Timeline

I finally got my RFE and from how i read it they pretty much said that I have enough proof that we live together but not enough that we are married.

 

i am unsure what else to do ,they say they want bill from us from 2016-2020 however the first year we lived with his parents so we didnt have anything at the time and i wasnt even working yet,when we moved we had our lease and utility bills which i gave alot of travel pictures and gave a affidavit from our friend that knew the both of us for 13 years but accordin to the RFE they never mentioned that they got it which i feel that is a lie cause we did, and now starting january we have to move back in with his mom to help her out so we no longer have utility bills and all we have now is our car insurance together and a couple of loans but i feel that is not enough.

 

can anyone please help me on what to do :(

Please post your letter, so we can help you better, because I am not convinced you read it right. Proof of being married would simply be a marriage certificate, but I don't believe that would be what they are asking for. Or did they ask for proof that you're living in marital union?

 

Do you have bank statements that show both of your incomes, and bills, groceries, etc. being paid form that account? Do you have life insurance showing each other as beneficiary? Health insurance with both of your names? That's just a few things I can think of right now that would be helpful.

The info on the paper has mine and my husbands name on it , do you know how to remove those ?

Thank you for posting this, it helps us understand what the issue is. So it is not so much about being married, but more about showing a continuous relationship and shared responsibility. Please see my post above with suggestions for evidence to include.

Like Joint Tax Returns, Joint Ownership of Home, Car etc, Or Both Names on Apartment lease agreement, Health Insurances together, Bills with both names like light bill, Phone bill, Life Insurance or 401K beneficiary listed as spouse etc might help to prove continuous Bonafide marriage.

thank you for helping me on this,i am trying to speak  to our old apartment providing us new copies of our leases we had since we moved in, our job is messed so we have to have our own insurance (we work for same company),i believe i have him on my life insurance i would have to see if i can get that from my hr , as for our bills is it in both our names and i did show that to them and i give him the money and he pays it for the both of us which i showed our credit number is the same but one with his name and one on mine..now that we live with his mom there is no more bills we have together but just the car insurance and possibly my life insurance with our company.

Do you mean that you were added as an authorized user to his bank account? Documentation of that would be good evidence.

 

Do you have a 401k, or some other retirement plan at work? Is he listed as your beneficiary there?

 

Do you have any pets that are registered at a vet's office under both of your names? Do you both have driver's licenses with the same address on them? Letters addressed to both of you from friends or family? Are you listed as each other's emergency contacts at work? Do you share credit cards, or are you authorized users on each other's cards? Try to think of anything where both of you could be registered, like maybe a gym, Costco, etc.

Timeline

Will, living will, power of attorney, are all relatively inexpensive and fast to do via online legal providers.  It would be a good investment of time and additional evidence that you are in a real relationship, legally connected.  Good luck!

we provided all those things and sadly was not enough for them, i will see if i can get my husband to see if i can get documentation that i am an authorized user, i think showing that are credit cards have the same number but different names on the actual cards would have been proved, sadly no pets for us, and yes we are our emergencies contacts at work an we showed them that as well, 

 

main ones i can think of that we share is our car loans and a debt me and him share to help with his surgery, we both have emergency contacts to each other for work and that one credit card ,

It's perfectly normal for USCIS to ask for more evidence since it was so long since you filed for ROC, a lot can happen in that amount by of time. It's not random. Technically you should have more than a year's worth of new evidence now than what you had when you filed in 2018.

 

Every single month there is a new bank statement (that's at least 12 new statements since you filed). Every 3, 6 or 12 months there are new insurance ID cards on the car. Every year there is a new registration document for the car. Every month there is a new phone bill, electricity bill, gas bill, water bill etc (that's a ton of new bills, at least 12 of each). Every 1, 3, 6 (whatever) month there is money going into a joint savings account. Every month there are new statements for the joint credit card, and so on. That's what they're looking for, to see that the marriage is still continuous and you're not separated etc.

I have been busy do to pandemic so sorry for late reply , I am going through all my new stuff , I have my tax returns for 2019 and our geico insurance (says we have to renew in September 2020,  but plan to renew when it’s close to September) and I am trying to fix my life insurance right now as my insurance forgot to add him , I also trying to get my old leases and new ones that we signed . Now we live with my mother in law so don’t have much like we used to. Should my mother in law write anything stating we live with her?

Hola buenas tardes alguien me puede ayudar yo ingrese mi forma I-485 y la I-765 el 15 de enero 2010 ya me tomaron huellas pero el 12 de marzo me pidieron RFE y la envié me dicen que ya la recibieron y sigue el proceso el 20 de marzo cuánto me faltaría esperar para la cita y mi tarjeta de trabajo gracias

Hi guys! I filed my 751 in to Vermont in July 2019. I got my bio-metrics done about a month later and 250 days later (03/23/2020) I received a request for additional evidence, even though the system says they're on September 2018.

Originally I sent:

1. Bank Statement (they said minimal joint usage of the account for household bills)

2. Service Member's Life Insurance naming me as beneficiary

3. My insurance naming him as beneficiary

4. Taxes transcripts for 2015 to 2018

5. Lease

6. Pay Stub

7. His military ID and mine

8. Vacation Photos

I am so confused because at our first interview we clearly discussed my husband is stationed in Virginia and I live in New York. My daughter lives with me - (not his child). I am holding down the bills in New York and he is Holding down the bills in Virginia.

Everything they asked for in the list, I've already sent but at the end of the letter is says do not send previous documents sent.

The only things I can send are:

1. His car insurance documents with my name on it as well

2. My utility bill with both our names on it

3. A letter from my daughter's school saying his is her guardian as well

4. 2 affidavit letters

5. 2019 Tax return

6. Updated photos

Should I also write a letter stating that we do not live together, he is even getting ordered to move to South Carolina...so I'm not sure what else to provide.

Please feel free to suggest any additional tips! - this is so overwhelming.
