Applying for a K3 visa after Form I-130 is filed

Hi folks!

I am from Costa Rica and have a valid 10 year B2 (tourist) visa. I currently travel back and forth to the U.S., while I wait for the form I-130 to be approved and never had any problem at the port of entry despite I have my wife and my son living in the U.S. (both U.S. citizens). The problem is we received NOA1 on sept 4th, 2019 and still we don't get any news from USCIS. Currently is being processed at Nebraska Service Center. We filed form I-130 for a CR-1 spouse visa. Is it woth to file form I-129F (Petition for Alien Fiancé) to apply for a K3 visa? Asking just because of current wait times that I believe are too long.

Wait times are what they are.

 

There is no evidence that submitting an I-129F subsequent to filing an I-130 currently results in "jumping the line" as it briefly seemed to for several months in 2019.

Your spouse should apply for K3. It will show more evidence towards a bonafide marriage. I know it’s never going to be approved but it’s part of the law and a benefit for US citizens. Like everything else U S C I S wants to drown it delays. Apparently, that’s all they can do until someone takes them to SC again.

Because the form asks for criminal record from the petitioner. That’s the only difference in the form.

If the beneficiary sees the criminal history that wasn’t possible thru just i130, then the beneficiary might divorce the petitioner. So it will do the opposite of bonafide relationship then. 😀😀

I think you're confusing IMBRA (and general I-129F) requirements with the requirement of having a bona fide relationship.

We haven't seen this trick work past October or November. So this is not worth it to file for a K3 as well

I didn’t say criminal record check is a sign of Bona fide relationship. Filing K3 is as you want your spouse to join you using every possible avenue. Btw, I’m not the beneficiary, I’m the petitioner.
