Cannot work without a valid EAD.

Cannot leave the US and return w/o valid AP.

 

EAD + AP can be obtained via the I-765 and I-131, respectively. Timelines are ~4-7 months right now, but will probably grow given current conditions.

 

Or once you get a green card, then the above 2 documents become moot. The green card trumps the need for them.

Ok ; So when  I send the I-130 and the I-485 Packets in the mail concurrently, should also include those two documents and the same time?

Yes

Edit: Note the term "packets". Those packets include the other forms required for each (like an I-131, I-864, I-944, etc.)

You need more than just that . . .  look at the 3rd post in this thread and include the I-944. Follow all of the instructions on the forms and checklist.

Hey guys! I am currently filling out the I-130 and I am at question 20 a. : Little puzzled here. So when I filled out my marriage license she will have the same last name as me. I haven't officially changed her name yet (only filled the marriage license out so that her and I will have the same last name). When it says enter spouses last name, should I fill out her maiden name since I havent done really anything to change it yet other than the marriage license?

 

Also Question 34-36: parents town of residence and country of residence, are they asking where they are currently living now?

A marriage certificate is a legal name change document.

 

If you have only filled out a license, then the I-130 is premature (unless you are just preparing it for after marriage...in which case go by what their name will be at that time: her married name).

ok so just to be clear. Her and I got married last week. So when I put my spouse "family name" I will use her name from the marriage? (i.e. my last name)

You will use each other current (married) names.

If the name changed due to marriage, then that's the one you use. Documents can be updated later to reflect this new name (SS card, bank accounts, credit cards, passport, etc.). The EAD, AP, and green card will be issued in the name presented on the forms.

Hey friends, question on the I-130, Part 4 question 57 a-c : it is asking to write her first and last name in her native language (Bulgarian) ; should I use her maiden name or her new last name (MINE)? I'm assuming they will use her native language to search her for background check?
