn't have an RFE, so it's really discouraging that your case is taking so long.

So, as some here suggested I called USCIS to schedule an info pass appointment. They told me I am on a waiting list and they can’t guarantee that I get an appointment before my status expires… since then I received 2 emails that “thank me for my patience” and that there are no appointments available as they go in order as you have been put on the list. 
 

my status expires September 23rd. Can I just show up at the USCIS service center and get the stamp in my passport?

Your LPR status does not expire, only proof of your LPR status expires. You remain an LPR only an immgration judge can terminate your LPR status. So you will not be "out of status" even after your extension letter expires and you only need proof of your LPR status for travel out of the USA, getting a new job, or renewing a driver's license if you are not doing any of those things you don’t need to do anything.

 

As long as you have a pending ROC you will never be out of LPR status.

Hello,

we are the same situation as you have now. The card expired two years ago, and the I797 letter expired on 9/14/2022. I called USCIS couple weeks ago. They said they scheduled us last December 2021 for interview on April 2022. But then they canceled the interview without noticed. We didn’t even get letters about scheduling and cancellation at all. We were waiting for the whole time. The lady that I was talking to, she thinks because it was Covid and USCIS at our location was limited closed or whatever, so they don’t have enough people to process. She put a notice on our document and hope to reschedule soon. She said the only thing we can do is just WAITING!!!!

 

I also asked her about the info pass, she said in our situation, for conditional green card removal, there are not a option to get the info pass stamp. She said we could apply for the reentry US form, which we need to pay for another $600 or so, file another stupid form, and wait for god know how long we need to wait for the slow government make the process.

 

it is such a very lack of communication and falling apart of process. We are now not about to travel out of country or if we travel, we will have trouble to come back. 


Anyway, I hope you and us will hear things back soon.

This is ridiculous!!!!! Paying an extra fee just because they are too slow to process the removal. It should take 3 years for them to do this. Ridiculous. Wish you all the best. My status is “waiting to be scheduled for interview” since September of last year.

Try calling them again. Maybe they're missing the fact your extension letter expired.

Thank you for your suggestions. I will try to call them again on Monday. However, if they are smart enough, they should know it as soon as they pull up our file to look when I was talking to them couple weeks ago. This is also a sign of lack of detail. Also I was clearly to asked her a couple times about the info pass. She said that it doesn’t apply to our application and situation. She could be wrong, I hope I will get a better answer from other person next time I call again.

 

This is just very disappointing and bad experience of moving into USA.
