Green card holder cannot go back to the states due to the virus problem.

Hello all. New member here. Would like to ask for advice about my situation. Im a green card holder and currently Im in the Philippines now. My planned trip back to the states was on March 26 of this year but it was cancelled due to the virus problem. I will be reaching my 6 month stay here on the 22nd of April. Still there are news about extending the lockdown in our city which means no internarional flight. Will I still be allowed to enter the the states if I stay here for more than 6 months? Also my son will be coming with me, its his first time to go to the states with an immigrant visa that expires on April 24,2020. Thanka all.

no one can see the future to predict that. you will need to contact the embassy when everything opens back up.

Green Card holders can stay outside the US for up to 12 months  without presumption of abandonment of resident status.  On the subject of your son, if the visa expires, there are provisions in the law that allow the consulate to re-validate an expired visa with a new medical exam, fees, etc at the discretion of the consulate officer......but I would try to travel before expiration.

Thanks for the response. We already rebooked our International flight to April 17,2020. But until now there is no domestic flight.

There has been a lot in the news about rescue flights, make sure the Embassy know your situation so you are notified.

   Save all your records, flight changes, cancellation notices etc.

 

   Just in case you need it, it's best to have proof that you intended to return to the USA but were unable to.

A single trip of 6+ months but under a year is unlikely to be an issue here IMO.

There are repatriation flights as well, which I believe includes LPRs.

As noted, contact the embassy to make them aware of your situation. They can coordinate the next steps.

Philippines Department Of Tourism is also a resource.   Last Davao flight was last Thursday.  Don't know what is next

Thanks. Im at the the Philippine department of tourism site  now.  Cant find any lead to the emergency flights.
