Yes.  You are not able to adjust on the basis of the I-129F.

 

Two choices,   file the I-130 package and return home for consular processing or file the I-130 package, AOS package and I-944 and remain in the US and be unable to work until getting AP/EAD or GreenCard

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

Third time is charm. First time sent in March 5 rejected because an issue with our credit card. Second time rejected because I forgot to sign the I-485. Finally, third time, received on May 7. Checks cashed and case numbers received yesterday (May 14).

 

Has anybody successfully expedite EAD without biometrics post covid-19? I had biometrics from December, 2019 when I renewed my TN visa, don't know if they can used those.

03/04/2020 -- AOS package (I-130/I-485/I-864/I-944/I-765/I-131) sent to USCIS

03/05/2020 -- Package delivered to Chicago Lockbox (Rejected)

04/20/2020 -- Package delivered to Chicago Lockbox (Rejected)

05/04/2020 -- Package delivered to Chicago Lockbox

05/14/2020 -- Checks cashed. Case numbers received (4 SMS)

05/19/2020 -- NOA1 Hard copies received

12/03/2020 -- Biometrics appointment notice received (Appointment on 12/21)

12/21/2020 -- Biometrics appointment

02/25/2021 -- I-765 New Card Is Being Produced

10/07/2021 -- I-765 & I-131 Renewal Package received by USCIS

02/23/2022 -- I-485 Interview was scheduled

Have you heard back yet? Our package got delivered on the 12th so I am just waiting by my phone all day everyday now.

You'll  have to give them 30 solid working days before you panic. Sometimes it takes that long!

Mailed our application on 5/12 via FedEx and it was delivered on 5/14. Doing an AOS from J1 visa for my husband. Anxiously waiting for the NOA. Sending good vibes to all of us.

Hi All. I AM A K1 visa holder and arrived in USA in February. We got delayed to get married due to Covid 19 but eventually got married early May. Im in the process of completing forms and collecting all necessary evidence. I have 2 questions. 

1. Is it compulsory  to complete form i 131 if i do not have any plans to travel out if America any time soon.

2. My I 94 is expiring this week, will i encounter any problems for my green card application if my documents reach USCIS after my i94 expiration. Tia

I-131 is optional. It is not mandatory for you to file this form.

I dont think you'll have any issues. just file your AOS package as soon as possible.
